At approximately 9:24 A.M. on July 15, 1995, Plaintiff, Eugene Gordon, was in'the process of crossi ng the street a-t the intersection of Broad and Girard Streets, in the city of Philadelphia. 7. At the same time, Defendant, Willie R. Alexander, was entering into the intersection of Broad and Girard Streets in the city of Philadelphia. 8. Plaintiff, Eugene Gor'don, stepped obeying all traffic rules and right-of-ways, Defendant's vehicle. into the street. and was struck by 9. Plaintiff, Eugene Gordon, was imm('diately transported to Hahnemann University Hospital, Plttsburqh, ['('nnsylvania, where he was admitted and treated for neck and hedd t r'auma. 10. Plaintiff, Eugene ('.erdon, was later released from Hahnemann University Ilospital. 11. Defendant, Willie R. It\ ,I proptH look. out for ll('tlt~st r HillS; O. failillq 10 .Ipply IllS h!d~t'S III 11m." to iwoid COUNT I MOTION TO STRIKE FOR IMPROPER VENUE OR IN THE ALTERNATIVE, TO TRANSFER VENUE TO PHILADELPHIA COUNTY 3. Pa.R.C.p. 1028(a) (1) permits the filing of Preliminary Objections where venue is improper in the jurisdiction in which the action was commenced. 4. Pa.R.C.P. 1006 provides that, with enumerated exceptions not applicable hereto, an action against an individual may be brought in and only in a County in which the individual may be served or in which the cause of action arose or where a transaction or occurrence took place out of which the cause of action arose. S. Venue with respect to this proceeding is inappropriate in Cumberland County because the Defendant does not reside in Cumberland County, cannot be served in Cumberland County, and the cause of action giving rise to Plaintiffs Complaint did not occur in Cumberland County. 6. Defendant submits that appropriate venue in this matter lies exclusively in Philadelphia County. 7. The Court of Common Pleas of Cumberland County does not have venue of this action and the matter must therefore either be stricken or transferred to the Court of Common Pleas of Philadelphia County. WHEREFORE, Defendant respect full y requests this Honorable Court to grant Defendant's Preliminary Objections and either strike the Complaint or transfer this matter to Philadelphia County and Impose the costs of sald transfer ut'On tht" Plaintlffs. COUNT II MOTION TO STRIKE FOR LACK OF SPECIFICITY 8. The averments contained in paragraphs one through seven (1-7) hereinabove are specifically incorporated herein by reference. 9. Pa.R.C.P. 1019(a) requires that material facts upon which a cause of action is based be stated in a concise and summary form. 10. Pennsylvania law requires a Plaintiff to plead sufficient facts to give a Defendant notice of the nature of Plaintiff's claim and to adequately inform the Defendant of the relevant issues. 11. Sub-paragraphs (f) and (g) of paragraph eleven (11) of Plaintiffs' Complaint avers that Mr. Alexander was negligent as follows: f) behaving in a negligent and reckless manner under the existing circumstances; and g) Violated the Statutes of the Commonwealth of Pennsylvania pertaining to the operation of motor vehicles upon highways or roadways. 12. Such boiler plate averments fail to contain the required specificity and should be Ordered stricken from Plaintiffs' Complaint, or, in the alternative, Plaintiffs should be required to re-plead the Complaint with the requisite specificity. WHEREFORE, Defendant respectfully requests this HonOrable Court to strike sub-paragraphs ll(f) and (9) of Plaintiffs' C,~laint, or in the alternative, require Plaintiffs to provide a ~~te specific pleading.
