Dear Mr. Rockey:
This firm provides counsel to the Register of Wills of Cumberland County. This letter
la Intanded to explain the basis for tha revocation of Letters of Administration in the Estata
of Robert K. Rockey, which were Issued to you May 23, 1995.
In the course of a routine review of filings, the Cumberland County Register of Wills
discovered that, In fact, Letters of Administration In the Estate of Charles R. Rockey had been
granted February 22, 1990, to William E. Hoffman, whose firm, Hoffman-Roth Funaral Home,
Inc. had provided funeral services for the decedent. Prior to the grant of letters to Mr.
Hoffman, notice had been given to Charles R. Rockey, the brother of the decedent, that If he
failed to apply for Letters of Administration within fourteen (14) days, Letters of
Administration would be granted to Mr. Hoffman. Mr, Hoffman, as Administrator of
decedent's estete, flied a stetus report dated December 4, 1990, Indicating that
admlnlatratlon of the estate was complete, and that asseta of the estate were sufficient only
to pay the cost of administration and funeral.
Since Mr. Hoffman was never discharged by the Orphans' Court as Administrator of
the decedent's estate, technically, his administration of the estate is still open. Therefore,
Letters of Administration technically could not be grantad to yourself, and It became
nacessary for the Regiater of Wills, upon dlacovery of the earliar grant of letters to Mr.
Hoffman, to revoke the Lettera of Administration which had been granted to yourself. At this
point, you simply need to return the Certificate of the grant of Letters of Administration which
you Issued, tog ather with any Short Certificates stili In your possession, to the Office of the
Raglster of Wills.

In tha evant that you wish to serve as Administrator In the decedent's estate, it may
be possible for you to obtain the resignation of Mr. Hoffman as Administrator, and for you to
then petition for a grant of Letter. of Administration for yourself, as the successor to Mr.
Hoffmsn.

Dear Donna:
Letters of Administration in the Estete of Robert K, Rockey, whose date of death was
November 10, 1988, were issued May 23, 1995, to Charles R, Rockey, Identified on the
Petition for Grent of Letters of Administration as tha decedent's nephew. One short
certificate was issued. The Petition Indiceted that decedent at death owned personal property
with en estimated value of $5,000. Upon a routine review of filings, it was discovered that
Letters of Administration in the estate of the same decedent had been granted February 22,
1990, to William E. Hoffman, whose firm had provided funeral services for the decedent.
In conjunction with the grant of letters to Mr. Hoffman, notice had been given to
Charles R. Rockey, brothar of the decedent, who had not taken out letters In the decedent's
estate. Mr. Hoffman's patltlon Indicated that the decedent had personal property valued et
$3,000. An Inheritance tax return wes filed by Mr. Hoffman, indicating that there was an
Insolvent estate and a report of status of administration wes filed by Mr. Hoffman. dated
December 4, 1990. Indicating that administration of the estate wes complete. and thet the
assets of the estate were sufficient only to pay the cost of administration and funeral. Mr.
Hoffman apparently did not file a formal account with the Orphans' Court, and did not seek
discharge under Section 3184 of the Probate. Estates and Flduclerles Code.
Because William E. Hoffmen wes never formally discharged as Administrator of the
decedent's estate, technically, lettars could not be subsequently granted to Charles R.
Rockey. It Is our opinion that the Letters of Administration granted May 23. 1995. to Charles
R, Rockey, should be ravoked. and that a notice regarding the revocation of letters should be
published.
