1. Plaintiff, Gerald Kinter, is an adult individual living
and residing at 604 East Winding Hill Road, Mechanicsburg,
Pennsylvania.
2. Wilbur Y. Hardeman, (hereinafter "the deceased") having
first made his Will, wherein he appointed the Plaintiff as his
Executor died on or about February 6th, 1997.
3. Said will was duly admitted to probate and Letters of
Testamentary thereon duly granted to Plaintiff on the 13th day of
February 1997.
4. Defendant, Chris Failor, is an individual living and
residing at 604 S. York Road, Dil1sburg, Pennsylvania.
5. On or about January 1, 1992, The deceased loaned defendant
Five Thousand Dollars ($5,000.) with and in consideration of the
defendant's promise to repay said amount at ten (10\) per cent
interest.
6. Defendant began to repay the loan on April 20, 1992 by
performing work on the decedent's property.
7. Thereafter and until the date of decedent's death,
decedent intermittently loaned defendant money at varying interest
rates and credited defendant's account with the agreed upon value
of tasks performed by defendant on deceased property.
8. From time to time defendant also repaid portions of the
outstanding loan balance in cash payments.
9. The loan amounts, interest charges, credits, repayaents
and balances owed are reflected in a ledger maintained by the
decedent and attached hereto as Exhibit "An.
10. On the date of death. the defendant owed decedent the
amount of $9.J96.79.
11. The last interest charged posted to the ac:count wa. on
January IS. 1997 in the ..ount of $38.99.
