I, ESTHER I. THURSTON, a l'esldent of East Pennsboro Township,
Cumberland County, Pennsylvania, being of sound and disposing mind and memory,
do hereby make, publish and declare this as and for my Last Will and Testament,
hereby revoking any and all Wills by me at any time heretofore made.
ITEM I. I direct that all my just debts and funeral expenses be paid as
soon after my decease as may be found convenient.
ITEM II. All the rest, residue and remainder of my estate, real or personal,
which I may own or have the power to dispose of at the time of my death, I give,
devise and bequeath unto my husband, Harold A. Thurston.
ITEM III, In the event my husband, Harold A. Thurston, shall predecease
me, I give. devise and bequeath my entire estate. real or personal. in equal shares.
unto my children. Carol Jane Wlttle, Mounted Route. Enola. Pennsylvania 17025.
and Thomas A. Thurston. Carlisle. Pennsylvania 17013. If either of my said
children shall predecease me, his share shall go to his surviving issue. If any,
in equal shares, otherwise to my surviving child.
ITEM IV. I hereby nominate, constitute and appoint Carol Jane Wittle and
Thomas A. Thurston. Executors of this my Last Will and Testament, with full
power in their discretion to do any and all things necessary for the complete
administration of my estate. with full power to sell at public or private sale and
without order of Court, any real or personal property belonging to my estate, and
to compound, compromise or otherwise to settle or adjust any and all claims, charges,
debts and demands whatsoever against or In favor of my estate as fully as I could
do if living.

We, the underlllllned, hllve paid the Inheritance Tax all billed on
the enclolled invoice under protellt. We feel we do not owo the tax
becau~e we did not inherit the property in lluestlon. The property
wall trunllferred to UII by our mother by deed (recorded at the Cumberland
County Cuurt 1I0use on Hay 23, 1990 in Book 0034, Plllle 858). The property
wall ours free and clear with no reservationll by our mother. In fact, ,the
plan wn~ that IIhe would relocnte, most likely, to one of our homes, and
her intent WII~ that we could use tho property to gurner allllet~ In case
she became incnpacitated and required profelltlional care.
Briefly, we had no agreement neither written nor implied that ~he
could or would stay at the property for any time frame. We expected
her to live with one of UII. But as it happened, IIhe wall not ready to
leave. Thi~ went on for four+ yearll and we didn I t have the heart to
force her to leave. During thill time frame we were neither gaining
financially from the property nor claiming it as depreciation for
income tax purpolles.
I'm lIure you realize the intent of the transfer of the deed and
how difficult it would have been to get an elderly parent to relocate.
Of course, had our mother lIurvived her heart attnckll, IIhe would, in
all probability, have had to relocate given her diabetic condition.

This is a letter of appeal to your decision that we
owe an inheritance tax on the property transferred to us by
our mother more than four and one-half years prior to her
death. The reason for the transfer was not to avoid the
tax but. rather for her to give us (instead of a nursing home
or some other orgsnization) control over how she would spend
her remaining years. This transfer, as noted, occurred well
over four years before she died and was final at that. time
wit.h absolutely no reservat.ions on her part.
We feel that the Commonwealth and the Board are treating
us wit.h total unfairness in both a legal and a moral sense
