COMPLAINT
1. Plaintiff is Julia Louise Jeselnick, who currently
resides at 37 South Front Street, Halifax, PA 17032.
2. Defendant is Rodger Theodore Atwood, who currently is in
FCI Federal Correctional Institute, PO Box 2000, White Deer, PA
17887.
3. Plaintiff has been a bona fide resident of the Common-
wealth of Pennsylvania for a period of more than six (6) months
immediately preceding the filing of this Complaint.
4. On October 31, 1991, a wedding ceremony was performed
between Plaintiff and Defendant at Hagerstown, Maryland. A true
and correct copy of the parties' marriage certificate is marked
Exhibit "A," attached hereto, and made part hereof.
5. On or about November 14, 1991, the parties separated and
have continued to live separate and apart since.
7. There has been no prior action for divorce or annulment
instituted by either of the parties in this or any other juris-
diction.
8. Neither Plaintiff nor the Defendant is in the military or
naval service of the United States or its allies within the
provisions of the Soldiers' and Sailors' Civil Relief Act of the
Congress of 1940 or its Amendments.

MOTION TO COURT TO ENTER DEFAULT
JUDGMENT AGAINST DEFENDANT
AND NOW, this ~ day of August, 1997, the plaintiff above
named, by her attorney, James P. Gregorowicz, Esquire, moves the
court to enter judgment against the defendant declaring the
marriage contract entered into between plaintiff and defendant
invalid pursuant to 23 Pa.C.S. Section 3306, for the following
reason:
1. On or about July 14, 1997, a Complaint and Notice to
Defend was filed by plaintiff requesting a Declaratory Judgment
pursuant to 23 Pa.C.S. Section 3306 seeking a declaration of the
invalidity of the marriage entered into between plaintiff and
defendant. On or about July 15, 1997, defendant received a copy
of the said Complaint and Notice to Defend by first class mail.
A copy of the returned receipt is attached and marked as Exhibit
"All.
2. In paragraph 11 of the plaintiff's Complaint, the
plaintiff expressly avers that the marriage contract entered into
by and between plaintiff and defendant is invalid because it was
entered into while a former marriage still subsisted between
Defendant and Donna Lee Meyers-Atwood. True and correct copies
of the relevant pleadings are attached as Exhibit "B".
3. On or about August B, 1997, plaintiff filed a Notice of
intention to file a praecipe for Default Judgment pursuant to
Pennsylvania Rules of Civil Procedure, Rule 237.1. A copy of the
Notice was received by defendant on or about August B, 1997 by
first class mail. A copy of the Notice and returned receipt is
attached and marked as Exhibit "C".
4. Since defendant has failed to file an Answer within the
required time, and all averments of plaintiff's Complaint are
thus deemed admitted, plaintiff is entitled to an Order for
Judgment upon Default pursuant to Rule 1037 of Pennsylvania Rules
of Civil Procedure.
