I, SARAH E. !<ANN, of R. D. 1, Newville, Cwnberland County,
Pennsylvania, being of sound mind, memory and disposition, do
hereby make, publish and declare this my Last Will and Testament,'
hereby revoking and maki~g void all wills by me at any time
heretofore made.
FIRST'. I order' and direct the payment of all my just debts and
funeral expenses as soon as may be convenient after my decease.
. SECOND. I give and bequeath all my personal belongings and
'household furnishings to ~ children, each to receive the items
which they gave me, and the balance to be disposed of by my
hereinafter named Executors.
THIRD. I direct my hereinafter named Executors to distribute the
balance of my estate, ,real, personal and mixed, whatsoever and
wheresoever situate among my children, share and share alike, and
the power to distribute in kind if such can be done equitably.
FOURTH. I nominate, constitute and appoint my son, RICHARD L.
KANN, and my daughter, SHIRLEY K. GRAHAM, or the survivor of

SUE ANN KANN, RICHARD L. KANN, and SHIRLEY K. GRAHAM
heirs of the Estate of
SARAH E. KANN
and
RICHARD L. KANN and SHIRLEY K. GRAHAM,
Co-Executors of the Estate
of SARAH E. KANN
WHEREAS, SARAH E. KANN, late of Penn Township, Cumberland County,
Pennsylvania, died on May 2, 1995; and
WHEREAS, the Last Will and Testament of SARAH E. KANN dated
December 31, 1971 was probated on June 5, 1995; and
WHEREAS, Letters Testamentary were granted to RICHARD L. KANN and
SHIRLEY K. GRAHAM on June 5, 1995; and
WHEREAS, at least 4 months has elapsed since the first
advertisement regarding grant of letters testamentary; and
WHEREAS, the said Co-Executors have gathered the assets of the
estate of the decedent consisting of both real property and
personal property, for a total value of $ 76,247.60 as more fully
set forth herein, which is a statement of account of the said Co-
Executors;
WHEREAS, the debts and deductions, including the
inheritance tax in the said estate, is $ 20,871.20,
balance for distribution of $ 55,376.40, more fully
herein;

GRAHAM, in consideration of the above and intending to be legally
bound hereby, do hereby acknowledge that we have this day
received from the said Co-Executors, in full satisfaction and

payment of all sum or sums of money, legacies, bequests and
devises as are stated under said last will and testament, the
assets listed in the schedule of distribution, and does hereby
bind themseives to the Accounting and Schedule of Distribution
attached hereto and do release the said Co-Executors, RICHARD L.
KANN and SHIRLEY K, GRAHAM from any further liability,
AND, we do hereby stipulate that in order to avoid the expense
and time involved in the filing of a formal account and schedule
of distribution, we consent to distribution being made without
the fillng of an account and schedule of distribution, the same
to be with the same force and effect as if they had been filed
and confirmed by the Orphan's Court Division of the Court of
Cumberland County, Pennsylvania.
THEREFORE, we do hereby remise, release, quitclaim and forever
discharge the said Co-Executors of and from the said estate and
from all actions suits, payments, accounts, reckonings, claims,
and demands whatsoever for or by reason thereof, or for any other
use, matter, cause or thing whatsoever, touching upon the estate
of the said decedent, and we do further hereby covenant and agree
that should any liability come due to the estate of the said
decedent after the signing of this agreement, we hereby covenant
and agree with each other and the aforesaid personal represent-
ative, that we will contribute pro-rata our share of the estate
to satisfy any and all claims, demands, suits, or causes of
action which may be successfully prosecuted against the said
estate or the aforesaid personal representative after the
signing, sealing and delivery of this family settlement agreement
and final release,
