Barger, of Monroe Township, Cumberland Count.~', Pennsylvania, being of sound and disposing mind and memory, do make, publish and declare this to be my Last Will and Testament, hereby reVOking all Wills and Codicils by me at any time made, ~TEM I: I direct that all inheritance and estate taxes beooming due by reason of my death, whether such taxes may be payable by my Estate or by any recipient of any property, shall be paid by my Executor out of the property passing under this Will, which is not specifically devised or bequeathed as an expense and cost of administration of my Estate. My Executor shall have no duty or obligation to obtain reimbursement for any suoh tax paid by my Executor even though on proceeds of insuranoe or other property not passing under this Will. ITEM II: I hereby make the following specific gifts and bequests: (a) To the Trindle Springs Lutheran Church, the sum of Two Thousand Dollars ($2,000.00). (b) To my daughter Mary Jane Rider, if she survives me, all of the promissory notes in my possession at the time of my death which have been signed and issued by my son James E, Barger as Obligor. In the event my daughter does not survive me, I forgive the indebtedness represented by such promissory notes in my possession at the time of my uoath and direct that such notes be returned to my son James E. Barger. ~: I order and direct all of the rest, residue and remainder of my Estate, re~l personal and mixed, to be converted into money as soon as it can conveniently be done after my decease by my Executor. I give, devise and bequeath the ,prooeeds of said conversion to the following residuary benefioiaries in the fOllowing shares: Page 1 of 5 Pages . . (a) Thirty-seven and one-half percent (37.5') to my daughter, Mary Jane Rider, if she survives me. If she does not survive me, I give, devise and bequeath one-half of the amount passing under this sub-paragraph (a) to Mary's surviving husband, Robert Rider and one- half of to my aon, James E. Barger, (bl Thirty-sevon and one-half percent (37.5%) to my son, James E. Barger, if he survives me, or, if he does not sur.vive me, to my son's wife, Beulah A. Barger. (c) TwentY-five percent (25%) in equal shares of five percent (5%) each to the five following named grandchildren, Bradford Barger, Karen Barger Bissel, Barbara Barger starner, Brian Barger and Keith Barger; to each per stirpes and not per capita. It any of the said five grandchildren named above shall predecease me without issuo, his or her share shall be divided into as many equal shares as there are surviving grandchildren named above and deceased grandchildren named above survived by the living issue and distributed accordingly. I make no bequest to my grandson Frank Weiser, Jr., not out of any ill feeling, but because in my jUdgment he has already received a fair benefit from me during my lifetime. ~TEM IV: In the settlement of my Estate, my Executor shall possess, among others, the following powers to be executed for the best interest of the beneficiaries: (a) To sell, either at public or private sale and upon such terms and conditions as my Executor may deem advantageous to my Estate, any or all real or personal estate or interest therein, whether owned by me severalJ.y or in conjunction with other persons or acquired after my death by my Executor, and to consummate said sale or sales by sufficient deeds or other instruments to the purchaser or purchasers, Page 2 of 5 Pages , I , , .. oonveying a fee simple title, free and olear of all trust and without obligation or liability of the ~urohaser or purohasers to see to the applioation of the purohase money or to make inquiry into the validity of said ~ale or sales; also, to make, execute, acknowledge and deliver any and all deeds, assignments, options or other writings which may be necessary or desirable in carrying out any of the powers oonferred , upon my Exeoutor in this Paragraph IV(a) or elsewhere in my will. (b) To pay all costs, taxes, expenses and charges in oonneotion with the administration of my Estate. My Exeoutor shall pay ~xpenses of my last illness and funeral expenses. (c) To distribute my Estate in kind or in money, If any assets are distributed in kind, they shall be distributed at their respeotive value(s) on the date(s) of their distribution. (d) To retain any investments I may have at my death so long as my Executor may deem it advisable to my Estate so to do. (e) To vary investments, when deemed desirable by my Executor and to invest in such bonds, stocks, notes, money markets, real estate mortgages or other securities or in such other property, real or personal, as my Executor shall deem wise, without being restricted to so-called "legal investments." (f) To mortgage real estate and to make leases of real estate, (g) To borrow money from any party to pay indebtedness of mine or of my Estate, expenses of administration or inheritanoe, legacy, estate and other 'taxes. 'Page 3 of 5 Pages " .' I . I, " (h) 'To vote any shares of stock which form a part of the Estate and to otherwise exercise all the powers incident to the ownership of such stock. (i) In the discretion of my Exeoutor, to unite with other owners of similar prope~ty in carrying out any plans for the reorganization of any corporation or oompany whose securities forl1l a part of the Estate. (j) To distribute my personal property directly to the Guardian of the person of any miner benefioiaries hereunder. (k) To elect such settlement options as deemed most appropriate by my Executor with respect to any pension, prOfit-sharing or other retirement plan in whioh I am a participant. (1) To do all other acts, in the judgment of my Exeoutor, necessary or desirable for the proper and advantageous management, investment and distribution of my Estate, ITEM V: Any person who shall have died at the same time as Testator or in a common disaster with him, or under suoh ciroumstanoes that it is difficult or impossible to determine who died first, or who fails to survive him by ninety (90) days, shall be deemed to have predeceased him, ITEM VI: If at any time, any minor child or disabled person shall be entitled to receive any assets hereunder, my son, .James E. Barger, of Cumberland County, Pennsylvania, shall aot as Guardian of the assets payable to such person. Said Guardian may reoeive and administer all assets authorized by law and shall have full authority to use such assets, both principal and income, in any manner said Guardian shall deem advisable for the best interest of such person, including college, university, post-graduate or other education, without securing oourt order. Said Guardian shall have all the rights and privileges as to the 'guardianship and the assets thereof as are herein granted to my Exeoutor as to my Estate and the assets therein.
