SIXTH: TRUST - II' AMBER FOLTZ is under the age of' twenty-one
(21) years nt my death, then the share of my estate given t.o her
shall be held IN TRUST by NANCY L. McCULLOUGH and HAROLD J.
McCULLOUGH, under the following terms and conditions:

(A) The TRUSTEES shall deposit all monies in a
savings account at. the FARMERS NATIONAL BANK OF
NEWVILLE, PA, to or for the use of AMBER FOLTZ, or to
acoumulate it in the sole discretion of the TRUSTEE.
The TRUSTEE is also authorized and empowered t.o pay
over to, or for the use and benefit of AMBER FOLTZ such
portion of or all of the principul of' the trust. estate
as in the TRUSTEE'S sole discretion seems proper for
her education, medical care, support and maintenance.

(B) When AMBER FOLTZ reaches the age of twenty-one
(21) years, then whatever remains of t.he principal and
accumulated income of the trust estat.e shall be
distributed to her. If AMBER FOLTZ does not survive the
termination of this trust, then upon her decease

income of the trust. est.ate shall be distributed to her
children, share and share alike and subject to the same
trust. provisions that are provided herein for AMBER
FOLTZ, If she dies without issue, the trust assets
shall be distribut.ed to my children, on a per stirpes
distribution basis.

Judge; and it further appearing that t.he Last Will and Te.tament
of JANET E. FOLTZ provided in Paragraph FOURTH thorein as
follows:
"FOURTH: DEVISE OF REAL ESTATE - I hereby
devise my real estat.e, together wit.h
improvement.s thereon, situate In North Newton
Township, Cumberland Count.y, Ponnsylvania, to
my daught.er, NANCY L. HcCULLOUOII and my son-
in-law, HAROLD J. HcCULLOUGH.
The said devisees shall collect all
rents and income, pay all expenses and
maintenance, and place the remaininK amount.
IN TRUST for AHBER FOLTZ, pursuant to
Paragraph SIXTH below, In the evont t.hat
said real est.ate is conveyed by t.he said
devisees in the fut.ure, the net proceeds
shall be divided equally among NANCY L.
HcCULLOUGH, BARRY L. FOLTZ, JEFFREY I., FOLTZ
and AHBER FOLTZ. However, if any of said
persons does not survive me and leaves
children who so survive me, such children
shall receive, per stirpes, the share my
child would have received had he or she so
survived me."

Distribution confirmed on June 18, 1996, by specifically awarding

Donald B. Dunlap and Anna Mary Dunlap, his wife, in a
Southeasterly direction a distance of 160 feet. to an
iron pin: thence along other land owned now or formerly
of PaulO. Dyarman and Mary L. Dyarman, his wife, in a
Southwesterly direct.ion a distance of 200 feet. t.o a
point; thence along other lands now or formerly of Paul
O. Dyarman and Mary L. Dyarman, his wife, in a
Northwesterly direction a distance of 142 feet. to a
point in the center of the aforesaid public road;

lAI The TRUSTEES shall deposit all monies in a
savings account at the FARMERS NATIONAL BANK OF
NEWVILLE, PA, to or for the use of AMBER FOLTZ, or to
accumulat.e it in t.he sole discretion of the TRUSTEE.
The TRUSTEE is also authorized and empowered t.o pay
over to, or for the use and benefit of AMBER FOLTZ such
port.ion of or all of the principal of t.he t.rust. est.ate
as in t.he TRUSTEE'S sole discretion seems proper for
her educat.ion, medical care, support. and maint.enance.
(B) When AMBER FOLTZ reaches t.he age of t.went.y-one
1211 years, then whatever remains of the principal and
accumulat.ed income of the t.rust estate shall be
distributed to her. If AMBER FOLTZ does not survive t.he
termination of t.his t.rust., then upon her decease
what.ever remains of t.he principal and accumulated
income of t.he t.rust est.ate shall be dist.ribut.ed t.o her
children, share and share alike and subject. t.o t.he same
t.rust. provisions that are provided herein for AMBER
FOLTZ. If she dies without issue, the trust assets
shall be distributed to my children, on a per st.irpes
distribution basis.
(C) The TRUSTEES shall not be required to post
bond.
SEVENTH: GUARDIAN OF THE PERSON - I hereby nominat.e my daught.er,
NANCY L. McCULLOUGH, and my son-in-law, HAROLD J. McCULLOUGH as
guardians of t.he person for AMBER FOLTZ.

and Proposed Schedule of Distribution of NANCY L. McCULLOUGH,
Executrix of the Last Will and Testament of JANE'r E. FOLTZ, late
of North Newton
Township, Cumberland County, Pennsylvania,
deceased, have been filed and advertised in accordance with law
and Rules of Court and the same having been confirmed absolutely
by the Orphans' Court. Division of the Cumberland County Court of
Common Pleas on June 18, 1996, by HAROLD E, SHEELY, President
Judge; and it furt.her appearing that tha Last. Will and Testament.
of JANET E. FOLTZ provided in Paragraph FOURTH t.herein as
follows:
"FOURTH: DEVISE OF REAL ESTATE - I hereby
devise my real est.ate, t.ogether with
improvements thereon, situate in North Newton
Township, Cumberland Count.y, Pennsylvania, t~
my daught.er, NANCY L. McCULLOUGH and my son-
in-law, HAROLD J. McCULLOUGH.
The said devisees shall collect. all
rents and income, pay all expenses and
maintenance, and plaoe the remaining amount
IN TRUST for AMBER FOLTZ, pursuant t.o
Paragraph SIXTH below. In the event that
said real estat.e is conveyed by the said
devisees in t.he fut.ure, the net. proceeds
shall be divided equally among NANCY L.
McCULLOUGH, BARRY L. FOLTZ, JEFFREY L. FOLTZ
and AMBER FOLTZ. However, if any of said

persons does not survivB me and leavos
children who so survive me, such children

AND IT NOW being desired to clarify the Schedule of
Distribution confirmed on June 18, 1996, by specifically awarding
the hereinafter-described real estate in accordance with the
above recited Paragraph FOURTH of decedent.'s Last Will and
Testament. to her daughter, NANCY L. McCULLOUGH and son-in-law,
HAROLD J. McCULLOUGH, subject to said conditions listed above.
NOW, THEREFORE, it. is ordered, adjudged, and decreed that:
TRACT 1:
ALL that certain lot. of ground situate in North Newton
Township, Cumberland County, Pennsylvania, bounded and
described as follows:
BEGINNING at a point-in the center of public road being
Township Road 306; thence along land now or formerly of
Donald B. Dunlap and Anna Mary Dunlap, his wife, in a
Southeast.erly direct.ion a distance of 160 feet. to an
iron pin; t.hence along other land owned now or formerly
of PaulO, Dyarman and Mary L, Dyarman, his wife, in a
Southwesterly direct.ion a distance of 200 feet. to a
point; thence along other lands now or formerly of Paul
O. Dyarman and Hary L. Dyarman, his wife, in a
Northwesterly direction a distance of 142 feet to a
point in t.he center of the aforesaid public road;
thence through the center of the aforesaid public road
in a Northeast.erly direct.ion a distance of 230 feet to
a point., the place of BEGINNING,
BEING THE SAHE REAL ESTATE WHICH PAUL O. DYARMAN and
HARY L. DYARHAN, his wife, by deed dated Hay 14, 1970
and recorded in the Office of t.he Recorder of Deeds in
and for Cumberland Count.y in Deed Book Volume Q-23,
Page 96, granted and conveyed to WALTER R. FOLTZ and
JANET E. FOLTZ, his wife. The said WALTER R. FOLTZ
having died on August II, 1992, thereby vest.ing full
tit.le in JANET E, FOLTZ, his wife.

BEGINNING at. an iron pin at the edge of a proposed
right of way being the dividing line between lots #4
and '5 of the aforementioned Plan; thence along said
dividing line North 37 degrees 40 minutes 35 seconds
West, a distance of 74.13 feet to a post; thence along

Page 788, granted and conveyed to WALTER R. FOLTZ and
JANET E. FOLTZ, his wife. The said WALTER R. FOLTZ
having died on August. 11, 1992, thereby vest.ing full
t.itle in JANET E. FOLTZ, his wife.
IS hereby awarded to NANCY L. McCULLOUGH and HAROLD J.
McCULLOUGH, subject t.o the restrictions contained in the said
Paragraph FOURTH.
