LAST WILL AND TESTAMENT OF
ERNEST CARMEN DIVINCENZO, JR.
I, Ernest Carmen Divincenzo, Jr., of 60 Old Federal Road, Camp Hill,
Cumberland County, Pennsylvania, being of sound and disposing mind, memory
and understanding, do hereby make and declare thia as and for my last will
and testament and revoke nIl wills nnd codicils heretofore mnde by me.
FIRST
I direct the payment of my debts and expenses of my last illness and
funeral from my ostate as soon after my denth as conveniently may be done.
If none of the four cemetery lots that I presently own at the Resurrection
Cemetery, are owned by me at the time of death, and thus not available for
my interment, 1 authorize my personal representative to purchase such a
cemetery lot with a contract for perpetual care, using therefor funda from
my estate in such amount as my personal representative shall consider
necessary and desirable.
I also authorize my personal representative to expend funds from my
estate for the purchase, erection and inscription of a marker for my grave.
My preference as to type and atyle of marker is indicated on materials which
are in my safe deposit box.
SECOND
I give, devise and bequeath certain items of my personal property unto
certain of ,my godchildren and other persons as specified in a letter which
is in my safe deposit box.
THIRD
I give, devise and bequeath nIl the reat, residue and remainder of
my est.ate to my beloved wife, Debornh, if she survives me by thirty (30)
daya. In the event she fails to survive me by thirty (30) days, I give,
devise and bequeath all the rest, residue and remainder of my estate unto
such of my children as shall survive me. per stirpes.

consideration of the petition filed by the Petitioner, Deborah A.
Divincenzo, seeking a review of the Board of Appeals decision

PETITION FOR REVIEW OF
DECISION OF DEPARTMENT OF REVENUE
NOW COMES, the Petitioner, DEBORAH A. DIVINCENZO, by
and through her attorneys, Ricci & Taneff, and files this
Petition pursuant to ~ 2186 of the Tax Reform Code ("TRC") for a
review of the decision of the Board of Appeals denying the
Petitioner's protest of the Department of Revenue's appraisement
and assessment. In support of her Petition, the Petitioner
states as follows:
1. Petitioner, DEBORAH A. DIVINCENZO, is an adult
individual, residing at 60 Old Federal Road, Camp Hill,
Cumberland County, PA 17011.
2. On June 29, 1995, Letters Testamentary were issued
to the Petitioner by the Cumberland County Register of Wills for
the purpose of administering her late husband Ernest C,
Divincenzo's estate. (A copy of the Letters are attached hereto
and made a part hereof as Exhibit-A.)
3. On or about August 27, 1997, the Petitioner filed
an insolvent Inheritance Tax Return on her late husband's estate.
(A copy of the Return is attached hereto and made a part hereof
as Exhibit-B.)

4. On or about January 5, 1998, the Department of
Revenue changed the Return and the Petitioner was assessed a tax
of $3,199.32 based upon the contents of a safe deposit box
containing cash in the amount of $53,322.00, (A copy of the
Department's assessment is attached hereto and made a part hereof
as Exhibit-C.)
5. On or about February 25, 1998, a protest of the
assessment was filed with the Department of Revenue and the
protest was subsequently assigned to the Board of Appeals for
review. (A copy of the Department r s acknowledgment of protest
and assignment is attached hereto and made a part hereof as
ExhJbit-D.)
6. On March 24, 1998. the Petitioner was advised that
her protest was assigned to Donna Aument of the Board of Appeals
for review and disposition. (A copy of said notice is attached
hereto and made a part hereof as Exhibit-E.)
7. On or about April 26, 1999, Petitioner received a
copy of the Board of Appeals decision dated May 7, 1998 denying
her protest. (A copy of said notice is attached hereto and made
a part hereof as Exhibit-F.)
8. At all relevant times, the Petitioner had no
knowledge of the Board's decision of May 7, 1998. Moreover, the
Petitioner has no recollection of having received notice of the
Board's decision until the decision was made known to her under
cover of the Board's letter of April 24, 1999.
9. The Board of Appeals decision denying the
Petitioner's protest is incorrect because the assets which the
Department of Revenue seeks to tax was not the property of the

decedent and, theref,ore is not taxable to the estate or the
Petitioner. On the contrary, the contents of the safe deposit
box were at all times the propsrty of the decedent's parents.
WHEREFORE, the Petitioner respectfully requests that
this Honorable Court set this matter for hearing and that the
Board of Appeals decision be vacated and set aBide.

DECISION AND ORDER
On March 9, 1998, the Bureau of Individual Taxes forwarded Petitioner's letter of
February 25, 1998, to the Board of Appeals to be treated as a protest to the
appraisement and assessment Issued January 5, 1998. In that appraisement and
asseSlIment, the Department determined that the $53,322 cash In Dauphin Deposit
safe deposit box #231, registered In the names of Nicolette F. Divincenzo or Ernest C.
Divincenzo, Jr., was fully taxable In the decedent's estate because "There was no
Indication that this money was Nlcolotte F. Divincenzo's money only" as alleged in the
return. Petitioner's letter states that "only 50% of this Joint asset would be taxable".
On March 24, 1998, the Board requested Petitioner to furnish a statement
regarding the ownership of the cash, proof of that ownership and the reason the cash
was placed in the safe deposit box. Petitioner has not responded to the Board's

request arid has, therefore, failed to meet the burden of proof that the Department's
appraisement and assessment was erroneous.
Accordingly, It Is hereby, Ordered that the protest Is denied,

DECISION AND ORDER
On March 9, 1998, the Bureau of Individual Taxes forwarded Petitioner's letter of
February 25, 1998, to the Board of Appeals to be treated as a protest to the
appraisement and assessment Issued January 5, 1998. In that appraisement and
assessment, the Department determined that the $53,322 cash In Dauphin Deposit
safe deposit box #231, registered Ir, the names of Nicolette F. Divincenzo or Ernest C,
Divincenzo, Jr., was fully taxable In the decedent's estate because "There was no
Indication that this money was Nicolette F. Divincenzo's money only" as alleged In the
return. Petitioner's letter states that "only 50% of this joint asset would be taxable".
On March 24,1098, the Board requested Petitioner to furnish a statement
regarding the ownership of the cash, proof of that ownership and the reason the cash
was placed in the safe deposit box. Petitioner has not responded to the Board's
