to law deposes and says: that he is a principal in the law firm
of Snelbaker, Brenneman' Spare, P. C., being the attorneys for
Keith A. Rockey, the Plaintiff in the above captioned action in
divorce; that on July 15, 1997, he did send to Defendant Betty J.
Rockey by certified mail, return receipt requested, restricted
delivery, a duly certified copy of the Complaint in Divorce which
was filed in the above captioned action as evidenced by the
attached cover letter of the same date and Receipt for Certified

dated June 10, 1999, the full-time Master has been appointed in
the above referenced divorce proceedings,
A divorce complaint was filed on July 15, 1997, raising
grounds for divorce of irretrievable breakdown of the marriage
and the economic claim of equitable distribution.
On May 3, 1999, an affidavit under Section 3301(d) was
filed by the Plaintiff averring that the parties have been
separated for a period of at least two years, since April 15,
1997. The Defendant filed a counter-affidavit indicating that
she wishes to claim economic relief; however, no claim. have
been raised by the Defendant. The only claim pending before the
Master is the claim of equitable distribution.
I am going to proceed on the basi. that there i. no issue
with respect to the date of separation and that the parties
have, in fact, been separated for at least two yeara.
Therefore, grounds for divorce are not an issue. I am directing
each counsel in accordance with P,R.C,P, 1920.J3(b) to file a
pretrial statement on or before Monday, July 12, 1999. Upon

Present for the Plaintiff, Keith A. Rockey,
is attorney Keith O. Brenneman, and present for the
Defendant, Hetty J. Rockey, is attorney John J. Mooney, III.
A divorce complaint was filed on July 15,
1'l97, raislnq grounds for divorce of irretrievable breakdown
of the marriage. Although an affidavit under Section
]]Olldl was filed on May 3, 1999, averring a separation in
excess of two years, counsel have indicated that the parties
will slqn and file affidavits of consent and waivers of
notice of intention to request entry of divorce decree so
that the divorce can be concluded under Section 3301(c) of
the Damest IC Relations Code.
The complaint also raised the economic claim
of eqUitable distribution. On August 15, 1997, the
lIelendant wife filed an answer and counterclaim raising
ildditional economic issues of alimony, alimony pendente
lite, and counsel fees and expenses. With respect to the
alimony claim, counsel have indicated that they do not
anticipate offering any testimony on the factor of marital

The parties were married on August 28, 1993,
and separated April 15, 1997. There were no children born
of the marriage although both parties have adult children
from prior marriages.
Husband IS ~9 years of age and reSides at
4075 Pufus King Court, Enola, Pennsylvania, where counsel
believe he lives alone. He has a Bachelor's degree and is
currently employed as a budget analyst wlth the Commonwealth
uf i'enn:;ylvdnia. He has been wnh the co=onwealth for
approximately 18 yedrs. An order entered Nove~ber 21,
1997, show~d his net monthty Income at $2,903,00. Husband

Gun Club Road, York Springs, Pennsylvania 17372 where she
lives alone. She is a high school graduate and is a
teacher's aide with the Bermudian Springs School District.
She has worked for the district for approximately 27 years.
The order entered on November 2l, 1997, showed her net
monthly income at $1,632.00. She also has a part-time job
as a distributor for Market America, Wife is also going to
file a current income and expense statement showing income
and expenses to update the prior income information. Wife
is also receiving a pension benefit as a result of her prior
marriage and the death of her husband. The amount of that
benefit is $285.71 per month. Wife has not raised any
health issues. She is going to be able to use the medical
insurance benefit through her employer.
The parties owned real estate at 1714 Loring
Lane, Mechanicsburg, Pennsylvania, which was sold and the
net proceeds were placed in an escrow account at PNC Bank.
The amount in the account, shown on the pretrial statement,
is $82,558.51 plus interest that has been earned since the
date the account was opened. Counsel will provide updated
information on the value of that account.
Husband has a 1996 Buick Regal sedan which he
has valued at $7,130.00. Wife continues to use the vehicle
which she had prior to the parties' marriage.
Counsel have indicated that the parties have
divided the household tangible personal property but husband
reserves the rIght to have all of the property appraised.
Counsel need to determine whether they want to use any
values for the property in each party's possession as part
of the total value of the marital estate.
Husband is a participant in the PSERS
Retirement System and wife is a partlcipant in the Bermudian
Springs School District pension which 15 also PSERS.
Counsel have indlcated that they would likE' to try to

Husband had a condo in South Carolina which
was nonmarital and according to Mr. Brenneman when it was
sold there was no increase in value. He can provide Mr.
Mooney with documentation showing the value at time of
separation and sale price if that is necessary to confirm
that there is no increase.
Husband also had two investment accounts,
nonmarital, with Morgan Stanley Dean Witter and according to
Mr. Brenneman the increase in value of those accounts was
around $130,945.00.
Mr. Brenneman has requested information
regarding some annunities which wife has. The purpose of
the inquiry is to determine if there has been any increase
in value of those annunities since they were owned by wife
prior to the marriage. Mr. Mooney is going to provide
information to Mr. Brenneman as Mr. Brenneman may require.
There is no marital debt.
Wife has raised an alimony claim and as
noted, is receiving $1,008.00 per month in alimony pendente
lite. The Master has suggested that one way of resolving
the case would be to weigh the distribution of the marital
assets in favor of wife and in return wife would forego her
alimony claim. Husband has pointed out that this is a
short-term marriage and he obviously does not want to have
ongoing financial ties with wife following the entry of a
divorce decree.
The Master has suggested that the parties
request a conference with the Master after they have
developed the numbers which need yet to be determined.
This conference can be scheduled within two weeks of request
by counsel during an afternoon session to bring the parties
in and see if we can resolve the outstanding issues.
Counsel should be prepared at that time to bring in a
worksheet showing their valuation of the assets in the
marital estate.
A hearing is sCheduled for Tuesday, June 20,
2000, at 9:00 a.m. Notices will be sent to counsel and the
parties.

PETITION TO MODIFY ALIMONY PENDENTE LITE ORDER
Plaintiff/Petitioner Keith A. Rockey, by his attorneys,
Snelbaker, Brenneman & Spare, P. C" submits this Petition to
Modify the Alimony Pendente Lite Order dated July 27, 1998 as
follows:
1, Petitioner is Keith A. Rockey, an adult individual.
2. Respondent is Betty J. Rockey, an adult individual.
3, On November 21, 1997 this Court issued an Order
directing Petitioner to pay $508.00 per month as alimony pendente
lite effective August 18, 1997.
4. Respondent Betty J. Rockey timely appealed the Court's
Order dated November 21, 1997.
5, Prior to a hearing on the aforesaid appeal, Petitioner
and Respondent agreed to include an additional sum of $500.00
each month retroactive to August 19, 1997 to account for income
being earned by Petitioner from Petitioner's investment account.
6. On April 3, 1998 Petitioner and Respondent entered into
a Stipulation For Alimony Pendente Lite which Stipulation
resulted in an Order of Court dated July 27, 1998 modifying the
I "ovember 21, 1997 Order to increase the monthly alimony pendente
I lite Obligation Of Petitioner to $1,008.00.

7, On February 3, 1999 Respondent's deposition was taken in
the parties' divorce action docketed to No. 97-3824 civil Term,
Cumberland County,
8. At the aforementioned deposition, Respondent testified
to receiving beginning in March, 1998 a monthly payment of
$297.37 from a Caterpillar non-contributory pension plan, A true
and correct copy of pages 12 and 13 of Respondent's deposition
testimony taken February 3, 1999 is attached hereto and
incorporated by reference herein as "Exhibit A".
9, At the time the parties entered into the Stipulation,
which became part of the Order of Court dated July 27, 1998,
Respondent was aware of the additional income she was receiving
from the Caterpillar non-contributory pension plan as more fully
set forth above.
10. The caterpillar non-contributory pension plan monthly
benefit received by Respondent was not taken into consideration
in determining Respondent's net monthly income for alimony
pendente lite purposes.
11. Respondent intentionally failed to advise Petitioner or
Petitioner's counsel of her receipt of the Caterpillar non-
contributory pension plan payment.
12. Petitioner'S investment income, which income in
substantial part was considered in establishing Petitioner's
monthly alimony pendente lite obligation, has been reduced.
13. Petitioner is no longer working all part-time jobs in

Plaintiff's prior marriage ended in divorce.
For the past 27 Defendant has worked full-time as a
teacher's aide for Bermudian School District. Since 1996 in
addition to her full-time employment, she worked on a part-time
basis as a distributor for Market America.
STATEMENT PURSUANT TO Pa.R.C.P, 1920.33tbl.
The following substantially corresponds to the Paragraphs of
Pa.R.C,P. 1920,33(b) setting forth the content of the Pretrial
Statement:
1. MARITAL ASSETS.
a. Marital Re.idence.
The parties before they were
married purchased a home in Hay, 1993 located at 714 Loring Lane,
Hechanicsburg, Upper Allen Township, Cumberland County for the
I price of $158,700.00. Plaintiff contributed $7,500.00 cash for
the purchase while Defendant paid $60,000.00 financed by a swing-
loan on her previous residence. The residence was sold after
this action was initiated at which time the parties' mortgage was
paid off. The net proceeds of the sale - $82,558.51 - were
deposited by mutual agreement of the parties in an interest-

L bearing escrow account pending conclusion of this case. Each

b. Household Goods, Furnishings, Miscellaneous Tangible
Personal Property.
The parties have divided marital goods and furnishings by
prior agreement. Plaintiff reserves the right to appraise
marital personalty as necessary.
c. Kotor Vehicles.
The only vehicle which is marital property is a 1996 Buick
Regal sedan purchased by Plaintiff immediately prior to
separation. It has an estimated value of $7,130.00.
d. Cbecking, Savings and Otber Account..
The parties had no joint banking accounts during their
marriage, with the exception of one account owned by Plaintiff
upon which Defendant was added for purposes of convenience. This
account pertained to his non-marital condominium property (see
below) which maintained a minimal balance and was closed.
.. Harital Debt.
The only marital debt that existed was the mortgage on the
marital home which was paid and satisfied when the home was sold,

VIII, RETIREMENT/PENSION BENEFITS.
Plaintiff is vested in a retirement benefit provided by the
Commonwealth of Pennsylvania State Employes' Retirement System.
Valuation of his retirement benefit on both the date of marriage
and the date of the parties' separation will be provided.
Defendant receives a pension benefit as a result of her
employment with Bermudian School District as a teacher's aide.
Plaintiff has no current information concerning the value of that
benefit.

Plaintiff defers to Defendant as to a statement concerning
any claim of counsel fees or expenses that she may have.

TO: E. ROBERT ELICKER, II, DIVORCE MASTER
AND NOW, comes the Defendant, Betty J. Rockey, by and
through her attorneys, Mooney & Associates, by John James
Mooney, III, Esquire, and files the within Defendant's Pre-Trial
Statement in accordance with Pa.R.C.P. 1920.33(bl and the
direction of the Divorce Master as follows:
A. BACKGROUND
Defendant is essentially in agreement with the background
cited in Plaintiff's Pre-Trial Statement. In addition,
Defendant would indicate that she had, prior to marriage to
Plaintiff, been receivinq a pension benefit in an amount in
excess of $600.00 per month and by reason of Defendant's
marriage to Plaintiff, Defendant ceased receiving the same. It
was not until March of 1998 that [lE!fendant began receiving a
monthly pension cheCk (by reason of her deceased husband's

employment) in the amount of $285.71.
STATEMENT PURSUANT TO Pa.R,C.P, 1920,33fbl
The following substantially corresponds to the Paragraphs
of Pa.R.C.P, 1920,22(b) setting forth the content of the Pre-
trial Statement:
I. MARITAL ASSETS
a. Marital Residence. The parties did purchase a marital
residence as referred to in Plaintiff's Pre-Trial Statement. It
should be noted that Defendant paid all of the interest on the
$60,000.00 that was contributed to the residence and upon sale
of her residence paid off that loan. In addition, throughout
the course of the parties' marriage, despite a great discrepancy
in income, the parties paid equally upon the mortgage on the
marital residence.
b. Household Goods, Furnishinqs, Miscellaneous Tangibl.
Personal Property.
The parties have divided the martial goods and furnishings
by prior agreement.
c. Motor Vehlel... The only marItal vehicle is the 1996
Buick purchased by Plaintiff prIor to sep<HatlCn.

1. The parties hereto are husband and wife, having
been joined in marriage on August 28, 1993.
2. The parties separated on or about April 1997.
3. The divorce was filed on July 15, 1997.
4. The Petitioner's Answer and Counterclaim was filed
on August IS, 1997.
5. Petitioner is without the ability to earn income
sufficient to meet her reasonable needs and to a.si.t her

2. In addition, Plaintiff's attorney, as escrow
agent, under an escrow account held at PNC Bank, will pay,
from that account, to Defendant, the sum of $60,000.00. That
account was established from proceeds from the sale of the
marital residence at 914 Loring Lane.
3. Upon payment to Defendant of both of those sums,
the Defendant shall immediately notify the Domestic Relations
Office and terminate and end all further claim that she may
have to temporary alimony,
4. The payment by the Plaintiff of the $75,088.07
is made in satisfaction of all claims by the Defendant of
equitable distribution and all claims of the Plaintiff of
equitable distribution.
5, The Defendant shall retain ownership in its
entirety of the three Erie Family life insurance annuities,
her Caterpillar stock, and any vehicles that she has whether
marital or non-marital.
6. Plaintiff will retain free of any claim of the
Defendant all interest in the Morgan Stanley Dean Witter
investment accounts.
7, Defendant waives any claim against any of the
proceeds from the sale of Plaintiff's condominium in Myrtle
Beach.
8. Defendant further waives any claim against value
to or the vehicle, the 1996 Buick Regal, owned by the
Plaintiff, which is a marital asset,
9. Both parties waive and release any claim they have
against the pension of the other.
10. The Defendant waives any claim or right to claim
alimony and counsel fees in this action.
