AND NOW, this I 'ji/ day of 6::p\" , 1995 upon
consideration of the stipulation between Debtor Barbco, Inc. and
the Borough of Mount Holly Springs, this court's order of January
17, 1995, the Certification of Default filed by the Borough of
Mount Holly Springs in this matter as well as the Motion of the
Borough of Mount Holly springs requesting the automatic stay be
lifted, it is hereby ORDERED that the Motion is Granted and that
the automatic stay in this proceeding is terminated with respect
to the Borough of Mount Holly Springs. If is further ordered
that the Borough of Mount Holly springs is hereby permitted to
exercise all remedies available to it, whether against the Debtor
or its property.

DEFENDANT'S ANSWER TO PLAINTIFF'S COMPLAINT
AND NOW, comes Defendant, Barb Co. (sic) (correctly
Barbco) by and through its attorneys, cunningham & Chernicoff,
P.C., and files its Answer to Plaintiff's complaint and in
support thereof, avers as follows:

8. The answers contained in Paragraphs 1 through 7,
inclusive, of this Defendant's Answer to Plaintiff's Complaint
are incorporated herein as if more fully set forth at length.

10. Defendant is without knowledge sufficient to form a
belief as to the truth of the averments set forth in Paragraph
10 of the Plaintiff's complaint and strict proof of the same
if relevant is demanded at the time of trial.
11. Defendant is without knowledge sufficient to form a
belief as to the truth of the averments set forth in Paragraph
11 of the Plaintiff's complaint and strict proof of the same
if relevant is demanded at the time of trial.
12. Defendant is without knowledge sufficient to form a
belief as to the truth of the averments set forth in Paragraph
12 of the Plaintiff's complaint and strict proof of the same
if relevant is demanded at the time of trial.
13. Admitted in part, denied in part. It is admitted
that Defendant has not submitted payment for all services
(sewer, water and trash) provided for by Plaintiff. It is
denied that Defendant has refused to make payment. To the
contrary, Defendant has, on several occasions, indicated a
willingness to pay any amount reasonably owed to the Plaintiff
for the providing of sewer, water and trash services. However,
despite numerous attempts by Defendant to obtain information
regarding the charges alleged by Plaintiff, Plaintiff has
refused to provide an itemized invoice evidencing the alleged
balance.
14. Admitted. By way of further answer, Defendant
believes, and therefore avers, that the amount sought in
Paragraph 14 of Plaintiff's Complaint is incorrect and that
Plaintiff is attempting to charge Defendant an amount that
exceeds that normal charges associated with the providing of
sewer, water and trash services.
15. Denied. To the contrary, Defendant has consistently
and continuously requested from Plaintiff, or Plaintiff's
agents, an itemized accounting for all alleged charges.
Despite these requests, Plaintiff and/or Plaintiff's agents
have refused to provide Defendant with an itemized accounting
thus, precluding Defendant from evaluating the accuracy of
such invoices.
16. The averment contained in Paragraph 16 of
Plaintiff's complaint is specifically denied and strict proof
thereof is demanded at the time of trial.
17. Admitted in part, denied in part. It is admitted
that presently, Defendant charges its tenants for services
provided by the Plaintiff by way of supplemental rent.
However, it is denied that Defendant charged its tenants this
"supplemental rent" for the relevant time period for which
Plaintiff claims to be owed and strict proof thereof is
demanded at the time of trial.
18. Denied. It is denied that Defendant directly charged
its tenants for sewer, water and trash for the relevant time
period for which Plaintiff claims to be owed and strict proof
thereof is demanded at the time of trial.
19. Defendant is without knowledge sufficient to form a
belief as to the truth of the averments set forth in Paragraph
19 of the Plaintiff's complaint and strict proof of the same
if relevant is demanded at the time of trial. By way of
further answer, Defendant objects to, and challenges, the
accuracy of the account statement attached to Plaintiff I s
Complaint as Exhibit "B".

10. Denied. It is denied that Plaintiff has prematurely
listed this case for arbitration. It is further denied that
there is any outstanding discovery that needs to be completed.
By way of further response, Defendant Barb eo. has never engaged
in any discovery in this case.
11. Denied. It is denied that Defendant Barb Co. will be
prejudiced in any manner if a "statement of accounting" is not
provided to Defendant. It is further denied that Defendant has
made any request for a statement of accounting prior to the time
this case was listed for arbitration.
12. Denied. It is denied that Plaintiff will not be
prejudiced. To the contrary, Defendant Barb Co. has not made all
payments due since the filing of this action in July, 1997.
WHEREFORE, Plaintiff Borough of Mount Holly Springs requests
this Court to dismiss Defendant Barb Co.'s objections to the
Petition for Appointment of Arbitrators in this action.
NEW MATTER
13. Barb Co. at no time engaged in any discovery under the
Pennsylvania Rules of civil Procedure in this case.
14. Barb Co. was not a party to the action docketed to No.
97-6418 Civil, Cumberland County between the Borough of Mount
Holly Springs and Commerce Bank.
15. Page Macdonald-Matthes never made a request of
Plaintiff for an accounting or a statement of account until such

3, Since July 14, 1997 Plaintiff and Defendant have
been engaged in discovery to ascertain what amounts, if any,
are actually due and owing to Plaintiff,
4. During the pendency of the above referenced action,
Plaintiff attempted to bring a civil action against Commerce
Bank for the same claims raised against Defendant, in light of
the fact that Commerce Bank collects the rents from the
various residents of Defendant's mobile home park pursuant to
an order of the United States Bankruptcy Court for the Middle
District of Pennsylvania.
5. Before Plaintiff determined to withdraw its action
against Commerce Bank, counsel for Commerce Bank, Andrew
Dowling, Esquire and counsel for Defendant, Paige Macdonald-
Matthes, Esquire appeared before the Honorable Kevin A, Hess
on February 12, 1998 to request the Court's intervention with
Defendants request for a complete accounting from Plaintiff
and Plaintiff's refusal to provide the same. At the
conclusion of the hearing, Judge Hess directed that
Defendants' counsel be permitted to inspect the Plaintiff's
records. Judge Hess further directed that if after the
