The Harrisburg Academy having offered enrullmenl to
for Ihe academic year 1995.96 as a studenl in grade K ,we herewith forward as a deposil on accounl ui mil ion for Ihal academic
year, the amount uf S500,00 (or an amount equallu the ~lal(h I, I ~')5 mumhly payment due to Ihe Academy, if paid by March 15, 1995).
Using Ihe March payment as a deposil will extend payments from June I, IW5 to July 1, 1995 for Ihis child, We understand Ihalthis
deposil will be applied 10 the second semester tuilion if we Opl :'or olher Ihan payment in full before Ihe starl of Ihe school year. We
undersland Ihal by signing and returning Ihis enrollment conlracl we have uncondilionally obligaled ourselves 10 pay Ihe full year's
luilion and fees, as shown on Ihe reverse side of Ihis page, for the i1pplicable grade, and are reserving a plilce for our child for Ihe enlire
academic .year. We understand and i1gree Ihal our obligalion for the full year's tuition ,and fees will nOI be reduced or excused by
withdrawal, dismissal from lhe Academy, i1lne", disilbililY. death or any other absence for any cause since we recognize and acknowl.

AND NOW, comes plaintilT, The Trustees of the Harrisburg Academy (the
"Academy") by and through their attorneys, Melle, Evans & Woodside, who respond
to the New Matter of Defendant Christine Knackstedt (hereinafter "Knackstedt") as
follows:
19. Plain tilTs incorporates its allegations as fully set forth in paragraphs 1
through 18 of its Complaint.
20. Denied. After a reasonable investigation, Plain tilT is without sufficient
information or knowledge sufficient to form a belief as to the truth of the factual
averments of the corresponding paragraph of Knackstedt, the same is therefore
denied and strict proof, if relevant, is demanded at the time of trial.
21. Denied. By way of further answer, Knackstedt does not allege failure
of PlaintilT to meet any statutory or contractual notification period,

Defendants in the above~aptioned matter. by and through their attorney, Jeffrey R,
Boswell, Esquire and Boswell, Snyder, Tintner and Piccola in answer to the Complaint filed
by Plaintiff hereby state as follows:

12, Denied. Defendant Knackstedt is unaware what payments, if any, have been
made and demands proof at trial.
13. Admitted.
14. Denied, Defendant Knackstedt disclosed at the time of execution of the
contract that each of the parents would pay one-half (1/2) of the amount required for
tuition, aftcr full credits for scholarship assistance, which arrangement was acceptable to the
Plaintiff. The contract does not disclose that each one of the parents is or would be
individually responsible for the entire obligation.
15. Denied, The Plaintiff accepted til11ely payments from the Defendant
Knackstedt without question, as noted by the cancelled checks that are allached on two
pages incorporated as Knackstedt Exhibit" A."
16. Denied, The contract must be interpreted given the acceptance of partial
payments from Defendant Knackstedt and failure to notify Defendant Knackstedt that an
equal allocation of cost to mother and father was not acceptable, creating a circumstance
of justifiable reliance by Defendant Knackstedt to continue the enrollment of the minor
Maura Knackstedt for the entire academic year,
17. Denied. The Plaintiff did accept Defendant Knackstedt's payments based
upon an arrangement made at the time of the execution of the agreement and thereafter
on February 22, 1995, when Dcfendant Knackstcdt cxccutcd the agrecment and then on
April II, 1995, when Dcfcndant Barber cxccuted the agreement, thcreby accepting his
individual responsibility, In addition, Defendant Knackstedt callcd the Harrisburg Academy
busincss officc to inquirc as to thc exact figurc for hcr final paymcnt which was represcnted
by Defendant's representative to be $804.82, as noted in Defendant's check number 1108,
dated April 26, 1996, made payable to the order of the Harrisburg Academy, noting on the
check "final payment on account."
18. Denied. Defendant Knackstedt has made full payment equal to one-half (1/2)
of the tuition fees owed, specifically denying that she has any obligation to pay the
remaining balance alleged.
NEW MATIER
19. Defendant Knackstedt incorporates the answers to paragraph 1 through 18 in
this New Matter.
20. After inquiry by Defendant Knackstedt to Plaintiff, Defendant Knackstedt
tendered her check number 1108 on April 26, 1996, noting "final payment on account,"
which check was accepted by the Harrisburg Academy by deposit to its account by the
Harrisburg Academy on April 30, 1996, without comment to Defendant Knackstedt nor
qualification to Defendant Knackstedt as to the notation "final payment on account."
21. The Plaintiff failed to notify Defendant Knackstedt in a timely manner that
Defendant James Barber did not make timely payments for tuition as now alleged.
