Hoffer dated June 10, 1999, the full-time Master has been appointed in the above referenced divorce proceedings, A divorce complaint was filed on July 15, 1997, raising grounds for divorce of irretrievable breakdown of the marriage and the economic claim of equitable distribution. On May 3, 1999, an affidavit under Section 3301(d) was filed by the Plaintiff averring that the parties have been separated for a period of at least two years, since April 15, 1997. The Defendant filed a counter-affidavit indicating that she wishes to claim economic relief; however, no claim. have been raised by the Defendant. The only claim pending before the Master is the claim of equitable distribution. I am going to proceed on the basi. that there i. no issue with respect to the date of separation and that the parties have, in fact, been separated for at least two yeara. A divorce complaint was filed on July 15, 1'l97, raislnq grounds for divorce of irretrievable breakdown of the marriage. Although an affidavit under Section ]]Olldl was filed on May 3, 1999, averring a separation in excess of two years, counsel have indicated that the parties will slqn and file affidavits of consent and waivers of notice of intention to request entry of divorce decree so that the divorce can be concluded under Section 3301(c) of the Damest IC Relations Code. The complaint also raised the economic claim of eqUitable distribution. On August 15, 1997, the lIelendant wife filed an answer and counterclaim raising ildditional economic issues of alimony, alimony pendente lite, and counsel fees and expenses. With respect to the alimony claim, counsel have indicated that they do not anticipate offering any testimony on the factor of marital l!1 I scondt!ct . The parties were married on August 28, 1993, and separated April 15, 1997. There were no children born of the marriage although both parties have adult children from prior marriages. She is a high school graduate and is a teacher's aide with the Bermudian Springs School District. She has worked for the district for approximately 27 years. The order entered on November 2l, 1997, showed her net monthly income at $1,632.00. She also has a part-time job as a distributor for Market America, Wife is also going to file a current income and expense statement showing income and expenses to update the prior income information. Wife is also receiving a pension benefit as a result of her prior marriage and the death of her husband. The amount of that benefit is $285.71 per month. Wife has not raised any health issues. She is going to be able to use the medical insurance benefit through her employer. The parties owned real estate at 1714 Loring Lane, Mechanicsburg, Pennsylvania, which was sold and the net proceeds were placed in an escrow account at PNC Bank. The amount in the account, shown on the pretrial statement, is $82,558.51 plus interest that has been earned since the date the account was opened. Counsel will provide updated information on the value of that account. Husband has a 1996 Buick Regal sedan which he has valued at $7,130.00. Wife continues to use the vehicle which she had prior to the parties' marriage. Counsel have indicated that the parties have divided the household tangible personal property but husband reserves the rIght to have all of the property appraised. Counsel need to determine whether they want to use any values for the property in each party's possession as part of the total value of the marital estate. Husband is a participant in the PSERS Retirement System and wife is a partlcipant in the Bermudian Springs School District pension which 15 also PSERS. He can provide Mr. Mooney with documentation showing the value at time of separation and sale price if that is necessary to confirm that there is no increase. Husband also had two investment accounts, nonmarital, with Morgan Stanley Dean Witter and according to Mr. Brenneman the increase in value of those accounts was around $130,945.00. Mr. Brenneman has requested information regarding some annunities which wife has. The purpose of the inquiry is to determine if there has been any increase in value of those annunities since they were owned by wife prior to the marriage. Mr. Mooney is going to provide information to Mr. Brenneman as Mr. Brenneman may require. There is no marital debt. Wife has raised an alimony claim and as noted, is receiving $1,008.00 per month in alimony pendente lite. The Master has suggested that one way of resolving the case would be to weigh the distribution of the marital assets in favor of wife and in return wife would forego her alimony claim. Husband has pointed out that this is a short-term marriage and he obviously does not want to have ongoing financial ties with wife following the entry of a divorce decree. The Master has suggested that the parties request a conference with the Master after they have developed the numbers which need yet to be determined. This conference can be scheduled within two weeks of request by counsel during an afternoon session to bring the parties in and see if we can resolve the outstanding issues. Counsel should be prepared at that time to bring in a worksheet showing their valuation of the assets in the marital estate. C" submits this Petition to Modify the Alimony Pendente Lite Order dated July 27, 1998 as follows: 1, Petitioner is Keith A. Rockey, an adult individual. 2. Respondent is Betty J. Rockey, an adult individual. 3, On November 21, 1997 this Court issued an Order directing Petitioner to pay $508.00 per month as alimony pendente lite effective August 18, 1997. 4. Respondent Betty J. At the aforementioned deposition, Respondent testified to receiving beginning in March, 1998 a monthly payment of $297.37 from a Caterpillar non-contributory pension plan, A true and correct copy of pages 12 and 13 of Respondent's deposition testimony taken February 3, 1999 is attached hereto and incorporated by reference herein as "Exhibit A". 9, At the time the parties entered into the Stipulation, which became part of the Order of Court dated July 27, 1998, Respondent was aware of the additional income she was receiving from the Caterpillar non-contributory pension plan as more fully set forth above. 10. The caterpillar non-contributory pension plan monthly benefit received by Respondent was not taken into consideration in determining Respondent's net monthly income for alimony pendente lite purposes. 11. For the past 27 Defendant has worked full-time as a teacher's aide for Bermudian School District. Since 1996 in addition to her full-time employment, she worked on a part-time basis as a distributor for Market America. STATEMENT PURSUANT TO Pa.R.C.P, 1920.33tbl. The following substantially corresponds to the Paragraphs of Pa.R.C,P. 1920,33(b) setting forth the content of the Pretrial Statement: 1. MARITAL ASSETS. a. Marital Re.idence. The parties before they were married purchased a home in Hay, 1993 located at 714 Loring Lane, Hechanicsburg, Upper Allen Township, Cumberland County for the I price of $158,700.00. Plaintiff contributed $7,500.00 cash for the purchase while Defendant paid $60,000.00 financed by a swing- loan on her previous residence. The residence was sold after this action was initiated at which time the parties' mortgage was paid off. The net proceeds of the sale - $82,558.51 - were deposited by mutual agreement of the parties in an interest- J L bearing escrow account pending conclusion of this case.
