KNOW ALL MEN BY THESE PRESENTS, that I
WHEREAS, Beatrice K. Hattenbach, late of Upper Allen Township
Mechanicsburg, Cumberland County, Pennsylvania, deceased, died
testate on September 13, 1994;
WHEREAB, Letters Testamentary on the Estate of the said
deoedent were duly issued by the Register of wills of Cumberland
County, Mary C. Lewis to Marcia K. Welsh, Exeoutrix, on November
16, 1994;
WHEREAS, the Executrix has gathered the assets of the Estate
of the said decedent and the assets oonsist of personal property to
a total value of $150,384.53, as Bet forth in Exhibit "A" attaohed
herato, 'which is a Statement of Account of the Exeoutrix;
WHEREAS, debts, inoluding the payment of Inheritanoe Tax on
the said Estate, amount to $25,703.97, leaving a balanoe for
distribution of $124,680.56, as set forth in the Statement of
Aooount of the Executrix,
WHEREAS, the parties signing this Family Settlement Agreement
and Final Release each acknowledge reoeipt of $53,000.00 already
paid as partial distribution;
WIIIRlAS, the balanoe for dbtribution has been reduoed to oash
with the exoeption of the oash balanoe of $18.78 remaining in the
Smith Barney Estate Aocount No. 7241900518790, whioh the Exeoutrix
shall olose out and retain.
HOW, THEREFORE, WE, MARCIA K. WELSH and NANCY BERGSTROM, f/k/a
NANCY DUNBROOK, being the only perDons entitled to inherit any
remaining assets of the Estate of Beatrice K. lIattenbaoh, do hereby
aoknowledge that we have th1e day reoeived from the Exeoutrix, in
full satisfaotion, all sums of money whioh are given to eaoh of us,
by virtue of the Deoedent's Last will and Testament. Furthermore,
it is aoknowledged that Nanoy Bergstrom has agreed to relinquish to
her sister, Maroia K. Welsh, any additional monies to whioh Nanoy
Bergstrom may be entitled in exoess of the partial distribution of
$53,000.00. A copy of Nancy Bergstrom's letter indicating her
relinquishment is attached hereto as Exhibit "B". Thus, any monies
remaining for distribution shall go direotly to Marcia K. Welsh.
AHD, we do hereby stipulate that in order to avoid the expense
a.nd time involved in the filing of a formal aooount and schedule of
distribution, we agree that no acoount is neoessary and we do
hereby agree that we do oonsent to distribution being made without
the filing of an aooount and schedule of distribution, the same to
be with the same force and effeot as if the documents had been
filed and oonfirmed by the Orphans I Court Division of the Court of
Cumberland County.
THIRlrOR!:, we do hereby release and forever disoharge the
Exeoutrix, /4aroia K. Welsh, Jill M. Wineka, Esquire and the Law

Firm of Puroell, Krug & Haller, the attorneys for the Estate, their
heirs, executors, administrators and assigns, of and from all
aotions, suits, payments, aooounts, and olaims whatsoever for or by
reason thereof whatsoever, touching upon the Estate of the said
Deoedent. We do also agree that should any liability oome due to
the Estate of the said Decedent after the signing of this
Agreement, eaoh of us do covenant and agree that we will contribute
prorata our share of thB Estate whioh we eaoh have reoeived in
order to satisfy any and all claims, demands, suits or causes of
.aotion which may be suocessfully proeeouted against the said Estate
or the aforesaid Exeoutrix after the signing, sealing and delivery
of this Family Settlement Agreement and Final Release.
It is
further understood that any outstanding inoome tax or the cost for
preparation of any such Fiduoiary Income Tax Return shall be borne
solely by Marcia K. Welsh.
IN WITNESS WHEREOF, we have set our hands and seals to the
Family. Settlement Agreement and Final Rt,llease on the dates as
Indicated beluw.
