FINAL ORDER OF COURT APPOINTING PLENARY GUARDIAN

this case having been held on
, 1994, a hearing in

appearing to the Court that Bernar'd F. Brinkerhoff was served
with a Citation and Notice of his hearing on
1994, and that he was present at the hearing, the Court finds
from the testimony:
1. That Bernard F. Brinkerhoff suffers from Parkinson's
disease and dementia, a condition or disability which totally
impairs his capacity to receive and evaluate information
effectively and to make and communicate decisions concerning his
management of financial affairs or to meet essential requirements
for his physical health and safety.
2. That because of the execution of a purported Revocation
and a purported new Power of Attorney there are insufficient
supports available to assist Bernard F. Brinkerhoff in such
decisions and that there exists no other less restrictive
alternative mechanism for decision making.
3. That based on the total incapacity of Bernard F.
Brinkerhoff to reoeive and evaluate information and to make or
oommunicate decisions, a plenary Guardian of the Person and a
plenary Guardian of the Estate are required on a permanent basis.

NOW, THEREFORE, based on the clear.and convincing evidence
,supporting the foregoing findings it is ORDERED, ADJUDGED and
.DBCRBBD that Bernard F. Brinkerhoff be and is hereby adjudged a
totally incapacitated person and Bernadette B. Marino is
appointed Plenary Permanent Guardian of the Person and Plenary
Permanent Guardian of the Estate.
The named Guardian, as attorney-in~fact, may continue to
enter any safe deposit box in th~ name of the incapacitated
person alone or in the names of the incapacitated person and
another or others as if no guardian had been named.
The named guardian may otherwise continue to act as
attorney-in-fact in the same manner as she has heretofore.
An Inventory must be filed within ninety (90) days. A
report by the Guardian shall be filed within twelve (12) months,
and annually thereafter.
Bernard F. Brinkerhoff, an incapacitated person, has the
right to appeal this Order of Court by filing exceptions within
ten days of this date or to petition this Court for. a review
hearing to modify or terminate the guardianship herein
estab1 ished.
IT IS HEREBY FURTHER ORDERED AND DECREED that the Revocation
dated August 29, 1994, and the Power of Attorney dated August 29,
1994, are hereby declared to be invalid and void, and the Power

YOU ARE HEREBY NOTIFIED THAT THE ATTACHED PETITION FOR THE
APPOINTMENT OF A GUARDIAN HAS BEEN FILED WITH THE ORPHANS' COURT
OF CUMBERLAND COUNTY AND THAT A HEARING ON THE PETITION HAS BEEN
SCHEDULED BEFORE , IN COURTROOM NUMBER ___,
LOCATED IN THE CUMBERLAND COUNTY COURTHOUSE, AT 1 COURTHOUSE
SQUARE, CARLISLE, PENNSYLVANIA, ON THE ______ DAY OF

THE PURPOSE OF THIS HEARING IS TO DETERMINE:
1. WHETHER YOU SUFFER FROM ANY MENTAL OR PHYSICAL
IMPAIRMENT WHICH WOULD AFFECT YOUR ABILITY TO RECEIVE AND
EVALUATE INFORMATION EFFECTIVELY AND COMMUNICATE DECISIONSI AND
2. WHETHER SUCH IMPAIRMENT, IF ANY, IS SIGNIFICANT ENOUGH
TO RENDER YOU PARTIALLY OR TOTALLY UNABLE TO MANAGE YOUR

3. WHETHER THE COURT SHOULD DECLARE THE PURPORTED
DOCUMENTS, AT'l'ACHED TO THE PETI'rION AS EXHIBIT "A", PREPARED BY
ATTORNEY BROWN TO BE INVALID UNDER SECTION 715(4) OF THE
PENNSYLVANIA ESTATES AND FIDUCIARIES CODE.
AT THE TIME OF THE HEARING, THE COURT WILL RECEIVE EVIDENCE
ABOUT YOUR ALLEGED INCAPACITIES OR FUNCTIONAL LIMITATIONS. IF
THE COURT DETERMINES THAT INCAPACITIES OR FUNCTIONAL LIMITATIONS
EXIST, THE COURT MAY APPOINT A GUARDIAN TO ACT ON YOUR BEHALF.
THE APPOINTMENT OF A GUARDIAN IS A MATTER OF GREAT IMPORTANCE
SINCE IT WOULD RESTRICT AND INFRINGE UPON YOUR LEGAL RIGHT TO
PERFORM CERTAIN ACTIVITIES OR TO MAKE CERTAIN DECISIONS, POSSIBLY
INCLUDING THE RIGHT TO HANDLE YOUR OWN MONEY AND TO DECIDE WHERE

DUE TO THE SERIOUSNESS OF THIS PROCEEDING, YOU HAVE THE
RIGHT TO REQUEST THE APPOINTMENT OF COUNSEL AND TO HAVE COUNSEL

AFFORD COUNSEL, YOU HAVE THE RIGHT TO HAVE SUCH COUNSEL PAID FOR

7. Petitioner estimates the alleged inoapacitated person's
annual income to be $l3,968.00, including monthly social Security
benefits of $403.35.
8. The name and address of the institution now providing
residential services to Bernard F. Brinkerhoff is Cumberland
crossing, 1 Langdorf Way, carlisle, Pennsylvania 17013.
9. Bernard F. Brinkerhoff was never a member of the Armed
services of the United states. Bernard F. Brinkerhoff is not

Administration.
10. Petitioner asks that she, Bernadette B. Marino, be
appointed as guardian of the estate and of the person of Bernard
F. Brinkerhoff. The proposed guardian is a sister to Bernard F.
Brinkerhoff.
11. The proposed guardian has no interest which is adverse
to the interests of Bernard F. Brinkerhoff.
12. Petitioner believes, and therefore avers that no Court
has ever assumed jurisdiction in a proceeding to determine
whether Bernard F. Brinkerhoff is incapacitated.
13. Petitioner believes, and therefore avers, that Bernard
F. Brinkerhoff does not have a guardian already.
14. The reasons why this guardianship is sought are as
follows:
a. Petitioner has been acting as attorney-in-fact for
Bernard F. Brinkerhoff since 1991. During that time, she has
diligently fulfilled this duty with the best interest of Bernard
being her only oonoern. She and Bernard have always had a olose
relationship, and he depended upon her even before he beoame
inoapacitated by his illness.
b. Their sisters, Irene Mendock and Dolores Looker, have
reoently become interested in Bernard's affairs, particularly his
finances. On August 29, 1994, Irene Mendock and Dolores Looker
took Bernard to the offices of Attorney Jan L. Brown in order to
cause him to execute an alleged Revocation of the Power of
Attorney held by Petitioner for the past 21 years, and to execute
an alleged new Power of Attorney designating all three sisters,
Irene Mendock, Delores Looker, and Petitioner, as Respondent's
agents. A copy of the alleged Revocation and alleged new Power
of Attorney is attached hereto as "Exhibit A". 'l'his was done
without informing Petitioner until after the faot, through a
letter from Attorney Brown, a copy of which is attached hereto as
"EXhibit B".
c. Being close to Bernard and familiar with his condition,
and after examining the 'alleged new documents and conSUlting with
Bernard's doctors, Petitioner believes that Bernard lacked the
capaoity neoessary to request and exeoute the documents prepared
by Attorney Brown and that they were the product of fraud,
duress, and undue influence exerted by Irene Mendoch and Delores
Looker. Petitioner also has concerns about the future
implications of any action her sisters may take pursuant to the
purported new Power of Attorney, including possible "gifting".

d. The existenoe of thase doouments, and their purported
,legal effeot, are oreating diffioulty in the administration of
Bernard's affairs. Petitioner believes the alleged new Power of
Attorney to be invalid, and her attorney has advised Dauphin
Deposit Bank ancl Trust Company, which holds many of Bernard's
assets, not to honor the said alleged Power of Attorney.
Unfortunately, the Bank must now take the position that it will
honor neither the original nor the alleged new Power of Attorney

until the Court resolves this matter. Aooordingly, Petitioner
seeks a rUling from this Court regarding the validity of the
purported Revooation, the purported new Power of Attorney, and of
any other purported legal documents executed at the behest of
Irene Hendoolc and Delores Looker, Petitioner believes the
eBtablishment of a guardianship to be the only remaining way to
ensure that the best interests of Bernard are proteoted, as it is
the only guarantee that the same or similar doouments will not be
"exeouted" again in the fut.ure.
15. The funotional limitations and physioal and mental
condition of Bernard F. Brinkerhoff are that he has Parkinson's
disease and dementia, which make him dependent on others for
assistanoe regarding his daily life.
16. There are no less restrictive alternatives to the
appointment of a guardian for the reasons alluded to in Paragraph
. Fourteen above.

,17. Petitioner requests that the quardian be granted power
to aot for Bernard F. Brinkerhoff in all matters regarding his
finances and his daily life.
18. The proposed guardian has the following qualifications:
Petitioner is the sister of Bernard F. Brinkerhoff, and has
acted on his behalf as power of Attorney for the past four years.
She cares for him deeply, and has nothing but his best interest
at heart. She is familiar with his affairs, both personal and
finanoial, and she wishes only to do what is right for Bernard.
WHEREFORE, Petitioner respectfully requests that the Court/
under section 5511 of the probate, Estates and Fiduciaries Code,
issue a oitation to Barnard F. Brinkerhoff, Bernard F.
Bril'\kerhoff's next of kin, and to such other persons as the Court
directs, to show cause why Bernard F. Brinkerhoff should not be
adjudged to be an incapacitated person and plenary guardian of
his person and his estate be appointed. Further, pursuant to
section 715(4) of the Pennsylvania Estates and Fiduciaries Code,
Petitioner respectfully requests the Court to declare the
purported doouments prepared by Attorney Brown to be invalid.
