I, MILDRED P. SAUVE, ot the Borough ot Shiremanstown,
CU~8rl~nd County, Pennsylvania, make, pUblish and declare this a.
&nd tor my Last Will and Testament, hereby reVOking all other
Wills and Codicils heretofore made by me.
FIRST: I devise and bequeath all the rest, residue and
remainder of my estate of what~ver nature and wherevar situate,
including any property over which I hold power of appointment and
together with any insurance polioies thereon, in equal shares, to
my children, JAMES W. SAUVE, JR., STEPHEN C. SAUVE, and DAVID L.
SAUVE, provided that should any of my children predecease me, I
give and bequeath such child's share unto his issue per stirpes by
representation, and if there be a failure of same, then I give and
bequeath such deoeas~d ohild'~ share to my surviving ohildren as
provided herein.
SECOND: In addition to all powers granted to them by
law and by other provisions of this Will, I give the fiduciaries
aoting hereunder the following powers, applioable to all property,
exeroisable without oourt approval and effective until aotual
distribution of all property:
(A) To sell at publio or private sale, or to lease, for
any period of time, any real or personal property and to give
options for sales, exchanges or leases,' for such prioes and upon
suoh terms (inClUding credit, with or without seourity) or condi-
tions as are deemed proper. This includes the power to give
legally sufficient instruments for transfer of the property and to
receive the proceeds of any disposition of it.
(8) To partition, subdivide, or improve real estate and
to e~ter into agreements conoerning the partition, subdivision,
improvement, zoning or management of real estate and to impose or
extinguish restriotions on real estate.

To oompromise any olaim or oontroversy and to
abandon any property whioh i. ot little or no value.
(D) To invest in all torms of property, inoluding
stooks, oommon trust funda and mortgage investment funds, without
re.triotion to investments authorized for Pennsylvania fiduoi-
aries, as are deemed proper, without regard to any prinoiple of
diversifioation, risk or produotivity.
(E) To exeroise any option, right or privilege granted
in insurance pOlioies or in other investments.
(F) To exercise any election or privilege given by the
Federal and other tax laws, inoluding, but not necessarily being
limited to, personal income, gift and estate or inherltance tax
laws.
(G) To make distributions to my herein named benefioi-
aries in oash or in kind or partly in each.
(H) To borrow money from themselves or others in order
to pay debts, taxes, or estate or trust administration expenses,
to proteot or ilnprove any property held under my will, and for
investment purposes.
(I) To seleot a mode of payment under any qualified
retirement plan (pension plan, profit sharing plan, employee stook
ownership plan, or any other type of qualified plan) to the extent
the plan or the law permits them to do so, and to exeroise any
other rights which they may have under the plan, in whatever
manner they oonsider advisable.
THIRD: I direot that all inheritance, estate, transfer,
suooession and death taxes, of any kind whatsoever, whioh may be
payable by reason of my death, whether or not with respeot to
property passing under this Will, shall be paid out of the princi-
pal of my residuary estate.
FOURTH: I nominate and appoint my son, STEPHEN C.
SAUVE, Executor of this, my Last Will and Testament. In the eVe~t
of the death, resignation or inability to serve for any reason

filed to No. 94-6871 civil Term on behalf of
MBNA America Bank, N.A. for unpaid charge card
account, was filed on 12/5/94 against James W.
Sauve Jr. and Judith A. Sauve, a copy of whioh
is attached hereto and incorporated herein,
with a Praecipe for Default Judgment being
filed on or about 1/30/95.
For the reasons set forth above it is suggested
that the Judgmen~ Note has no value as it is
presently not a oollectible item. An Affidavit
exeouted by Stephen C. Sauve, Executor,
affirming this position is also attached
hereto.
It is respectfully requested that this item be
suspended from taxability at the present time
until a final determination is made as to the
oollectibility of the Judgment Note. The PA
Department of Revenue will be notified in
writing upon final det~rmination as to whether
or not the Judgment Note is collectible.

Dr., Camp Hill, Pennsylvania 170~1, and il hereinafter referred to as
"Defendant.1I
3. Defendant received a charge card account and agreed to be bound
by the terms and conditions therof.
4. Defendant received a statement of Account (hereinafter
"statement") which set forth all debts and oredits on the account for
each month.
5. Attached hereto and made part hereof and marked Exhibit IIAII is
a copy of statement which evidences the debt of Defendant.
6. Defendant defaulted for failing to make payment when and as
due, and Plaintiff incurred I!. loss, " .'

No distribution of assets of the Estate of Mildred P. Sauve,
outside of the one-third share of personal property and
furniture, will be made to James W. Sauve, Jr. in accordance with
the evi.dence of indebtedness set forth in a Memorandum attached
to the Last will and Testament of Mildred P. Sauve and 34
Standard pa Practice 2d U59. 94. No distribution will be made
due to the existence of an unrecorded Judgment Note dated June B,
1990 for $42,000.00 executed by James W. Sauve, Jr. and Judith A.
Sauve, husband and wife, a copy of same being attached hereto as
an exhibit. James W. Sauve, Jr. and Judith A. Sauve do not have
the financial ability to repay said judgment either partially or
in full.
Stephen C. Sauve, Executor under the Last Will and Testament of
Mildred P. Sauve, deceased, hereby declares under oath that he has fully
and faithfully discharged the duties of his officel that the foregoing
First and Final Account is true and correct and fully discloses all the
significant transactions occurring during the accounting periodl that all
known claims against the estate have been paid in full; that, to his
knowledge, there are no claims now outstanding against the estate I and that
all taxes presently due from the estate have been paid.

his wife, both of 282 st. ~ohn's Drive, Camp lIill, Cumberland County,
Pennsylvania, 17011, both individually, severally and jointly, promise
to pay to the order of MILDRED p, SAUVE, of 16 W. Main street, Shire-
manstown, Cumberland County, Pennsylvania, 17011, Pennsylvania, the sum
of Forty-Two Thousand and NoI100 Dollars ($42,000.00), without offset,
and without interest, said amount being due and payable in full: On
Demand.
AND FURTIIER, we do hereby authorize and empower any attorney or
the Prothonotary of Cumberland County, Pennsylvania, or any Court of
Record of Pennsylvania or elsewhere, to appear for and enter Judgment
against us at any time before or after maturity for the above sum, with
or without declaration, with costs of suit, release of errors, without
stay of execution, and with 15% added for collection fees; and we
hereby agree not to make any motion or any application whatsoever to
any Court for an inquisition on any real estate that may be levied upon
to collect the aforesaid sum, and we voluntarily condemn same, and
authorize the Prothonotary or any Court of Record to enter saId volun-
tary condemnation upon the Writ of Execution and we further agree that
any property, real, personal or mixed may be sold through a Writ of
Execution and further hereby waive and release all relief from any and
all appraisements, stay or exemption laws of any state now in force or
