LAST WILL AND TESTAMENT
I, HELEN E. EBERLY, of the Township of upper Allen, County
of Cumberland, and Commonwealth of Pennsylvania, being of sound
and disposing mind, memory and understanding, do make, publish
and declare this as and for my Last Will and Testament, hereby
revoking and making void all former wills and codicils by me at
any time heretofore made.
FIRST. I order and direct that all my just debts and
funeral expenses be paid by my Executor, hereinafter named, as
soon as conveniently may be done after my decease.
SECOND. I give and bequeath my fur jacket unto my
daughter-in-law, namely, DILYS EBERLY, absolutely,
THIRD, I give and bequeath my Avon plate collection unto
my granddaughter, namely, DEBORAH RIDER, abaolutely.

FOURTH. I own a collection of fine jewelry which I desire
be distributed unto my daughters-in-law, granddaughter,
granddaughters-in-law and great-granddaughters. Since I may
make inter vivos gifts or otherwise dispose of some articles of
jewelry during my lifetime, I may make a list of such articles
and the persons to whom said items should be distributed, which
list mayor may not be dated and will certainly post-date the
date of this, my Last will and Testament. Based upon the
foregoing background, I hereby give and bequeath to the
individually named persons the article or articles of jewelry as
set forth on any such list which may be found herewith.
In the event that I have made no such list, I order
and direct my Executor, hereinafter named, to distribute my

jewelry in as nearly equal proportions in value among my several
daughters-in-law, granddaughter,granddaughters-in-law and
great-granddaughters living at the time of my death. In making
such distribution, I order and direct my said Executor to cause
an appraisal of said jewelry to be made and then to permit the
beneficiaries to express their preferences for individual
articles, such preferencea to be stated in the order of their
class of relationship and chronological age beginning with my
daughters-in-law. such preferences shall not be binding upon
the Executor but shall be used to assist him/it in making the
distribution aforesaid.
FIFTH. I give, devise and bequeath all the rest, residue
and remainder of my Eatate, real, personal and mixed, whatsoever
and wheresoever situated, unto my huaband, namely, RUSSELL S.
EBERLY, absolutely and in fee simple. if he aurvivea me by as
many as sixty (60) days,
SIXTH, If my said huaband. RUSSELL S. EBERLY, doea not
survive me by aa many aa sixty (60) days, then and in that
ultimate event, I order and direct that the residue of my Estate
be distributed and disposed of as follows:
A. I give and bequeath a sum of money equal to
five per centum (5%) of the net value of my residuary
estate unto TRINDLE SPRING LUTHERAN CHURCH at
Mechanicsburg, PA, absolutely,
B, I give, devise and bequeath all the rest,
residue and remainder of my Eatate, real, peraonal
and mixed, whatsoever and wheresoever situated, in
equal shares unto my two (2) sons, namely, MARLIN E.
EBERLY and RICHARD J. EBERLY, share and share alike,

absolutely and in fee simple.
If either of my said sons shall predecease
me, I order and direct the foregoing share of such
deceased son shall be distributed unto his issue per
stirpes by representation and not per capita.
LASTLY. I nominate, constitute and appoint my son, namely,
RICHARD J. EBERLY, to be the Executor of this, my Last will and
Testament, to serve without bond or other security as a
condition of qualification hereunder, but if for any reason he
should fail to qualify as my Executor or cease ao to serve, then
and in that event, I nominate, constitute and appoint THE FIRST
BANK AND TRUST COMPANY OF MECHANICSBURG, PA., (or its successor
by merger, consolidation or other corporate reorganization) to
be the Executor hereof.
IN WITNESS WHEREOF, I, HELEN E. EBERLY, have hereunto set
my hand and seal to this, my Last Will and Testament which
consists of three (3) typewritten pages to each of which I have
affixed my signature this 3rd day of January A.D., One Thousand
Nine Hundred Ninety-one (1991).
