The Plaintiff and Defendant have legally and beneficially acquired property, both real and personal, during their marriage. 15. The Plaintiff and Defendant have been unable to agree as to equitable distribution of the said property to the date of the filing of this Complaint. WHEREFORE, the Plaintiff, Tara K. Lavelle, requests this Court to equitably divide all marital property. COUNT III ALIKO" PENDENTE LITE 16. Paragraphs 1 through 9, and 11 are incorporated herein by reference. 17. The Plaintiff is unable to sustain herself during the course of this litigation. 18. The Plaintiff is in need of alimony during the pendency of this divorce proceeding to adequately defend and prosecute her claim. WHEREFORE, the Plaintiff requests your Honorable Court to enter an award of alillony pendente lite until final hearinq as deeae4 appropriate. COUNT IV COUNSEL FEES. COSTS AND EXPENSES 19. Paragraphs 1 through 9, and 11 are incorporated herein by reference. 20. The Plaintiff has employed counsel, but is unable to pay the necessary and reasonably attorney's fees for said counsel. 21. Plaintiff is without sufficient means to pay counsel fees, expenses and costs relative to this proceeding, including the employment of any necessary experts or the obtaining of any appraisals, and Defendant is more than able to pay them. WHEREFORE, the Plaintiff, Tara K. Lavelle, requests this Honorable Court to grant counsel fees, costs and expenses of investigation, preparation, evaluation and any other matter necessary to the proper determination of this case. Hoffer dated February 13, 1998, the full-time Master has been appointed in the above referenced divorce proceedings. A divorce complaint was filed on July 21, 1997, raising grounds for divorce of indignities. The complaint did not raise grounds of irretrievable breakdown of the marriage although I assume that is intended since the caption of the first part of the complaint refers to Sections 3301(c) and 3301(d) of the Domestic Relations Code. Consequently, if it is intended that grounds for divorce of irretrievable breakdown are to be raised, they should be pleaded in an amended complaint. The complaint also raised the economic issues of equitable distribution, alimony, alimony pendente lite, and counsel fees and expenses. I am unable to tell from the pleadings whether or not the parties will sign affidavits of consent. The parties, according to Paragraph 9 of the complaint, separated Hay 2, 1997, so the parties have not been separated for a period in excess of two y.ars. If the parties are not agreeable to signing affidavits of consent, then I request that counsel advise .. immediately so I can schedule a hearing on indignities. However, based on the TARA K. Andes, and present for the Defendant, Mark T. Lavelle, is attorney Barbara J. Patton. A divorce complaint was filed on July 21, 1997, raising grounds for divorce of irretrievable breakdown of the marriage and indignities. Counsel have indicated that the parties will sign and file affidavits of consent and waivers of notice of intention to request entry of divorce decree prior to the hearing so that the divorce can be concluded under Section 3301(c) of the Domestic Relations Code. Previous to Ms. Patton's representation, Mr. Lavelle was represented by R. Eric Pierce. Mr. Pierce has not withdrawn his appearance and attorney Patton should contact Mr. Piece to file a praecipe showing that he is no longer counsel for the Defendant. The parties were married on Septe~ber 23, 1989, and separated May 2. 1997. They are the natural parents of two minor children who reside with wife. The complaint raised the economic issues of eqUitable distribution, alimony, alimony pendente lite, and counsel fees and costs. Counsel have indicated that there are issues involving the factor of marital misconduct and we have scheduled a hearing to take testimony on the factor of marital misconduct for November 7, 2000 at 9:00 a.m. Counsel are directed to provide each other a list of witnesses a month prior to the hearing date that they will be offering to testify. Pursuant to the order of August 24, 2000, husband's net monthly income is $5,783.62. Husband is an insulin dependent diabetic but apparently his health situation has not affected his ability to perform his job duties. The parties owned real esate at 1058 Hemlock Lane, East Pennsboro Township which was sold on March 30, 1999. The net proceeds were placed in an escrow account with PNC Bank. The amount in the account is in excess of $13,884.00. Husband, as an employer at Hershey Foods, is a participant in their retirement program, ESSIOP, and Hershey Stock program. The ESSIOP was valued in the pretrial statement at $74,281.22. That value should be updated using a current statereent. With respect to the retirement funds, ESSIOP funds and Hershey stock, counsel have indicated that they most likely will have to distribute those assets pursuant to a QDRO. Husband also has a stock purchase plan with his former employer, Hormel Foods, which has a value of around $3,000.00. Husband's IRA, as listed cn the pretrial statement, has a value as of March 31, 1999, of $7,576.00. The parties do not have any issues with respect to vehi c1es. There has been a distribution of household tangible personal property but husband may want to have the property appraised to use the value of property received by wife and any property received by him in the equitable distribution computation. Plaintiff expects to introduce federal income tax returns for the parties, a document showing the most recent value of the marital assets, and the like. Attached to this Pre-Trial Statement are the documents she has at the present time that she would anticipate offering as exhibits at the hearing. Plaintiff also reserves the right to offer additional exhibits as may be necessary to respond to Defendant's case. 5. INCOME STATEMENT. Plaintiff is employed by the Mulberry Child Care Center in Harrisburg, Pennsylvania, Attached hereto and marked as Exhibit C is a copy of an earnings report prepared by her employer as of 7 May 1999. 6. EXPENSE STATEMENT. Attached hereto is an expense statement prepared by the Plaintiff setting forth Plaintiff's average income and the average monthly expenses for herself and the parties' children, who reside in her custody, as of 18 May 1999. That income and expense statement is marked as Exhibit D. 7. PENSION INFORMATION, Plaintiff has no pension benefits because she was unemployed during most of the marriage and has been employed full-time recently only following separation, Defendant is employed by Hershey Foods Corporation and enjoys a pension with that company. As yet. detaIls of the pension and the benefits available to Husband from it are not fully known to Plaintiff. That Information Will be developed dunng discovery and the pension wtll be appraised, Plamtlff proposes that the pension be divided by awarding those benefits to Husband and awarding her an offset In the form of other assets, 8. COUNSEL FEES. Plaintiff has incurred substantial counsel fees in this matter to date and anticipates incurring several thousand dollars more if the matter requires a full hearing. She has agreed to pay her present attorney $175.00 per hour and a detailed statement of his services will be provided at the hearing. In addition, she owes her prior attorney, John F. King, Esquire, $3,500.00 in fees for his representation of her during this matter. 9. PERSONAL PROPERTY. Plaintiff believes the parties have essentially divided their personal property by a9reement, If Defendant does not agree, Plaintiff proposes to have all of the personal property appraised to determine its value and if the parties are not then able to agree upon a division of the assets, to have the master award to them their share of the personal property and adjust the value in the distribution of the remaining marital assets. 10. MARITAL DEBTS, The only marital debts known to Plaintiff are those listed in Exhibit A which lists the marital assets of the parties as well. 11. PROPOSED RESOLUTION OF ECONOMIC ISSUES. Plaintiff did not work for most of the marriage and, although now employed, earns approximately one. third of what Defendant earns. Moreover. Plaintiff is responsible for the primary care of the parties' two young children, which further limits her career oppc:>rtunities and her ability to acquire future assets, Defendant. on the other hand, enjoys a job which pays a substantial salary and provides generous benefits. HERSHEY FOODS ESSIOPP. The parties acknowledge that Husband, as a result of his employment with Hershey Foods Corporation. is a participant in the Hershey Foods ESSIOPP. in which there is currently a balance in excess of $70,000.00, The parties further acknowledge that a substantial portion of that value was contributed by Husband and his employer after the date of separation and is, for that reason, not marital property, The parties agree to divide and distribute that fund as follows: A, Husband shall transfer to Wife, pursuant to a Qualified Domestic Relations Order or any other requirement imposed by Hershey Foods Corporation and the administrators of the ESSIOPP, funds having a value of Thirty Thousand 1$30,000.001 Dollars as of 27 January 2000, plus or minus any investment results on that sum or those assets after that date until the date of transfer. Husband shall, within ten (101 days of the date of this agreement, make, execute, acknowledge and deliver any and all documents necessary to transfer that IRA into Wife's name or into another IRA in Wife's name. The parties agree that they shall cooperate with each other and other parties as required to make and complete the transfer of this asset to Wife's IRA as promptly as possible after the date of this agreement. 6, HaRMEL STOCK, The parties acknowledge that Husband owns one hundred eighty-nine {1891 shares of stock in Hormel Corporation and that such stock is owned in his own name and is free of any lien or encumbrance, Husband shall, within ten (10) days of the date of this agreement, make, execute, acknowledge. and deliver any and all stock certificates, endorsements, or other documents required to transfer such stock to Wife's name alone. The parties shall cooperate with each other to complete that transfer as promptly as possible after the date of this agreement and Husband hereby waives and releases any further claim to Of interest in the stock after it is transferred to Wife's sole name, ~ f {.
