I, EVEI.YN McGAUGHt:Y, of Grantham, Gumberland County, Pennsylvania,
declare this to be my will and hereby revoke all prior wills nnd codicils
made by me.
I. I bequeath, devise, nnd appoint all of my property, of whatuver
nature and wherever situated, to all of my children, ROBERT E. McGAUGHEY,
ROSEMARY M. GIBR, SHIRLEY M. JUNKINS and BRADFORD R. McGAUGHEY, shnre and
share alike, or their issue, per stirpes.
2. If any beneficiary under this will shall die within thirtv (30)
days after my death, he or she shall be deemed to have predeceased me for
all purposes under this will.
3. I grant to the fiduciaries named herein and their successor or
successors, the following powers in uddition to nnd not in limitation of
such powers as they may hold by law:
(a) To sell or otherwise dispose of any property, real or
personal, at any time forming a part of my estate, for cash or
upon credit, in such manner and on such terms and conditions as
they may deem best, and no persons dealing with them shall be
bound to see to the application of any moneys paid.
(b) To manage, operate, repair, improve, mortgage or
lease for any term any real estate at any time held or owned by
my estate.

5. I direct that all hequeots, legncieo and deviseo nnd nil shores and
interests in my estate shall not be oubject to attachment, levy, execution
or sequestration of any debt, contract, obligation or liability of any
legatee, beneficiary or devisee.
6. I direct that all estate, inheritance and succession taxes that may
be assessed in consequence of my death, of whatsoever nature and by whatever
jurisdiction imposed, shall be paid out of the principal of my general
estate to the same effect as if said taxes were expenses of administration,

Dear Donna:
You had transmitted to us a copy of a Will from the above-named decedent. The Will appears
to have been prepared for execution some time in 1980, although neither the testimonium clause nor the
self-proving affidavit has a date tilled In. There Is a signature line after the body of the Will for Evelyn
McGaughey which is blank. Following the WlII is a self-proving affidavit, which does show the name
of the decedent, and which contains blanks for the names of the witnesses. The names of the witnesses
were not tilled in the blanks, although following the text of the self-proving affidavil, the signature of
the decedent and the signatures of two witnesses appear.
The principal question In this mailer is whether, In fact, the aforementioned Instrument contains
all of the required formalities for a Will under Pennsylvania law. In particular, the question must be
addressed as to whether this Will has been signed "at the end thereof." Although there is no
Pennsylvania appellate court case precisely on point, the precise Issue has been addressed In the Orphans'
Court Divisions of three county Courts of Common Pleas In Pennsylvania. In each of those county court
cases, the Court held that although the signature of the Testator or the Testatrix appeared only on a
signature line following the self.proving affidavit, a Will bearing a signature In such a location was, in
fact, signed ":it the end thereof", and therefore met the required formalities for a Will under Pennsylvania
law. In addition, there are appellate level cases in Pennsylvania, which, while not on point, do provide
authority for the above-descrlbed county court decisions. Therefore, it is our opinion that the Instrument
which has been offered as the Will of Evelyn McGaughey may be admitted to probate.
Also, we should point out that, although the date of execution does not appear in the
aforementioned Will, there is no requirement under Pennsylvania law that a Will be dated.

AND PERSONAL REPRESENTATIVE FOR
ACCOUNTING AND DISTRIBUTION OF ASSETS
THIS AGREEMENT, by lInd umong nil of the beneliciaries under the Last Will and
Testament of Evelyn McGaughey, Deceased, to wit, Bradford R. McGaughey. 1812 Market
Street, Mechanicsburg, PA 17055; Shirley M. Jlmkins, Whiskey Springs Road. Dillsburg, PA
17019; Robert E. McGaughey. Box 6. Bowmansdale, PA 17008 and Rosemary M. Gibb, 85
Buttonwood Drive, DiIIsburg. PA 17019; and lhe Execulrix of said estate, Rosemary M. Gibb.
of the address aforesaid.
WITNESSETH:
WHEREAS. the said Evelyn McGaughey died a resident of Cumberland County on
April 30, 1995 and by her Last Will. duly received lor probate on May 30, 1995 by lhe
Register of Wills of Cumberland Counly. Pennsylvania. gave. bequeathed and devised all of
her estale in equal shares to all of her children, the said Brad(ord R. McGaughey. Shirley M.

WHEREAS, Rosemary M. Gibb has been duly appDintcd as Executrix of said Estate
pursuWlt to <he tcnns of the Decedent's Last Will; Wld
WHEREAS, each of the partics to this Agrccmcnt has bccn furnished with a complete
itemization of the estate assets, receipts and disbursemcnts, including a proposed schedule of
distribution; and
WHEREAS, each of the parties to this Agreement acknowledges previous receipt of a
copy of <he Last Will and Testament of the said Decedcnt; and
WHEREAS, it is the desire of the parties to this Agreement that the final distribution
of this Estate be accomplished without a fonnal accounting to the Orphans' Court Division of
<he Court of Common Pleas of Cumberland County. it being the desire of the parties to avoid
<he expense, delay Wld publieity of a formal accounting; and
NOW, THEREFORE, in consideration of the premises, Wld the mutual promises,
covenWlts and agreements herein set forth, and intending to be legally bound hereby. the
parties agree as follows:
I. Distribulion of net estate residue:
The net residue of said Estatc, after marshalling all of the assets of said
Estate, Wld after payment of Pennsylvania Inheritance Tax, debts of the
Decedent, and expenses of administralion, is in the cash sum of $59,620.04,
which shall be distribuled equally among the said beneficiaries as follows:
(a) $14,905.01 to Bradford R. McGaughey;
(b) $14,905.01 to Shirley M. Junkins;

(d) $14,905.01 to Rosemary M. Gibb.
2. Waiver and Relcase, The parties:
(a) Specifically waive thc requiremenl that the Executrix file an
accounting with the Orphans' Court Division of Ihe Court of Common Pleas of
Cumberland County. Pennsylvania;
(b) Agree and acknowledge that they have fully and carefully
examined all of the records of the Executrix reflecting her adminislration of
this Estate and find same to be true, correct and acceptable;
(c) Hereby accept and approve lhe dislribution as proposed and
agreed to refund the Executrix of the Estate any amounts which may be
necessary in the future to discharge any liabilities ,1f the Estate which may
have arisen before the date hereof but have not yet been brought to the
allention of the Executrix, and which liabilities arc properly found to be
chargeable against, and payable out of, the assets of the Estate, thus
compromising the distribulion set forth herein (such as additional unpaid debts
of the decedent, expenses of administration or inheritance or income taxes) and
of which the undersigned hereafter may rcceive notice;
(d) Hereby remise, release and discharge the Executrix and the
Estate, individually and collectively, of and from all manner of acts, suits,

3. Further:
(a) Each party to this Agreement ngrees and underslands that this
Agreement shall be indexed nnd recorded in lhe Eslate proceedings in the
Office of the Cumberland County Register of Wills and lhe terms hereof shall
be legally binding upon each of them and their respective heirs. successors,
administrators and assigns;
(b) This Agreement shall be governed by nnd construed in
accordance with the laws of the Commonwealth of Pennsylvania;
(c) The pnrties herelo agree 10 executc such other or addilional
documents as may be necessary to effeeluale any covenants sel forth herein.
