3. The underlying litigation results from an automobile
accident on November 24, 1995, in which Plaintiff was injured.
4. At the time of the loss Plaintiff was bound by the
limited tort option.
5. Plaintiff filed her Complaint in this case on July 22,
1997.
6. Discovery revealed that there was a question as to
whether the Plaintiff's injuries and damages exceeded the
limited tort threshold.
7. Based on this issue in the case, counsel for
Respondent Wilson, with full authority from his client, and
Respondent Beatty negotiated a settlement in the amount of
$12,788.25; There is no dispute that the case has settled.
8. This settlement is for Plaintiff's full economic
damages resulting from the accident.
9. Therefore, the parties intended to resolve the case
with settlement; they negotiated settlement; and counsel, on
behalf of their respective clients, agreed to a settlement in
the amount of $12,788.25 in exchange for a General Release and
discontinuance of the matter of record delivered by Plaintiff's
counsel.
10. However, Plaintiff's counsel, despite numerous
attempts, cannot locate his client to execute a Release.

5, 1998 attached hereto as Exhibit B.
8-9. Admitted.
10. It is admitted that in spite of numerous attempts,
Plaintiff's counsel has been unable to locate his client.
Plaintiff's counsel's letter of November 5, 1998, enclosing the
Release and sent to Plaintiff's Florida address, was returned
indicating that the box was closed and no forwarding order existed.
See Plaintiff's counsel's letter of November 5, 1998 and a copy of
the returned envelope attached hereto as Exhibit C. After
receiving the return envelope. Plaintiff's counsel immediately
notified defense counsel in a letter dated November 17, 1998.
Subsequent to that time, Plaintiff did receive a report around
Thanksgiving 1998 from the Fulton County Police Department advising
that Tanya Wilson was located hear Atlanta, Georgia. However, she
was not detained because she was not listed as a reported missing
person. See copy of the Fulton County, Georgia Police Department
report attached hereto as Exhibit D. Since that time, Plaintiff's
counsel has been in touch with family members, including the
Plaintiff's sister, Valerie Payne, and the Plaintiff's mother.
However. they have not been able to provide any additional
information concerning the Plaintiff's whereabouts.

11. Plaintiff's counsel can confirm that in a telephone
conversation with the Respondent Tanya Wilson in early October,
1998 that the Plaintiff indicated that she was willing to settle
for the full payment of economic losses less the cancellation fees
for the IMEs which Plaintiff did not attend. At that time,
Plaintiff's counsel was not aware of any difficulties which would
have prevented the Plaintiff from fully understanding the terms of
the settlement. The settlement was for the full economic losses
and that no payment was to be included for pain and suffering. At
that time, Plaintiff was aware that the case was on the trial list
for November, 1998 and that if she wished to dispute her claim for
pain and suffering and other non-economic damages that she would be
required to attend an independent medical examination and trial in
November of 1998. It was Plaintiff's counsel's impression that the
Plaintiff made a decision to settle after being fully informed of
these issues and the decision was of her own free will. Since that
time, Plaintiff Tanya Wilson's family has notified Plaintiff's
counsel that beginning before she quit her job with the
Commonwealth of Pennsylvania and moved from the Harrisburg area,
they felt that Plaintiff Tanya Wilson's mental state was steadily
deteriorating. In light of this, Plaintiff's counsel is providing
notice of this Petition to Plaintiff Tanya Wilson's mother and her

COMPLAINT
1. Plaintiff Tanya L. Wilson is a citizen of the
Commonwealth of Pennsylvania, adult individual, who resides at 131
Balm Street, HarriSburg, Dauphin County, Pennsylvania.
2. Defendant Elizabeth Beatty is an adult individual and
citizen of the Commonwealth of Pennsylvania, who resides at 766
Meadow Drive, Camp Hill, CUmberland County, Pennsylvania.
3. Defendant, Daniel E. Gilbert, is an adult individual and
citizen of the Commonwealth of Pennsylvania who resides at 776
Meadow Drive, Camp Hill, CUmberland County, Pennsylvania.
4. The facts and occurrences hereinafter related took place
on or about November 24, 1995, at approximately 8:17 p.m., near the
intersection of State Route 11 and 15 and Willow Avenue in Camp
Hill, CUmberland County, Pennsylvania.
5. In the area of the accident, State Route 11 and 15 is a
four-lane roadway,which generally travels north and south, with two
southbound lanes and two northbound lanes, separated by a curbed
concrete median with a posted speed limit of 35 miles per hour.
6. At that time and place, Plaintiff Tanya L. Wilson was

operating her motor vehicle, a 1988 Nissan sentra, in a southerly
direction in the lane closest to the median (left lane) on state
Route 11 and 15.
7. At that time and place, Defendant Elizabeth Beatty was
operating a 1987 Pontiac Sunbird, owned by Defendant Daniel E.
Gilbert.
8. At that time and place, Defendant Elizabeth Beatty was
heading in a northerly direction on State Route 11 and 15 in the
lane closest to the median (left lane) at a high rate of speed.
9. At that time and place, Defendant Elizabeth Beatty lost
control of her automobile due to her high rate of speed and
inexperience and jumped the concrete median and entered the
southbound lane in which Plaintiff Tanya L. Wilson was traveling,
striking Plaintiff's vehicle head-on.
10. At that time and place, Plaintiff Tanya L. Wilson
attempted to avoid the violent head-on collision with Defendant
Elizabeth Beatty, but was unable to do so, since the Defendant

entered her lane by jumping the concrete median without any
warning.
11. Plaintiff Tanya L. Wilson sustained painful and severe
injuries, which include, but are not limited to, fracture of the
right fifth metacarpal which resulted in Reflex sympathetic
Dystrophy, chest contusions, back sprain, and an injury to
Plaintiff's right kne..
12. As a result of suffering Reflex Sympathetic Dystrophy,
Plaintiff Tanya L. Wilson has limited use of her right hand and
underwent painful treatment.
13. Plaintiff Tanya L. Wilson sustained serious impairment of
bodily function due to aforesaid injuries.
14. By reason of the aforesaid injuries sustained by
Plaintiff Tanya L. Wilson, she was forced to incur liability for
medical treatment, medications, hospitalizations and similar
miscellaneous expenses in an effort to restore herself to health,
and claim is made therefor.
15. Because of the nature of her injuries, Plaintiff Tanya L.
Wilson has been advised and, therefore, avers that she may be
forced to incur similar expenses in the future, and claim is made
therefor.
16. As a result of the aforementioned injuries, Plaintiff
Tanya L. Wilson has undergone and in the future will undergo great
physical and mental suffering, great inconvenience in carrying out
her daily activities, loss of life's pleasures and enjoyment, and
claim is made therefor.
17. As a result of the aforesaid injuries, Plaintiff Tanya L.
Wilson has been and in the future will be subject to great
humiliation and embarrassment, and claim is made therefor.
, 18. Plaintiff Tanya L. Wilson continues to be plagued by

! persistent pain and limitation and, therefore, avers that his/her

damages sustained by Plaintiff Tanya L. Wilson as set forth
hereinafter are the direct and proximate result of the negligence
of the Defendant Daniel E. Gilbert for entrusting the 1987 Pontiac
Sunbird to Defendant Elizabeth Beatty as follows:
(a) Permitting Defendant Elizabeth Beatty to
operate the car, although he knew or should
have known that Defendant Beatty did not have
the proper training, experience, and judgment
to adequately control and operate the vehicle;
(b) Permitting Defendant Elizabeth Beatty to drive
the car although he knew or should have known
that Defendant Beatty was careless or reckless
in the operation of the vehicle;
(c) Permitting Defendant Elizabeth Beatty to drive
the car although he knew or should have known
that Defendant Beatty was not physically or
emotionally responsible to the degree
necessary to operate and control the vehicle
upon the highway.
WHEREFORE, Plaintiff Tanya L. Wilson demands judgment
against Defendant Daniel E. Gilbert in an amount in excess of
Twenty-Five Thousand ($25,000.00) Dollars exclusive of interest and
costs and in excess of any jurisdictional amount requiring
compulsory arbitration.

4. After receiving the settlement check, Plaintiff's counsel
contacted Plaintiff Tanya Wilson's mother and sister and was
advised that Tanya Wilson has not had any further contact with them
and still has not been located.
5. Angino & Rovner is unable to deposit the settlement check
in their escrow account or to distribute the proceeds of the
settlement, including payment of attorney's fees and expenses and
the lien to Paul J. Gitnik for the Pennsylvania Employee Benefit
Trust Fund since the check cannot be endorsed by Plaintiff Tanya
Wilson.
6. As indicated on the face of the settlement check, the
check is only valid for 60 days from the date of issue which was
August 5, 1999.
7. In light of Angino & Rovner's efforts to locate Tanya
Wilson and the fact that she has been unable to be located in over
a year, it is not anticipated that she will not be able to be
located prior to October 5, 1999 or even in the foreseeable future.
8. The insurance company for Defendant Elizabeth Beatty,
Brie Insurance, would be required to re-issue the settlement draft
which could not be negotiated every 60 days or to hold open the
file until such time as Tanya Wilson is found.

10. Since the money cannot be deposited into an account,
Plaintiff Tanya Wilson will lose any interest which would accrue on
her portion of the settlement proceeds, as will the lienholder,
Paul J. Gitnik for the Pennsylvania Employee Benefit Trust Fund.
11. Angino & Rovner would request the Court to issue an Order
requiring Erie Insurance Company to issue a check payable to Angino
& Rovner, P.C. on behalf of Plaintiff Tanya Wilson.
10. Angino & Rovner, P.C. would also request permission to
deposit the funds in an interest-bearing escrow account and be
permitted to make distributions, including attorney's fees and
expenses and payment of the outstanding Pennsylvania Employees
Benefit Trust Fund lien. A copy of the distribution sheet prepared
by Angino & Rovner, P.C. and which would normally be utilized in a
typical settlement is attached as Exhibit C. Letter of Paul J.
Gitnik & Associates verifying the amount of the lien, attached
hereto as Exhibit D.
11. Angino & Rovner, P.C., through Plaintiff's counsel,
Michael E. Kosik have contacted defense counsel, Steve Geduldig who
indicated he has no objection to this procedure.
WHEREFORE, Angino & Rovner, P.C. would request the Court to
issue an Order permitting Erie Insurance Company to issue a check
to Angino & Rovner on behalf of Tanya Wilson and to permit
