I, Harold R. Hammes of 55 Tower Road, Dillsburg, Cumberland
County, Pennsylvania declare this to be my last will and revoke
any will previously made by me.
ITEM ONE: I direct that all my debts and funeral expenses,
including my gravemarker shall be paid from my residuary estate
as soon as practicable after my decease as a part of the
expense of the administration of my estate.
ITEM TWO: I give, devise and bequeath my entire estate to my
nephew, Robert Meyer if he survives me by 60 days. As a
condition of Robert Meyer receiving my estate, he shall provide
a good home and living care for my three dogs.
ITEM THREE: I appoint Robert Meyer Executor of this my last
will. Should he fail to qualify or cease to act as Executor, I
appoint John Tanner to act as Executor with the same rights,
powers and duties.
ITEM FOUR: All estate, inheritance, succession and other
taxes, imposed or payable by reason of my death, and interest
and penalties thereon, with respect to all property comprising
my gross estate for tax purposes, whether or not such property
passes under this will, shall be paid out of the principal of
my residuary estate, without apportionment or right of
reimbursement.
ITEM FIVE: I direct that my personal represontative or
guardian shall not be required to give bond for the faithful
performance of their duties in any jurisdiction.
ITEM SIX: In addition to the rights and powers given to the
fiduciaries by law or elsewhere in this will, I give to my
Executor during the full time necessary and for the
administration of my estate the following rights and powers to
be exercised in his sole discretion.
A. To retain any real or personal property which may at any
time form a part of my estate so long as he or she deems it
advisable.
B. To invest in any real or personal property without
restrictions to legal investments.

C. To repair, alter, improve or lease for any period of time
any real or personal property and to give options for leases.
D. To sell at public or private sale, for cash or credit, with
or without security, to exchange or to partition real or
personal property, and to give options for leases.

F. To compromise claims.
ITBM SBVBN: I direct that my executor shall make funeral
arrangements through Bwing Brothers Funeral Home of Carlisle,
Pennsylvania and to provide a solid copper coffin.
Furthermore, the executor is instructed to arrange for a
Catholic mass through Sister Giblin of St. Phillips Convent in
Saddlebrook, New Jersey with my burial in the family plot at
holy Cross Cemetery, North Arlington, New Jersey.

1. Petitioners are Warren B. Lupfer, Jr. and Ruth E.
Fry, now Ruth E. Lupfer, of 55 Tower Road, Dillsburg (South
Middleton Township), Cumberland County, Pennsylvania.
2. Respondent is Robert A. Myer, now or formerly of 6
Washington street, or 21 Valgar street, Brattleboro,
Vermont, Executor of the Estate of Harold R. Hammes.
3. On March 30, 1999, a citation was awarded directing
Robert A. Myer to show cause why he should not be removed as
executor of the will of Harold R. Hammes and why Hubert X.
Gilroy, Esquire should not be appointed administrator of the
Estate.
4, The rule was returnable 20 days after service by
first class mail to the last known address of Robert A.
Myer.
5. Petitioners mailed three of the citations certified
mail to three addresses used by respondent.
Two of the
citations were received and one returned as undeliverable.
6. Petitioners mailed three citations regular mail to
three addresses used by respondent. Only one was returned.
Twenty days have passed since receipt of the citation
on April 5, 1999.
WHEREFORE, petitioners request the citation be made
absolute and to remove Robert A. Myer as executor and to
appoint Hubert X. Gilroy, Esquire as Administrator of the
Estate.

at Ten West High Street, Carlisle, Pennsylvania, and that on

Robert A. Myer at 6 Washington Street, Brattleboro, VT,
05301, to 21 Valgar street, Brattleboro, VT, (' 301, and to
c/o Moles Eye Cafe, 4 High Street Brattleboro, VT, 05301.
The certified mail sent to 6 Washington street was received
by Robert A. Myer on April 5, 1999. Return receipt
#Z013333927 is attached hereto. The citation sent to Robert
A. Myer, c/o Moles Eye Cafe was also received April 5 and
return receipt card #Z01333929 is attached hereto. The
certified mail sent to 21 Valgar Street was returned as "not
deliverable" on April 5, 1999.
The citation was also sent first class mail on April 1
to the above addresses. Only the one sent to 21 Valgar
Street was returned as "not deliverable." The citations

I, Harold R. Hammes of 55 Tower Road, Dillsburg, Cumberland
County, Pennsylvania declare this to be my last will and revoke
any will previously made by me.
ITEH ONB: I direct that all my debts and funeral expenses,
including my gravemarker shall be paid from my residuary estate
as soon as practicable after my decease as a part of the
expense of the administration of my estate.
ITEH TWO: I give, devise and bequeath my entire estate to my
nephew, Robert Heyer if he survives me by 60 days. As a
condition of Robert Heyer receiving my estate, he shall provide
a good home and living care for my three dogs.
ITBH THREB: I appoint Robert Heyer Bxecutor of this my last
will. Should he fail to qualify or cease to act as Bxecutor, I
appoint John Tanner to act as Bxecutor with the same rights,
powers and duties.
ITEH FOUR: All estate, inheritance, succession and other
taxes, imposed or payable by reason of my death, and interest
and penalties thereon, with respect' to all property comprising
my gross estate for tax purposes, whether or not such property
passes under this will, shall be paid out of the principal of
my residuary estate, without apportionment or right of
reimbursement.
ITEH FIVE: I direct that my personal representative or
guardian shall not be required to give bond for the faithful
performance of their duties in any jurisdiction.
ITBH SIX: In addition to the rights and powers given to the
fiduciaries by law or elsewhere in this will, I give to my
Bxecutor during the full time necessary and for the
administration of my estate the following rights and powers to
be exercised in his sole discretion.
A. To retain any real or personal property which may at any
time form a part of my estate so long as he or she deems it
advisable.
B. To invest in any real or personal property without
restrictions to legal investments.

Catholic mass through Sister Giblin oL st. Phillips Convent in
Saddlebrook, New Jersey with my burial in the Lamlly plot at
holy Cross Cemetery, North Arlington, New Jersey.

WITNESSETH
WHEREAS, Harold R. Hammes (Decedent) died on November 6, 1994: and
WHEREAS, Decedent died testate leaving a will dated January 16, 1991 In which Myer was
appointed Executor of the Decedent's Estate; and
WHEREAS, Myer took appropriate action to file the said will with the Register of Wills of
Cumberland County and to have Myer appointed Executor of the Decedent's Estate at Docket
No. 21-94-0976; and
WHEREAS, pursuant to Order of Court dated May 5, 1999, Myer was removed as Executor of
the Estate of Harold R. Hammes and Hubert X. Gilroy, Esquire was dire<;ted by said Court Order
to take out Letters of Administration in the Estate of Harold R. Hammcs, a copy of said Order is
attached hereto and marked Exhibit "A"; and
WHEREAS, pursuant to appropriate Order of thc Cumberland County Rcgister of Wills dated
June 9, 1999, Hubert X, Gilroy, Esquirc was appolntcd Administrator C.T.A, of the Estatc of
Harold R. Hammes at Estatc No. 21-94-0976; and
WHEREAS, thc Administrator has completed thi: sale of real estate owned by the Decedent at
the time of his death and has taken other action in the nature of filing of appropriate income tax
returns and filing of appropriate Pennsylvania inheritance tax returns in an effort to conclude the
handling of the Estate of Harold R. Hammes; and
WHEREAS, a copy of the Inheritance Tax Rcturn filcd in the Estate of Harold R. Hammes Is
attached hereto and marked Exhibit "B"; and

NOW, THBREFORE, the parties in consideration of the mutual covenants herein expresses and
intending to be legally bound hereby, agree as follows:

Myer hereby walves the filing of a fonnal accounting and schedule of distribution in the Bstste
of Harold R. Hammes.

Upon receipt by Myer of payments from the Estate of Harold R. Hammes, Myer agrees to refund
to the Estste any portion of any distribution made to him and to which he is not properly entitled
and to the extent of said distribution to indemnifY the Bstste of Harold R. Hammes from any
clalms and to reimburse the Estate for any expenses or cost in connection with said clalms.

Myer acknowledges that he has been provided with an opportunity to examine all papCIWork and
accounting of all expenses and revenues with respect to the Estate of Harold R. Hammes that are
in the control of the Administrator,

Upon the signing of this Agreement, Myer acknowledges that the Administrator shall proceed
with setting up a non-interest bearing escrow account to hold the reserve monies as set forth as
follows:

Myer acknowledges that a final income tax return for the Bstate of Harold R. Hammes will need
to be filed and it is the intention of the Administrator to proceed with filing said income tax
return and paying income taxes owing and costs associated with the necessary preparation of the
appropriate tax return, if any.

With reserve for additional costs as set forth in Paragraph 4 above, Myer acknowledges that the
sum of $54,825,32 shall be distributed to him upon Myers signing this Agreement and upon
Myer returning two (2) signed copies of this Agreement to the Administrator,

Myer agrees that the Administrator shall hold the remaining monies in the Estate of Harold R.
Hammes for the payment of items as set forth in Paragraph 4 above. Upon final payment of all
Income tax owing, all accounting bills and any other miscellanc.ous bills, Myer agrees that the
Administrator shall distribute all remaining assets to Myer without the requirement of any further
written agreement or court order,

Myer hereby forever releases, compromises, seules and discharges any and all claims, demands,
actions or causes of actions, legal or equitable, absolute or contingent, which he may have
against any party hereto or against the Estate of Harold R. Hammes or against Hubert X, Gilroy,
Esquire, Administrator C.T.A. of the Estate of Harold R. Hammes, by reason of any matter,
cause or thing growing out of or relating to any property or assets of said Estate, or growing out
of or relating to any act of the Administrator in his administration of the Estate. This release
shall release the Administrator from all liability, whether due to his negligence or otherwise,
which he may have by reason of his administration of the Estate of Harold R. Hammes. This
release shall not release the Administrator from any claims relating to fraud or claims relating to
willful action on behalf of the Administrator and failing to disclose an account for assets of the
Estate which the Administrator may have received. This release shall be binding upon signing
by Myer and signing by the Administrator.

Myer acknowledges that he may present this Agreement to his own private counsel for legal
advice if Mycr desires to have quch individual legal advice. Myer further acknowledges that he
Is aware that the Administrator is Ilt't acting as personal attomey for Myer in this matter.

Myer and the Administrator agree that this instrument shall be binding upon them, their
SUccesSOlll, assigns and pelllonal representative.

WHEREAS, the PeMsylvanla Department of Revenue has accepted as filed the Inhcritance Tax
Return and has Issued a Notice of Assessmcntln connection with this maller, a copy of which Is
allached hereto and marked Exhibit "e"; and
WHEREAS, the Administrator has provided an opportunity to Myer to examine all records of
the Decedent In the possession of the Administrator and to examine all records of the Decedent's
Estate in the possession of the Administrator; and
WHEREAS, the Administrator Is prepared to achieve the final distribution of the Decedent's
Estate subject to the reserves as set forth below; and
WHEREAS, the Administrator and Myer desire that the administration of the Estate of Harold R.
Hammes be tennlnated without the expense and delay of a court accounting and the parties are
willing to enter Into this Estate Settlement Agreement In order to expedite the conclusion of the
Estate; and
WHEREAS, during the time that Myer handled the Estate of Harold R. Hammes, Myer made
certain advance distributions to himself; and
WHEREAS, during the time the Administrator has handled the Estate of Harold R. Hammes, the
Administrator has made certain advance distributions to Myer while at the same time the
Administrator has paid certain expenses and obligations of the Estate; and
WHEREAS, the Administrator currently holds funds in the amount of $57,325.32 in the Estate
of Harold R. Hammes which represents all remaining monies to be distributed; and
WHEREAS, the Administrator proposes to hold monies in reserve from those funds as follows:

I, Harold R. Hlll/llIIes of 55 Tower Road, Dillsburg, Cumberland
County, Pennsylvania declare this to be my last will and revoke
any will previously made by me.
ITEH ONE: I direct that all my debts and funeral expenses,
including my gravemarker shall be paid from my residuary estate
as soon as practicable after my decease as a part of the
expense of the administration of my estate.
ITEH TWO: I give, devise and bequeath my entire estate to my
nephew, Robert Heyer if he survives me by 60 days. AD a
condition of Robert Heyer receiving my estate, he shall provide
a good home and living care for my three dogs.
ITEH THREE: I appoint Robert Heyer Executor of this my last
will. Should he fail to qualify or cease to act as Executor, I
appoint John Tanner to act as Executor with the same rights,
powers and duties.
ITEH FOUR: All estate, inheritance, succession and other
taxes, imposed or payable by reason of my death, and interest
and penalties thereon, with respect' to all property comprising
my gross e~tate for tax pur,poses, whether or not such property
passes under this will, s..all be paid out of the principal of
my residuary estate, without apportionment or right of
reimbursement.
ITEM FIVE: I direct that my personal representative or
guardian shall not be required to give bond for the faithful
performance of their duties in any jurisdiction.
ITEM SIX: In addition to the rights and powers given to the
fiduciaries by law or elsewhere in this will, I give to my
Executor during the full time necessary and for the
administration of my estate the following rights and powers to
be exercised in his sole discretion.
A. To retain any real or personal property which may at any
time form a part of my estate so long aD he or she deems it
advisable.
B. To invest in any real or personal property without
restrictions to legal investments.

Furthermore, the executor is instructed to arrange for a
Catholic mass through Sister Giblin of St. Phillips Convent in
Saddlebrook, New Jersey with my burial in the fami.ly plot at
holy Cross Cemetezy, North Arlington, New Jersey.

I do not know when the administration of the Estate will be complete. I was appointed
replacement Executor because of the failure of the other Executor to act. The other
Executor Is the sole beneficiary of the Estate. We have not been able to locate him, We
have commissioned a private Investigator to work on this.
