14. The Plaintiff and Defendant have legally and
beneficially acquired property, both real and personal, during
their marriage.
15. The Plaintiff and Defendant have been unable to
agree as to equitable distribution of the said property to the date
of the filing of this Complaint.
WHEREFORE, the Plaintiff, Tara K. Lavelle, requests this
Court to equitably divide all marital property.
COUNT III

17. The Plaintiff is unable to sustain herself during
the course of this litigation.
18. The Plaintiff is in need of alimony during the
pendency of this divorce proceeding to adequately defend and
prosecute her claim.
WHEREFORE, the Plaintiff requests your Honorable Court to
enter an award of alillony pendente lite until final hearinq as
deeae4 appropriate.
COUNT IV
COUNSEL FEES. COSTS AND EXPENSES
19. Paragraphs 1 through 9, and 11 are incorporated
herein by reference.
20. The Plaintiff has employed counsel, but is unable to
pay the necessary and reasonably attorney's fees for said counsel.
21. Plaintiff is without sufficient means to pay counsel
fees, expenses and costs relative to this proceeding, including the
employment of any necessary experts or the obtaining of any
appraisals, and Defendant is more than able to pay them.
WHEREFORE, the Plaintiff, Tara K. Lavelle, requests this
Honorable Court to grant counsel fees, costs and expenses of
investigation, preparation, evaluation and any other matter
necessary to the proper determination of this case.

AFFIDAVIT OF CONSENT
,. A Complaint in Divorce under Section 3301 (c) of the Divorce Code was filed on
21 July 1997 and served upon the Defendant on or about 31 July 1997.
2. The marriage of Plaintiff and Defendant is irretrievably broken and ninety (90) days
have elapsed from the date of filing of the complaint and the date of service of the
complaint on the Defendant.
3, I consent to the entry of a final decree in divorce either after service of a Notice of
Intention to Request Entry of the Decree or upon filing of my Waiver of the Notice of
Intention to Request Entry of the Decree.
4. I have been advised of the availability of marriage counseling and understand that
the Court maintains a list of marriage counselors and that I may request the Court to require
my spouse and I to participate in counseling and. being so advised. do not request that the
Court require that my spouse and I participate in counseling prior to the divorce becoming
final.
I verify that the statements made in this Affidavit are true and correct and I
understand that false statements herein are made subject to the penalties of 18 Pa. C.S.
Section 4904 relating to unsworn falsification to authorities.

By order of Court of President Judge George E. Hoffer
dated February 13, 1998, the full-time Master has been appointed
in the above referenced divorce proceedings.
A divorce complaint was filed on July 21, 1997, raising
grounds for divorce of indignities. The complaint did not raise
grounds of irretrievable breakdown of the marriage although I
assume that is intended since the caption of the first part of
the complaint refers to Sections 3301(c) and 3301(d) of the
Domestic Relations Code. Consequently, if it is intended that
grounds for divorce of irretrievable breakdown are to be raised,
they should be pleaded in an amended complaint.
The complaint also raised the economic issues of
equitable distribution, alimony, alimony pendente lite, and
counsel fees and expenses.
I am unable to tell from the pleadings whether or not the
parties will sign affidavits of consent. The parties, according
to Paragraph 9 of the complaint, separated Hay 2, 1997, so the
parties have not been separated for a period in excess of two
y.ars. If the parties are not agreeable to signing affidavits
of consent, then I request that counsel advise .. immediately so
I can schedule a hearing on indignities. However, based on the

Present for the Plaintiff, Tara K. Lavelle, is
attorney Samuel L. Andes, and present for the Defendant, Mark
T. Lavelle, is attorney Barbara J. Patton.
A divorce complaint was filed on July 21, 1997,
raising grounds for divorce of irretrievable breakdown of the
marriage and indignities. Counsel have indicated that the
parties will sign and file affidavits of consent and waivers
of notice of intention to request entry of divorce decree
prior to the hearing so that the divorce can be concluded
under Section 3301(c) of the Domestic Relations Code.
Previous to Ms. Patton's representation, Mr.
Lavelle was represented by R. Eric Pierce. Mr. Pierce has not
withdrawn his appearance and attorney Patton should contact
Mr. Piece to file a praecipe showing that he is no longer
counsel for the Defendant.
The parties were married on Septe~ber 23, 1989,
and separated May 2. 1997. They are the natural parents of
two minor children who reside with wife.
The complaint raised the economic issues of
eqUitable distribution, alimony, alimony pendente lite, and
counsel fees and costs. Counsel have indicated that there
are issues involving the factor of marital misconduct and we
have scheduled a hearing to take testimony on the factor of
marital misconduct for November 7, 2000 at 9:00 a.m. Counsel
are directed to provide each other a list of witnesses a month
prior to the hearing date that they will be offering to
testify.
Wife is 36 years of age and resides at 676
Cu:nberland Point Ci rele, Meehanicsburg, Pennsylvania, where
she lives With the two children. She 15 the center director
at MUlberry rhild (are Center. She has a Dachelor of Arts
degree In pSYChology. Pursuant to an order entered August 24.
2000, the Court fO\Jnii ~~fet5 net mnnttlly in:7oroe to be
$2,326.99. She is receiving alimony pendente lite in the
amount $453.00 per month and child support in the amount of
$1,862.00 per month. She has not raised any health issues.
Husband is 36 years of age and resides at 733
Heyden Drive, Hurnmelstown, Pennsylvania, where he lives alone.
He has a Bachelor's degree and is employed by Hershey
Chocolate as a manager in the category management department.
Pursuant to the order of August 24, 2000, husband's net
monthly income is $5,783.62. Husband is an insulin dependent
diabetic but apparently his health situation has not affected
his ability to perform his job duties.
The parties owned real esate at 1058 Hemlock Lane,
East Pennsboro Township which was sold on March 30, 1999. The
net proceeds were placed in an escrow account with PNC Bank.
The amount in the account is in excess of $13,884.00.
Husband, as an employer at Hershey Foods, is a
participant in their retirement program, ESSIOP, and Hershey
Stock program. The ESSIOP was valued in the pretrial
statement at $74,281.22. That value should be updated using a
current statereent. With respect to the retirement funds,
ESSIOP funds and Hershey stock, counsel have indicated that
they most likely will have to distribute those assets pursuant
to a QDRO.
Husband also has a stock purchase plan with his
former employer, Hormel Foods, which has a value of around
$3,000.00.
Husband's IRA, as listed cn the pretrial
statement, has a value as of March 31, 1999, of $7,576.00.
The parties do not have any issues with respect to
vehi c1es.
There has been a distribution of household
tangible personal property but husband may want to have the
property appraised to use the value of property received by
wife and any property received by him in the equitable
distribution computation.

assets, particularly his employment benefits, and to respond to any witnesses Defendant
may call in his case.
4. EXHIBITS. Plaintiff expects to introduce federal income tax returns for the
parties, a document showing the most recent value of the marital assets, and the like.
Attached to this Pre-Trial Statement are the documents she has at the present time that
she would anticipate offering as exhibits at the hearing. Plaintiff also reserves the right to
offer additional exhibits as may be necessary to respond to Defendant's case.
5. INCOME STATEMENT. Plaintiff is employed by the Mulberry Child Care Center
in Harrisburg, Pennsylvania, Attached hereto and marked as Exhibit C is a copy of an
earnings report prepared by her employer as of 7 May 1999.
6. EXPENSE STATEMENT. Attached hereto is an expense statement prepared by
the Plaintiff setting forth Plaintiff's average income and the average monthly expenses for
herself and the parties' children, who reside in her custody, as of 18 May 1999. That
income and expense statement is marked as Exhibit D.
7. PENSION INFORMATION, Plaintiff has no pension benefits because she was
unemployed during most of the marriage and has been employed full-time recently only
following separation,
Defendant is employed by Hershey Foods Corporation and enjoys a pension with that
company. As yet. detaIls of the pension and the benefits available to Husband from it are
not fully known to Plaintiff. That Information Will be developed dunng discovery and the
pension wtll be appraised, Plamtlff proposes that the pension be divided by awarding those
benefits to Husband and awarding her an offset In the form of other assets,
8. COUNSEL FEES. Plaintiff has incurred substantial counsel fees in this matter to
date and anticipates incurring several thousand dollars more if the matter requires a full
hearing. She has agreed to pay her present attorney $175.00 per hour and a detailed
statement of his services will be provided at the hearing. In addition, she owes her prior
attorney, John F. King, Esquire, $3,500.00 in fees for his representation of her during this
matter.
9. PERSONAL PROPERTY. Plaintiff believes the parties have essentially divided
their personal property by a9reement, If Defendant does not agree, Plaintiff proposes to
have all of the personal property appraised to determine its value and if the parties are not
then able to agree upon a division of the assets, to have the master award to them their
share of the personal property and adjust the value in the distribution of the remaining
marital assets.
10. MARITAL DEBTS, The only marital debts known to Plaintiff are those listed in
Exhibit A which lists the marital assets of the parties as well.
11. PROPOSED RESOLUTION OF ECONOMIC ISSUES. Plaintiff did not work for
most of the marriage and, although now employed, earns approximately one. third of what
Defendant earns. Moreover. Plaintiff is responsible for the primary care of the parties' two
young children, which further limits her career oppc:>rtunities and her ability to acquire future
assets, Defendant. on the other hand, enjoys a job which pays a substantial salary and
provides generous benefits. As a result, the Defendant's prospects for the acquisition of
future assets is fat greater than that of PlaintIff,

14. The Plaintiff and Defendant have legally and
beneficially acquired property, both real and personal, during
their marriage.
15. The Plaintiff and Defendant have been unable to
agree as to equitable distribution of the said property to the date
of the filing of this Complaint.
WHEREFORE, the Plaintiff, Tara K. Lavelle, requests thls
Court to equitably divide all marital property.

ALIMONY PENDENTE LITB

17. The Plaintiff is unable to sustain herself during
the course of this litigation.
18. The Plaintiff is in need of alimony during the
pendency of this divorce proceeding to adequately defend and
prosecute her claim.

enter an award of aUmony pendente lite until final hearinq as
d.e.ed appropriate.

appraisals, and Defendant is more than able to pay them.
WHEREFORE, the Plaintiff, Tara K. Lavelle, requests this

investigation, preparation, evaluation and any other matter
necessary to the proper determination of this case.

XVII, Enforcement
It is expressly stipulated that if either party fails in the due perfonnancc of his or her
material obligations under this Agreement. the other party shall have the right. at his or her
election, to sue for damages for breach thereof, to sue for specific perfonnance, to rescind this
Agreement, or to seek any other legal remedies as may be available, and the defaulting party shall
reimburse the non-defaulting party for any legal fees and expenses for any services incurred in
any action or proceeding to compel perfonnance hereunder,
XVIII. Severability
If any tenn, condition. clause. or provision of this Agreement shall be determined to be
void or invalid at law. or for any other reason. then only the tenn. condition, clause, or provision
shall be stricken from this Agreement as is held to be void or invalid, and in all other respects

PROPERTY SETTLEMENT AGREEMENT
THIS AGREEMENT, made this IS~ day of J),!t.~~, 2000, is by and
between:
MARK T. LAVELLE, of 733 Hayden Drive, Hummelstown, Pennsylvania party of the
first part, hereinafter referred to as "Husband"; and
TARA K. LAVELLE, of 676 Cumberland Point Circle. Mechanicsburg, Pennsylvania,
party of the second part, hereinafter referred to as "Wife,"
WITNESSETH:
WHEREAS, the parties hereto are husband and wife, having been married on 23
September 1989 and are the parents of two minor children. Gregory S. Lavelle, born 17
October 1991, and Maren B, Lavelle, born 6 April 1994 (hereinafter .children"); and
WHEREAS, certain difficulties have arisen between the parties hereto which have
made them desirous of living separate and apart from one another and Wife has initiated an
action in divorce filed to No. 98.849 Civil Term before the Court of Common Pleas of
Cumberland County, Pennsylvania,
WHEREAS, the parties hereto have mutually entered into an agreement for the
division of their assets, the provision for their children and for their rights and
responsibilities in and toward such children, the provision for the liabilities they owe, and
provision for the resolution of their mutual differences, after both parties have had full and
ample opportunity to consult with their respective attorneys, and the parties now wish to
have that agreement reduced to writing.
NOW. THEREFORE. the parties hereto. in consideration 01 the above recitals. the
mutually made and to be kept promises set forth hereinafter, and for other good and

valuable considerations, and intending to be legally bound and to legally bind their heirs,
successors, assigns. and personal representatives. do hereby covenant. promise, and agree
as follows:
" CUSTODY. Husband and Wife acknowledge that they are parties to a child
custody action filed to No, 98.849 Civil Term before the Court of Common Pleas of
Cumberland County, Pennsylvania, and that an order was entered in that action on 27 April
1998 awarding the parties shared legal custody. Wife primary physical custody. and
Husband periods of temporary custody. The parties agree to resolve their future custody
matters, to the extent they cannot reach private agreement to resolve any disputes.
through that action, The parties agree to cooperate with and be bound by any orders
entered in that action in the future regarding the custody of their children.
2, CHILD SUPPORT. Husband and Wife are parties to an action for child support
before the Court of Common Pleas of Cumberland County, Pennsylvania, which is filed to
Docket No, 114.5.1998 IPAC5E5 #987100037) in which the most recent order was
entered on 24 August 2000 for the support of the parties' two children. The parties agree
that the matter of the financial support of their children shall be determined by that support
action. as it may be amended, modified. or otherwise altered in the future. and both parties
agree to cooperate with and be bound by the court in the entry and enforcement of orders
in that action,
3, PROCEEDS FROM SALE OF RESIDENCE, The parties acknowledge that they
formerly owned a residence at 1058 Hemlock Lane in East Pennsboro Township,
Cumberland County, Pennsylvania. and that such property was sold in March of 1999,
The parties further represent that the net proceeds of the sale of that property, which were

originally in the amount of $18,342.50, but were reduced when $4.458.36 of those
proceeds were inadvertently released from escrow to the Cumberland County Domestic
Relations Office, are currently being held in escrow by their attorneys and that the balance
in that escrow account now exceeds $14.000.00, Husband hereby assigns and transfers
to Wife all of his right, title, and interest in those escrow funds and directs his attorney to
make, execute, acknowledge and deliver any and all documents necessary to immediately
release and pay over to Wife's attorney those funds.
4. HERSHEY FOODS ESSIOPP. The parties acknowledge that Husband, as a result
of his employment with Hershey Foods Corporation. is a participant in the Hershey Foods
ESSIOPP. in which there is currently a balance in excess of $70,000.00, The parties
further acknowledge that a substantial portion of that value was contributed by Husband
and his employer after the date of separation and is, for that reason, not marital property,
The parties agree to divide and distribute that fund as follows:
A, Husband shall transfer to Wife, pursuant to a Qualified Domestic
Relations Order or any other requirement imposed by Hershey Foods
Corporation and the administrators of the ESSIOPP, funds having a value of
Thirty Thousand 1$30,000.001 Dollars as of 27 January 2000, plus or minus
any investment results on that sum or those assets after that date until the
date of transfer.
B, Husband shall cause a Qualified Domestic Relations Order to be
prepared. shall have it approved by the administrators of the ESSIOPP. and
present it to the court for entry at the time a final decree in divorce is entered.

Husband and Wife will cooperate to prepare, obtain, and implement that
Qualified Domestic Relations Order.
C. After the rollover transfer made pursuant to the Qualified Domestic
Relations Order, Husband shall be the sole owner of the balance of the funds
and assets in the ESSIOPP and Wife hereby waives and releases any further
claim to or interest in that asset,
5, AMERICAN CENTURY FUNDS IRA. The parties acknowledge that Husband
holds an individual retirement account with American Century Funds which has a balance
as of May, 2000, of approximately $8,400.00. Husband shall, within ten (101 days of the
date of this agreement, make, execute, acknowledge and deliver any and all documents
necessary to transfer that IRA into Wife's name or into another IRA in Wife's name. The
parties agree that they shall cooperate with each other and other parties as required to
make and complete the transfer of this asset to Wife's IRA as promptly as possible after
the date of this agreement.
6, HaRMEL STOCK, The parties acknowledge that Husband owns one hundred
eighty-nine {1891 shares of stock in Hormel Corporation and that such stock is owned in
his own name and is free of any lien or encumbrance, Husband shall, within ten (10) days
of the date of this agreement, make, execute, acknowledge. and deliver any and all stock
certificates, endorsements, or other documents required to transfer such stock to Wife's
name alone. The parties shall cooperate with each other to complete that transfer as
promptly as possible after the date of this agreement and Husband hereby waives and
releases any further claim to Of interest in the stock after it is transferred to Wife's sole
name,

7, ALIMONY. Husband shall pay Wife alimony, as follows:
A. The amount of alimony shall be $453,00 per month and shall not be
subject to modification by any court at any time.
B, The term of the alimony shall commence on the first day of the first
month following the entry of a final decree in divorce between the parties. to
the action now pending between them, and shall continue for five years or
until the death of Husband, the death of Wife. Wife's remarriage, or Wife's
cohabitation, whichever first occurs. Otherwise, the term of the alimony shall
not be subject to modification or termination.
C. The alimony payments will be made through. and administered and
enforced by, the Domestic Relations Office of Cumberland County. The
parties will cooperate to obtain an order providing for the payment of alimony
in accordance with this paragraph,
D. The payments made pursuant to this paragraph shall be treated by
both parties as alimony. Wife shall include such payments with her income
for tax purposes and Husband shall be entitled to deduct payments for tax
purposes.
8. PERSONAL PROPERTY, The parties hereto mutually agree that they have
effected a satisfactory division of the furniture, household furnishings. appliances. and
other household and personal property between them and they mutually agree that each
party shall. from and after the date hereof. be the sole and separate owner of all such
tangible personal property presently in his or her possession, whether said property was
heretofore owned jointly or individually by the parties hereto. and this agreement shall have

the effect of an assignment or receipt from each party to the other for such property as
may be in the individual possessions of each of the parties hereto, the effective date of
said bill of sale to be contemporaneous with the date of the execution of this Agreement.
9. WAIVER OF FURTHER ALIMONY. SUPPORT AND ALIMONY PENDENTE LITE,
Husband currently pays alimony pendente lite to Wife pursuant to an order entered in the
divorce action. Husband shall remain responsible to pay alimony pendente lite pursuant to
that order until the entry of a final decree in divorce. The parties acknowledge that they
are aware of the income, education, income potential, and assets and holdings of the other
or have had full and ample opportunity to become familiar with such items. Both parties
acknowledge that they are able to support and maintain themselves comfortably, without
contribution from the other beyond that as provided for in this Property Settlement
Agreement, upon the income and assets owned by each of them, The parties hereby
accept the mutual covenants and terms of this Agreement and the benefits and properties
passed to them hereunder in lieu of any and all further rights to support or alimony for
themself, counsel fees. and alimony pendente lite at this time and during any and all further
or future actions of divorce brought by either of the parties hereto and the parties do
hereby remise, release, quit claim, and relinquish forever any and all right to support,
alimony, alimony pendente lite. counsel fees and expenses beyond those provided for
herein. during the pendency of or as a result of any such actions, as provided by the
Divorce Code of Pennsylvania or any other applicable statute. at this time and at any time
in the future,
10, WAIVER OF EQUITABLE DISTRIBUTION. The parties acknowledge that each
of them have had a full and ample opportunity to consult with counsel of their choice

regarding their claims arising out of the marriage and divorce and that they have
specifically reviewed their rights to the equitable distribution of marital property. including
rights of discovery, the right to compel a filing of an Inventory and Appraisement. and the
right to have the court review the assets and claims of the parties and decide them as part
of the divorce action, Being aware of those rights. and being aware of the marital property
owned by each of the parties, the parties hereto. in consideration of the other terms and
provisions of this agreement. do hereby waive. release and quitclaim any further right to
have a court or any other tribunal equitably distribute or divide their marital property and do
hereby further waive. release and quitclaim any and all claim against or interest in assets
now currently in the possession or held in the name of the other. it being their intention to
accept the terms and provisions of this agreement in full satisfaction of all of their claims
to the marital property of the parties and the equitable distribution of the same.
11, WAIVER OF PROPERTY CLAIMS AND ESTATE CLAIMS. Except as herein
otherwise provided. each party hereto may dispose of his or her property in any way, and
each party hereby expressly waives and relinquishes any and all rights he or she may now
have or hereafter acquire. under the present or future laws of any jurisdiction, to share in
the property or the estate of the other as a result of the marital relationship. including.
without limitation. the right to equitable division of marital property, alimony. alimony
pendente lite. and counsel fees. except as provided for otherwise in this Agreement.
dower. courtesy. statutory allowance. widow's allowance. right to take in intestacy, right
to take against the will of the other. and right to act as administrator or executor of the
other's estate. and each will, at the request of the other, execute. acknowledge. and

deliver any and all instruments which may be necessary or advisable to carry into effect
this mutual waiver and relinquishment of all such interests. rights, and claims,
12. WAIVER OF ESTATE RIGHTS. Husband releases his inchoate intestate rights
in the estate of Wife and Wife releases her inchoate intestate rights in the estate of
Husband, and each of the parties hereto by these presents for himself or herself. his or her
heirs, executors, administrators. or assigns, does remise, release, quit claim, and forever
discharge the other party hereto, his or her heirs, executors, administrators, or assigns. or
any of them. of any and all claims, demands, damages. actions. causes of action or suits
of law or in equity, of whatsoever kind or nature, for or because of any matter or thing
done. omitted. or suffered to be done by such other party prior to the date hereof; except
that this release shall in no way exonerate or discharge either party hereto from the
obligations and promises made and imposed by reason of this agreement and shall in no
way affect any cause of action in absolute divorce which either party may have against the
other.
13. REPRESENTATION AS TO NO DEBTS. The parties hereto mutually represent
to the other than neither of them has incurred any debts in the name of the other not
previously disclosed or provided for in this agreement. Each of the parties hereby
represents to the other that neither one of them have incurred or contracted for debts in
the name of the other or for which the other is or would be legally liable from and after the
date of the parties' separation. Both parties hereto mutually agree and promise that neither
will contract or otherwise incur debts in the other's or joint names without the prior
permission and consent of the other party hereto. Both parties hereto represent and

warrant to the other party that they have not so contracted any debts unbeknownst to the
other up to the time and date of this Agreement.
14. DISCLOSURE. Both of the parties hereto represent to the other that they have
made full disclosure of the assets and income and income sources owned, controlled, or
enjoyed by either of them and that neither party hereto has withheld any financial
information from the other. Each of the parties represents that they have reviewed this
information with an attorney of their choice. or had the opportunity to review this
information with an attorney of their choice and voluntarily decided not to do so. Further.
the parties each acknowledge that they are aware that they have the right to compel the
other party to provide full financial information about all assets owned by either party and
all liabilities owed by either party and have the right to have a court force such disclosure
in a divorce action. Being aware of those rights. the parties expressly waive the right to
further disclosure or discovery regarding marital assets, liabilities. incomes, and finances.
15. BREACH, In the event that any of the provisions of this agreement are
breached or violated by either of the parties, the other party shall be entitled to enforce this
agreement by an appropriate action in law or in equity or to take any other action to which
they are lawfully entitled to enforce this agreement or otherwise protect their rights, In the
event that such action is commenced by one of the parties and the other party is found to
have breached or violated any of the terms and provisions of this agreement, the party
having so violated or breached the agreement. shall be responsible for and shall promptly
pay upon demand the reasonable attorney's fees incurred by the other party to enforce
their rights hereunder,

16. CONCLUSION OF DIVORCE. The parties acknowledge that this agreement is
made in contemplation of the conclusion by both of them of an action in divorce which has
been filed or will be filed shortly by one of the parties hereto. Both of the parties hereto
agree that they shall, contemporaneously with the execution of this agreement, execute
and deliver to their respective attorney or attorneys, an Affidavit of Consent under Section
3301 (c) of the Divorce Code, consenting to the entry of a final decree in divorce, and a
Waiver of further notice for the entry of such decree. Both parties agree that they shall
accept the terms and provisions of this agreement in full satisfaction of any claims they
may have under the Divorce Code of the Commonwealth of Pennsylvania, including, but
not limited to, alimony, alimony pendente lite, counsel fees, equitable distribution, and the
like.
17. RELEASE. The parties acknowledge that the purpose of this agreement is to
divide all of their marital property, resolve all of the economic claims between them, and
terminate and conclude any and all claims one party may have against the other, The
parties acknowledge that each of them has had ample opportunity to consult with an
attorney of their choice and to obtain legal representation with regard to this agreement
and to the claims which they are terminating hereby, Consequently. each of the parties.
for themselves, their heirs, successors, and assigns, does hereby accept the terms and
provisions of this agreement in full satisfaction of any claims, of any nature. they may
have, or may ever have had, against the other party and each of the parties does hereby
