LAST WILL AND TRSTAHENT
I. JOHN R, FRY, of Upper Frsnkford Township, Cumberland County,
Pennsylvania" declare this to be my Last Will snd Testament and revoke sny
will or codicil previously made by me.
ITEM I: I direct that all my just debts and funeral expenses, including
my gravemarker and all expenses of my last illness, shall be paid from my
residuary estate as soon as I'racticable after my decease as a part of the
administration of my eatate.
ITEM II: I hereby devise the lot of land owned by me situated in Upper
Frankford Township, Cumberland County, Pennsylvania, upon which 1 presently
reside with my brother, GLENN, to my brother, GLENN E. FRY, provided he shall
aurvive me by thirty days. If my said brother ahall predecease me or die on
or before the thirtieth day following my death, the within devised lot shall
lapse and shall pass as a part of the residue of my estate in ITEM IV
hereinafter.
ITEM III: I hereby direct that my executora, in making distribution of
my estate, shall have the right and power to distrlbute any real estate owned
by me at my deatb to such of my beneficiaries as survive me and as are
desirous of receiving a distribution in kind of said real estate. The
diatributive ahare of any of such beneficiaries aa hereinafter provided sball
be reduced by their proportionate ahare of the aaid real estate based on its
fair market value os of the date of my death os determined for inherit once
tax purposes.

my death, of whatever nature and by whatever jurisdiction imposed, shall be
paid from my residuary estate as part of the expenses of the administration of
my estate.

WHEREAS, JOHN R. FRY, late of West Pennsboro Township, Cumberland
County, Pennsylvania, died on November 8, 1994; and
WHEREAS, the Last Will and Testament of JOHN R. FRY dated
February 27, 1985 was probated on December 8, 1994; and
WHEREAS, the debts and deductions, including the
inheritance tax in the said estate, is $ 26,546.60,
balance for distribution of $ 98,766.75, more fully
herein;
payment of
leaving a
set forth
WHEREAS, Letters Testamentary were granted to GLENN E. FRY and
CLARENCE W. FRY, lIon December 8, 1994; and
WHEREAS, at least 4 months has elapsed since the first
advertisement regarding grant of letters testamentary; and
WHEREAS, the said Co-Executors have gathered the assets of the
estate of the decedent consisting of both real property and
personal property, and income, for a total value of $ 125,313.35
as more fully set forth herein, which is a statement of account
of the said Co-Executors;
WHEREAS, distributions
previously made, leaving
kind, to be distributed,
in the amount of $ 600.00 have been
a balance of $ 98,166.75. in cash and in
NOW, THEREFORE, WITNESSETH that we, the said CLARENCE W. FRY,
DOROTHY BRADY, and RUTH FRY. in consideration of the above and
intending to be legally bound hereby, do hereby acknowledge that
they have this day received from the said Co-Executors, in full
satisfaction and payment of all sum or sums of money, legacies,
bequests and devises as are stated under said last will and
testament, the assets listed in the schedule of distribution, and

THEREFORE, we do hereby remise, release, quitclaim and forever
discharge the said Co-Executors of and from the said estate and
from all actions suits, payments, accounts, reckonings, claims,
and demands whatsoever for or by reason thereof, or for any other
use, matter, cause or thing whatsoever, touching upon the estate
of the said decedent, and we do further hereby covenant and agree
that should any liability come due to the estate of the said
decedent after the signing of this agreement, we hereby covenant
and agree with each other and the aforesaid personal represent-
atives, that we will contribute pro-rata our share of the estate
to satisfy any and all claims, demands, suits, or causes of
action which may be successfully prosecuted against the said
estate or the aforesaid personal representatives after the
signing, sealing and delivery of this family settlement agreement
and final release.
