I, KATIIRYN A. CONNER, a resident of New Cumberland, Cumberland County,
ennaylvania being of sound mind and memory, do make, publish and
eclare this to be my Last Will and Testament, hereby revoking all Wills
snd Codicils heretofore made by me.
ITEM 1.
I direct that sll of mll just debts, mll funeral
expanses including a euitable monument at my grave and the cost of
administration of my estate be paid as soon as practicable after my
death. 1 direct that my Personal Representative payout of my estate,
as a general charge thereon, all inheritance, estate. succession and
other taxes together with any interest or penalty thereon assessed by
reason of my death with regard to all properties and assets subject to
such tsxes, whether or not such property and sssets pass under this
ill.
ITEH II, I give. devise and bequeath to HARLAN E. KLINE, the right
of possession of my house, all furnish inns and lot situate at 210 11 Street.
New Cumberland, Cumberland County, Pennaylvanin. so long as he occupies same
as his personal residence, pays the property taxes. sewer, trash and keeps
the house insured for fire nnd storm loss at a fair market value of the
property with the insured being my Estate.and at such time that he no longer
personally occupies the said premises as his personal residence and pays said
bills or at the time of his death. whichever shall first occur, ,this right
of possession shall terminate.

to execute, acknowledge and deliver instruments of conveyance. including

any such loan by pledge or mortgage of all or any part of my property
and to execute the necesssry instruments to csrry out such powers; to
distribute my estate in kind or partly in money or partly in kind, and
to determine the fair value at which any property so distributed in kind
ahsll be received by the distributees; to conduct any business in which
I have an interest at the time of my decease. for such period as my
personal representative may deem proper, power to borrow money and
pledge assets of the business and the power to do all other scts that I,
in my lifetime could hsve done, to delegate such power to any partner,
manager or employee without liability for any loss occurring therein and
to organize a corporation to carryon said business as cspital to such
corporation and accept stock in the corporation in lieu thereof and hold
such stock for the uses of this my Will, and to vote said stock or to
sell the same as to my personal representative msy seem best; to retain
all stocks, assets. bonds and investments owned by me without being
confined to what is known as legal investments; to execute any options
to purchase, to apply for stocks, bonds or other investments, to purchase
or otherwiee acquire real estate and to execute the same powers thereover
aa hereinbefore provided; to retain indefinitely any part of my assets,

RE: Kathryn A. Conner Estate
Dear Frances,
Kathryn's will bequeathed $10,000.00 to Ward Davis, who
predeceased Kathryn and was a nephew of her husband.
I have done research on the legal question as to whether or
not this bequest has lapsed because he predeceased Kathryn Conner
and therefore does not go to his children but becomes a part of the
residue of the Estate.
Pa. Statute P.L.50B, No. 164 Section 2, effective July 1,
1972, 20 P.S.2514 sub paragraph (9) provides as follows:
Lapsed and void devises and legacies; substitution of issue.
A devise or bequest to a child or other issue of the testator
or to his brother or sister or to a child of his brother or
sister whether designated by name or as one of a class shall
not lapse if the beneficiary shall fail to survive the
testator and shall leave issue surviving the testator but
shall pass to such surviving issue who shall take per stirpes
the share which their deceased ancestor would have taken had
he survived the testator: Provided, that such a devise of
bequest to a brother or sister to the child of a brother or
sister shall lapse to the extent to which it will pass to
the testator's spouse or issue as a part of the residuary
estate or under the intestate laws.
This act states that a bequest to a child of her brother or
sister does not lapse but goes to the issue of the nephew living.
I have not been able to find any law that this applies to those
beyond blood relatives to decedent as compared to relatives by
marriage. I am sending a copy of this letter to Mrs. Ward Davis
so that she has the opportunity to have this legal question
researched by an attorney of her choice. Until I am advised of a
different legal opinion with legal references I have to advise you
that the gift to Ward Davis lapsed and does not go to his children.
