I, AGNES M. TWARDZIK, of the Borough of st. Clair,
schuylkill County, Pennsylvania, being of sound and disposing mind
and memory, do make, publish and declare this to be my Last Will
and Testament, hereby revoking all wills and Codicils by me at any
time previously made.

ITEM I:
All inheritance, estate and

similar taxes becoming due by reason of my death ("Death Taxes"),
whether such Death Taxes shall be payable by my estate or by any
recipient of any property, shall be paid by my Executor out of the
property passing under ITEM IV of this Will as an expense and cost
of administration of my estate. My Executor shall have no duty or
obligation to obtain reimbursement for any Death Taxes paid by my
Executor, even though paid with respect to proceeds of insurance
or other property not passing under this Will.
ITEM II:
(a) I give and bequeath to my

daughter, JOAN M. DANKO, if she survives me, all of my jewelry
(except for the ring disposed of under paragraph (b) of this
ITEM), my grandfather clock, sewing machine, secretary desk and
coin collection. If my daughter does not survive me, I give such

articles to my daughter's children living at my death in as nearly
equal shares as they shall select.
(b) I give and bequeath to my son, ROBERT J,
TWARDZIK, if he survives me, my Keepsake diamond ring
set in white gold. If my son does not survive me, the
bequest to my son under this paragraph (b) shall lapse.
(c) I give and bequeath to my granddaughter, MEGAN
DANKO, if she survives me, my four piece solid cherry
bedroom set. If my said granddaughter does not survive
me, the bequest to her under this paragraph (c) shall
lapse.
(d) I give and bequeath all of my household
furniture and furnishings, automobiles, books, pictures,
jewelry, china, crystal, appliances, silverware, wearing
apparel and all other like articles of household or
personal use or adornment not disposed of under
paragraphs (a) through (c) of this ITEM, to my issue,
per stirpes, living at my death in as nearly equal
shares as they shall select under the supervision of my
Executor. My Executor, acting under paragraph (a) and
paragraph (d) of this ITEM, shall select such articles,
if any, as such Executor deems appropriate for any minor
and deliver the articles to the minor or to any person
or persons chosen by such Executor whose receipt shall
be a complete acquittance therefor. If any such
articles cannot be fairly divided or distributed in kind
in the opinion of my Executor, such articles shall be

sold and the proceeds thereof shall pass 8S a part of my
residuary estate.
ITEM III: If my sister, ANNA LIPTOK,
survives me, I give and bequeath the sum of Ten Thousand Dollars
($10,000.00) to my daughter, JOAN M. DANKO, if she survives me, or
if my daughter does not survive me, I give and bequeath such sum
to her husband, DOUGLAS B. DANKO, if he survives me. I ask but do
not direct that my daughter (or her husband) use such sum for the
benefit of my said sister. I give my daughter (or her husband)
complete discretion as to whether to so expend any of this sum for
my said sister and my daughter (or her husband) shall not be
required to account to any person for her (or his) use of the sum
passing to her (or him) under this ITEM.
ITEM IV: I give, devise and bequeath all
the rest and residue of my property, real, personal and mixed, not
disposed of in the preceding portions of this Will, hereby
exercising any power of appointment which I may possess, in two
equal shares, as follows:
(a) One equal share of my said residuary estate
shall be distributed to my daughter and her children as
follows:
(1) I give and bequeath the sum of Ten
Thousand Dollars ($10,000.00) from such share
of my said residuary estate to each child of
my daughter, JOAN M. DANKO, living at my
death. If any of my said grandchildren is a
minor at the time of the payment of the

bequest to him or her under this paragraph (a)
(1), my Executor may pay such sum to the minor
or to a guardian of the minor's estate acting
hereunder or otherwise, or such sum may be
distributed to and registered in the name of
any person who is acting or agrees to act as
custodian for the minor under a Uniform Gifts
to Minors Act or may be deposited in a savings
account in the minor's name.
(2) I give, devise and bequeath the
balance of such share of my said residuary
estate to my daughter, JOAN M. DANKO, if she
survives me, or if she does not survive me, to
her issue living at my death, per stirpes. If
my said daughter and all of her issue
predecease me, the share otherwise passing
under this paragraph (a) shall be added to the
property passing under paragraph (b) of this
ITEM,
(b) One equal share of my said residuary estate
shall be distributed to my son and his children as
follows:
(1) I give and bequeath the sum of Ten

of my said residuary estate to each child of
my son, ROBERT J, TWARDZIK, living at my
death. If any of my said grandchildren is a

bequest to her or him under this paragraph (b)
(1), my Executor may pay such sum to the minor
or to a guardian of the minor's estate acting
hereunder or otherwise, or such sum may be
distributed to and registered in the name of

to Minors Act or may be deposited in a savings
account in the minor's name.
(2) I give, devise and bequeath the
balance of such share of my said residuary
estate to my son, ROBERT J. TWARDZIK, if he
survives me, or if he does not survive me, to

my said son and all of his issue predecease
me, the share otherwise passing under this
paragraph (b) shall be added to the property
passing under paragraph (a) of this ITEM.
ITEM V: No interest in income or
principal of my estate shall be subject to attachment, levy or
seizure by any creditor, spouse, assignee or trustee or receiver
in bankruptcy of any beneficiary of my estate prior to the
beneficiary's actual receipt thereof. My Executor shall pay over
the net income and the principal to the beneficiaries herein
designated, as their interests may appear, without regard to any
attempted anticipation (except as may be specifically provided

herein), pledging or assignment by any beneficiary of my estate
and without regard to any claim thereto or attempted levy,
attachment, seizure or other process against said beneficiary.
ITEM VI:
Any person, who shall have died
at the same time as I or under such circumstances that it is
difficult or impossible to determine who shall have died first,
shall be deemed to have predeceased me.
ITEM VII:
In the settlement of my estate,
my Executor shall possess, among others, the following powers to
be exercised for the best interests of the beneficiaries:
(a) To retain any investments I may have at my
death so long as my Executor may deem it advisable to
my estate so to do.
(b) To vary investments, when deemed desirable by
my Executor, and to invest in such bonds, stocks,
notes, real estate mortgages or other securities or in
such other real or personal property as my Executor
shall deem wise, without being restricted to so-called
"legal investments."
(c) In order to effect a division of the
principal of my estate or for any other purpose,
including any final distribution of my estate, my
Executor is authorized to make said divisions or
distributions of the personalty and realty partly or
wholly in kind. If such division or distribution is
made in kind, said assets shall be divided or
distributed at their respective values on the date or
dates of their division or distribution. In making any
division or distribution in kind, my Executor shall
divide or distribute said assets in a manner which will
fairly allocate any unrealized appreciation among the
beneficiaries.
Cd) To sell either at pUblic or private sale and
upon such terms and conditions as my Executor may deem
advantageous to my estate, any or all real or personal
estate or interest therein owned by my estate severally
or in conjunction with other persons or acquired after
my death by my Executor, and to consummate said sale or
sales by sUfficient deeds or other instruments to the
purchaser or purchasers, conveying a fee simple title,

free and clear of all trust and without obligation or
liability of the purchaser or purchasers to see to the
application of the purchase money or to make inquiry
into the validity of said sale or sales; also, to make,
execute, acknowledge and deliver any and all deeds,
assignments, options or other writings which may be
necessary or desirable in carrying out any of the
powers conferred upon my Executor in this paragraph or
elsewhere in this will.
(e) To mortgage real estate and to make leases of
real estate for any term.
(f) To borrow money from any party, inclUding my
Executor, to pay indebtedness of mine or of my estate,
expenses of administration, Death Taxes or other taxes.
(g) To pay all costs, Death Taxes or nther taxes,
expenses and charges in connection with the administra-
tion of my estate, and my Executor shall pay the
expenses of my last illness and funeral expenses.
(h) To hold investments in the name of a nominee.
(i) To compromise controversies.
.ITEM VIII:
If at any time any minor shall
be entitled to receive any assets free of trust by reason of my
death, whether payable hereunder, by operation of law or
otherwise, I appoint my Executor as Guardian of such assets
authorized by law payable to such minor. The Guardian may
receive, administer and shall have full authority to use such
assets, both principal and income, in any manner the Guardian
shall deem advisable for the best interests of the minor,
including college, university, graduate or other education,
without securing a court order. The Guardian shall have all the
rights and privileges in its capacity as Guardian as are herein
granted to my Executor as to my estate
ITEM IX:
I hereby appoint my daughter,
JOAN M. DANKO, as Executrix of this will. If for any reason she

DANKO, as Exeoutor. All roforonoos in this Will to my "Exeoutor"
shall also reter to my Exeoutrix or to my suooessor Executor, as
the oase may be.
ITEM Xl
Any Guardian or Executor shall
quality and serve without the duty or obligation of filing any
bond or other seourity.

LAST WILL AND TESTAMENT
AGNES M. TWARDZIK
I, AGNES M. TWARDZIK, ot the Borough ot st. Clair,
schuylkill county, Pennsylvania, being ot sound and disposing mind
and memory, do make, publish and declare this to be my Last Will
and Testament, hereby revoking all wills and codicils by me at any
time previously made.
ITEM I:
All inheritance, estate and
similar taxes becoming due by reason ot my death ("Death Taxes"),
whether such Death Taxes shall be payable by my estate or by any
recipient ot any property, shall be paid by my Executor out of the
property passing under ITEM IV of this Will as an expense and cost
ot administration of my estate. My Executor shall have no duty or
obligation to obtain reimbursement for any Death Taxes paid by my
Executor, even though paid with respect to proceeds of insurance
or other property not passing under this will.
ITEM II: (a) I give and bequeath to my
daughter, JOAN M. DANKO, it she survives me, all of my jewelry
(except tor the ring disposed ot under paragraph (b) ot this
ITEM), my grandfather clock, sewing machine, secretary desk and
coin collection. It my daughter does not survive me, I give such

article. to my daughter'. children living at my death in as nearly
equal .hares as they shall select.
(b) I give and bequeath to my son, ROBERT J.
TWARDZIK, it he survives me, my Keepsake diamond ring
set in white gold. It my Bon does not survive me, the
bequest to my son under this paragraph (b) shall lapse.
(c) I give and bequeath to my granddaughter, MEGAN
DANKO, it ehe survives me, my four piece solid cherry
bedroom set. If my said granddaughter does not survive
me, the bequest to her under this paragraph (cl shall
lapse.
(d) I give and bequeath allot my household
turniture and turnishings, automobiles, books, pictures,
jewelry, China, crystal, appliances, silverware, wearing
apparel and all other like articles of household or
personal use or adornment not disposed of under
paragraphs (al through (c) of this ITEM, to my issue,
per stirpes, living at my death in as nearly equal
shares as they shall select under the supervision of my
Executor. My Executor, acting under paragraph (a) and
paragraph (d) of this ITEM, shall select such articles,
if any, as such Executor deems appropriate for any minor
and deliver the articles to the minor or to any person
or persons chosen by such Executor whose receipt shall
be a complete acquittance therefor. If any such
articles cannot be fairly divided or distributed in kind
in the opinion of my Executor, such articles shall be

ITEM rII: If my sister, ANNA LIPTOK,
survives me, I give and bequeath the sum ot Ten Thousand Dollars
($10,000.00) to my daughter, JOAN K. DANKO, if she survives me, or
if my daughter does not survive me, I give and bequeath such sum
to her hUSband, DOUGLAS B. DANKO, it he survives me. I ask but do
not direct that my daughter (or her husband) use such sum for the
benefit of my said sister. I give my daughter (or her husband)
complete discretion as to whether to so expend any of this sum for
my said sister and my daughter (or her hUsband) shall not be
required to account to any person for her (or his) use of the sum
passing to her (or him) under this ITEM.
ITEM rv: I give, devise and bequeath all
the rest and residue of my property, real, personal and mixed, not
disposed of in the preceding portions of this Will, hereby
exercising any power of appointment which I may possess, in two
equal shares, as follows:
(a) One equal share of my said residuary estate
shall be distributed to my daughter and her children as
follows:
(1) I give and bequeath the sum of Ten
Thousand Dollars ($lO,OOO.OO) from such share
of my said residuary estate to each child of
my daughter, JOAN H. DANKO, liVing at my
death. If any of my said grandChildren is a
minor at the time of the payment of the

beque.t to him or her under this paragraph (a)
(1), my Executor may pay such sum to the minor
or to a guardian of the minor's estate acting
hereunder or otherwise, or such sum may be
distributed to and registered in the name of
any person who is acting or agrees to act as
custodian for the minor under a Uniform Gifts
to Minors Act or may be deposited in a savings
account in the minor's name.
(2) I give, devise and bequeath the
balance of such share of my said residuary
estate to my daughter, JOAN M. DANKO, if she
survives me, or if she does not survive me, to
her issue living at my death, per stirpes. If
my said daughter and all of her issue
predecease me, the share otherwise passing
under this paragraph (a) shall be added to the
property passing under paragraph (b) of this
ITEM.
(b) One equal share of my said residuary estate
shall be distributed to my son and his children as
follow.:
(1) I give and bequeath the sum of Ten
Thousand Dollars ($10,000.00) from such share
of my said residuary estate to each child of
my son, ROBERT J. TWARDZIK, living at my
death. If any of my said grandchildren is a

minor at the time of the payment of the
bequest to her or him under this paragraph (b)
(1), my Executor may pay such sum to the minor
or to a guardian of the minor's estate acting
hereunder or otherwise, or such sum may be
distributed to and registered in the name of

to Minors Act or may be deposited in a savings
account in the minor's name.
(2) I give, devise and bequeath the

ITEM V: No interest in income or
principal of my estate shall be subject to attachment, levy or
seizure by any creditor, spouse, assignee or trustee or receiver
in bankruptcy of any bBneficiary of my estate prior to the
beneficiary'S actual receipt thereof. My Executor shall pay over
the net income and the principal to the beneficiaries herein
designated, as their interests may appear, without regard to any
attempted anticipation (except as may be specifically provided

herein), pledging or assignment by any beneficiary of my estate
and without regard to any claim thereto or attempted levy,
attachment, seizure or other process against said beneficiary.
ITEM VI:
Any person, who shall have died
at the same time as I or under such circumstances that it is
difficult or impossible to determine who shall have died first,
shall be deemed to have predeceased me.
ITEM VII:
In the settlement of my estate,
my Executor shall possess, among others, the following powers to
be exercised for the best interests of the beneficiaries:
(a) To retain any investments I may have at my
death so long as my Executor may deem it advisable to
my estate so to do.
(b) To vary investments, when deemed desirable by
my Executor, and to invest in such bonds, stocks,
notes, real estate mortgages or other securities or in
such other real or personal property as my Executor
shall dee~ wise, without being restricted to so-called
"legal investments."
(c) In order to effect a division of the
principal of my estate or for any other pUrpose,
including any final distribution of my estate, my
Executor is authorized to make said divisions or
distributions of the personalty and realty partly or
WhOlly in kind. If such diVision or distribution is
made in kind, said assets shall be divided or
distributed at their respective values on the date or
dates of their division or distribution. In making any
division or distribution in kind, my Executor shall
divide or distribute said assets in a manner which will
fairly allocate any unrealized appreciation among the
beneficiaries.
(d) To sell either at public or private sale and
upon such terms and conditions as my Executor may deem
advantageous to my estate, any or all real or personal
estate or interest therein owned by my estate severally
or in conjunction with other persons or acquired after
my death by my Executor, and to consummate said sale or
sales by sufficient deeds or other instruments to the
purchaser or purChasers, conveying a fee simple title,

free and clear of all trust and without obligation or
liability of the purchaser or purchasers to see to the
application of the purchase money or to make inquiry
into the validity of said .ale or sales, also, to make,
execute, acknowledge and deliver any and all deeds,
as.ignments, options or other writings which may be
necessary or desirable in carrying out any ot the
powers conferred upon my Executor in this paragraph or
elsewhere in this Will.
(e) To mortgage real estate and to make leases of
real estate for any term.
(f) To borrow money from any party, inClUding my
Executor, to pay indebtedness of mine or of my estate,
expenses of administration, Death Taxes or other taxes.
(g) To pay all costs, Death Taxes or other taxes,
expenses and charges in connection with the administra-
tion of my estate, and my Executor shall pay the
expenses of my last illness and funeral expenses.
(h) To hold investments in the name of a nominee.
(i) To compromise controversies.
ITEM VII~:
If at any time any minor shall
be entitled to receive any assets free of trust by reason of my
death, whether payable hereunder, by operation of law or
otherwise, I appoint my Executor as Guardian of such assets
authorized by law payable to such minor. The Guardian may
receive, administer and shall have full authority to Use such
assets, both principal and income, in any manner the Guardian
shall deem advisable for tHe best interests of the minor,
inClUding COllege, university, graduate or other education,
without securing a court order. The Guardian shall have all the
rights and privileges in its capacity as Guardian as are herein
granted to my Executor as to my estate
IT~M IX:
I hereby appoint my daughter,
JOAN M. DANKO, as Executrix of this Will. If for any reason she

should fail or cease to act, I appoint her husband, DOUGLAS B.
DANKO, as Executor. All references in this Will to my "Executor"
shall also refer to my Executrix or to my successor Executor, as
the case may be.
ITEM X:
Any Guardian or Executor shall
qualify and serve without the duty or obligation of filing any
bond or other security.
