PRELIMINARY DECREE FOR GUARDIANS
AND NOW, this -1# day Of(),1 J,-, . 199-5-. to judicially resolve petllloner's request for
the appolntmem of guardians, the court does ~ER AND DECREE the following:
I. The Court hearing on the allached pelltlon Is scheduled for the ,!;(t;fA day Of~

courtroom NO. ~, located In the Cumberland County Courthouse In Carlisle, Pennsylvania.
2. The court directs the issuance of an appropriate citation with rule to show cause why the above-
captioned Individual should not be adjudged an Incapacitated person nod why the court should not appoint appropriate
guardians.
3. Petitioner shall cause to be served by personal service the citation and petition with allached nollce
upon the alleged Incapacitated person at lensttwenty (20) days prior to Ihe court hearing. The contems and terms
of the petition nod the notice shall be explained to the maximum extent possible in language and terms the allcged
incapacitated person Is most likely to understaad. An affidavit of service shall be filed before the hearing or offered
as an exhibit at the beginning of the court hearing.
4. Atlenst ~ UO days nOllce of the pelltion nod hearing shall be given by personal service
or certified mall to all persons residing In the Commonwealth who are sui juris and would be entitled to share In
the estate of the alleged ineapacltated person's estate if she died Imestate.
S. Petitioner shall nollfy the court, In writing, at least seven (7) days prior to the court hearing If
counsel has NOT been retained by or on behalf of the alleged Incapacitated person. This nollce shall also contain
all pertinent informallon which Indicates whether or not counsel should be appointed to represem the alleged
Incapacitated person.
6. The alleged Incapacitated person shall be present at the court hearing unless It Is established that
her physical or menial condition would be harmed by her presence, or It Is Impossible for her to be present because
of her absence from the Commonwealth.

PETITION FOR ADJUDICATION OF INCAPACITY
AND APPOINTMENT OF PLENARY GUARDIAN
OF THE ESTATE AND PERSON IN ACCORDANCE WITH
20 PA.C.S. ~ 5511
TO THE HONORABLE, THE JUDGES OF SAID COURT:
I. Petitioner is the granddaughter of Harriet Garber (the "alleged incapacitated
person"). Petitioner is already a de facto guardian of the person of her grandmother, who is in
a nursing home. She brings this petition primarily to be able take action to get another relative
to use the grandmother's money for her care and to deal with the real estate.
2. The alleged incapacitated person was born on November 6, 1907, is 88 years of
age and widowed, and resides at Thornwald Home, 442 Walnut Bottom Road, Carlisle,
Cumberland County, Pennsylvania 17013.
3. The following persons are to the best of petitioner's knowledge, information and
belief the only living next-of-kin of the alleged incapacitated person: Gary Garber and petitioner,
Sally Garber, both grandchildren. The alleged incapacitated person's children are deceased.
4. The name and address of the institution providing residential services for the
alleged incapacitated person is Thornwald Home.
5. To the extent known by petitioner, the assets of the alleged incapacitated person
are valued at between $27,869 and $40,869, comprising the following: a checking account with
$1,369 in it; a burial trust with $4,500; an account in the alleged incapacitated person's name
jointly with that of a nephew, Nathan Garber, with between $17,000 and $23,000 in it; and a
personal residence in Barnesville, Schuylkill County, Pennsylvania, valued at between $5,000
and $20,000. The alleged incapacitated person also owes the Thornwald Home about $14,000
for her care, due to Nathan Garber's refusal to use the funds under his control for the care of
the alleged incapacitated person. Thus, her net estate is between $13,S69 and $26,S69.
6. Petitioner estimates the alleged incapacitated person's annual income to be $7,OSO,
including current monthly Social Security benefits $275 and a Railroad Retirement Board pension
of $314.96 monthly.
7. The alleged incapacitated person was not a member of the armed services of the
United States and is not receiving benefits from the United States Veterans' Administration.
S. The alleged incapacitated person suffers from Alzheimer's disease, which has been
diagnosed by a CAT-scan, and degenerative arthritis. She also has several other problems
associated with aging, such a difficulty swallowing, incontinence, and bad eyesight and hearing.
9. Because of her mental and/or physical condition, the alleged incapacitated person
is totally unable to manage her financial affairs, property and business and to make and
communicate responsible decisions relating thereto, including the ability to communicate her
need for assistance in these areas.
10. Because of her impaired mental and/or physical condition, the alleged
incapacitated person lacks the capacity to make or communicate responsible decisions concerning
her person and is unable to walk, cannot see very well, cannot hear very well, must have a
special diet due to a tendency to choke, and is incontinent.
11. The following alternatives to the appointment of a guardian of the estate have been
considered: fussing at Nathan Garber to pay the nursing home bills from the funds over which

he has control without an Incapacity finding, but these alternatives are ineffective for the
following reasons: Nathan Garber will not coopemte.
12. The severity of the alleged incapacitated person's mental and/or physical condition
and the lack of viable, less restrictive alternatives necessitate that a plenary guardian of her
estate be appointed to manage and handle all aspects of the alleged incapacitated person's estate,
specIfically Including, but not limited to: all issues relating to her cash, checks, and any bank
or savings accounts held in her name, her stocks and bonds, her personal property, her real
estate, her life and other insurance of which she is a beneficiary, her entitlement to any
governmental and non-governmental benefit plans, federal, state, and local taxes, claims made
or to be made on behalf of her or against her, the execution of documents, entry into contmcts
affecting her and the payment of reasonable compensation or costs to provide services for her.
13. The following alternatives to the appointment of a guardian of the person have
been considered: initially, care in petitioner's home, which proved impossible, but these
alternatives are ineffective for the following reasons: it was economically infeasible to care for
the alleged incapacitated person in petitioner's home.
14. The severity of the alleged Incapacitated person's mental and/or physical condition
and the lack of viable, less restrictiVfl alternatives necessitate that a plenary guardian of her
person be appointed to handle all Issues relating to the person of the alleged incapacitated
person, specifically including, but not limited to: her living arrangements; her medical and
psychiatric care, the administration of medication to her, and the employment and discharge of
physician, psychiatrists, dentists, nurses, therapists and other professionals for her physical and
mental treatment and care.

IS. Petitioner has the alleged Incapacitated person's power of allomey. Petitioner is
not aware that the alleged incapacitated person signed any other powers of allorney or advance
health care directives or in any other way designated anyone to serve as her agent over any of
her personal or financial affairs or as her surrogate over hermedical care, or that she designated
in writing her wishes with regard to health care, including the use or refusal of life-sustaining
treatment.
16. The proposed plenary guardian of the person of the alleged incapacitated person
is petitioner, Sally Garber, a granddaughter of the alleged incapacitated person, who resides at
620S Elmer Avenue, Harrisburg, PA 17\12.
17. The proposed plenary guardian of the person is 46 years of age and is employed
as a Registered Nurse.
IS. The proposed plenary guardian of the estate of the alleged incapacitated person
is petitioner, Sally Garber, a granddaughter of the alleged incapacitated person, who resides at
620S Elmer Avenue, Harrisburg, PA 17112.
19. The proposed plenary guardian of the estate is 46 years of age and is employed
as a Register Nurse.
20. The proposed plenary guardians have no interest adverse to the alleged
incapacitated person.
21. The consents of the proposed plenary guardians are attached as Exhibits "A" and
"B".
22. No other court has ever assumed jurisdiction in any proceeding to determine the
capacity of the alleged incapacitated person.

being of the opinion that $12,500 is a better price than can be obtained at public sale and that
the sale is in the best interest of the incapacitated person, and all parties in interest having joined
in the presentation of the petition, Sally Garber, Plenary Guardian of the Estate of Harriet
Garber, an incapacitated person, is authorized to sell the premises at Barnesville, Schuylklll
County, Pennsylvania, as more particularly described in Exhibit A to petitioner's petition, to
Gary Garber for $12,500, and upon receipt of same to make, execute and deliver a deed to Gary
Garber, his heirs and assigns, for said property.

PETITION FOR PERMISSION TO SELL REAL ESTATE
AT PRIVATE SALE IN ACCORDANCE WITH
20 PA.C.S. ~ 5511
TO THE HONORABLE EDGAR B. BAYLEY:
Petitioner, Sally Garber, guardian of the estate of Harriet Garber, an incapacitated
person, represents that:
I. Harriet Garber was adjudged incapacitated after a hearing by this Court on August
28, 1995.
2. Petitioner, a granddaughter, was appointed plenary guardian of the incapacitated
person's estate.
3. The incapacited person lived in her residence in a rural area of Barnesville,
Schuylkill County, Pennsylvania, until last year; she is now a patient at the Thornwald Home,
442 Walnut BoUom Road, Carlisle, Cumberland County, Pennsylvania 17013.
4. The incapacitated person is 88 years of age and suffers from Alzheimer's disease
and degenerative arthritis. She also has several other problems associated with aging, such a
difficulty swallowing, incontinence, and bad eyesight and hearing. Because of all these
problems, her condition is deteriorating, and she is never expected to return to her Barnesville
residence or to be released from the Thomwald Home.
5. The incapacitated person acquired title to her Barnesville residence from a relative

with her then husband on June 12, 1926. Her husband has since died. A copy of the deed Is
attached as Exhibit A.
6. Petitioner obtained an appraisal of the Bamesville property from a certified
appraiser. This Is aUached as Exhibit B.
7. The value of the real estate to be sold, according to the appraisal (Exhibit B) Is
$12,500.
8. The incapacitated person has no creditors other than the nursing home, where her
care costs about $3,000 per month. Her other assets have been exhausted. In particular, cenain
moneys held in a joint account with a nephew have been demanded of him by the guardian. He
has paid half of said moneys over to the estate and furnished copies of bankbooks to account for
the balances. Because the Medicaid and nursing home authorities have indicated that they do
not care if the guardian pursues the remaining half, insofaras it affects the incapacitated person's
eventual eligibility for Medicaid, the plenary guardian has not instituted legal action to obtain
the other hal f.
9. It is necessary that the property be sold since it produces no income and cannot
be insured with no one living in It. It costs money just to minimally maintain it.
10. The incapacitated person's annual income is $7,080, Including current monthly
Social Security benefits $275 and a Railroad Retirement Board pension of $314.96 monthly.
Thus, her income is not sufficient to pay for her maintenance at the Thornwald Home. She will
be eligible for Medicaid, however, once her assets are exhausted.
II. Petitioner is not authorized to sell the real estate except by order of Court.
12. The Court waived surety.

13. Petitioner has possession of the incapacitated person's will. It names petitioner
as her sole beneficiary. A copy of the will is attached hereto as Exhibit C.
14. The incapacitated person's living next-of-kin are Gary Garber, who is the
proposed purchaser, and petitioner, Sally Garber, both grandchildren. The alleged incapacitated
person's children and husband are deceased.
15. The proposed purchaser is Gary Garber, a grandson, who resides at Box 22,
Chesapeak Mobile Estates, Hanover MD 21076.
16. The proposed purchaser has offered to buy the Barnesville house at its appraised
value. See Exhibit D, attached hereto.
17. Since the proposed purchaser is a grandson, there would be no transfer tax and
the only costs of sale would be the cost of deed preparation. The incapacitated person's estate
would therefore receive practically the full appraised value.
18. Petitioner offered to sell the Barnesville home to a nephew of the incapacitated
person, who had once expressed an interest in it, at its appraised value, but he declined to make
an offer at that or any higher price.
19. Given the value involved, petitioner does not see any point to trying to sell
through a realtor or at auction, which could easily net less money for the estate.
WHEREFORE, petitioner requests that this Honorable Court enter an order authorizing
the sale of the incapacitated person's Barnesville home to Gary Garber for $12,500 and that the
Court require no additional security.

Dear Judge Bailey:
I am counsel to the petitioner in the above incapacitated
person's matter. I am writing pursuant to the rules to furnish
notice that the alleged incapacitated person does not to my
knowledge have counsel.
I am also confirming in writing arrangements made with your
telephone approval to have Dr. Branscomb testify by phone at 11:15
a.m. on August 28. (The hearing is scheduled for 11:00 a.m.) Dr,
Branscomb will explain why Mrs. Garber cannot be physically present
due to senile dementia as well as providing the testimony as to the
degree of her incapacity.
To furnish the court such guidance as I can as to whether
counsel should be appointed for the alleged incapacitated person,
I should explain the context briefly. The petitioner is a
granddaughter who has been caring for Mrs. Garber under a power of
attorney. She and her brother, who supports the petition, are the
only next of kin. There was no real need for an incapacitated
perDon's estate until a cousin, who has some of Mrs. Garber's funds
in a joint account, refused to apply them to Mrs. Garber's care.
The underlying purpose of the proceeding iD to marshal Mrs.
Garber's remaining assets to provide for her continuing care in the
Thornwald home. Until those assets are used up, she cannot go on
Medicaid.

suffering from non-reversible senile dementia Alzheimer's type.
2, Harriet Garber is a resident of the Thornwald
Nursing Home in Carlisle and in need of total care to manage her
affairs and activities,
3, Harriet Garber's intestate heirs are her
grandchildren. petitioner. SallY Garber. and Gary Garber,
4, Harriet Garber's estate consists of a bungalow
worth about $12.500.00. a burial trust worth $4.500,00. about
$1.300.00 in a checking account. and her interest in Joint
assets that she set UP in an account with her nephew. Nathan
Garber,
5, The amount now owed to the Thornwald Nursing Home
is approximately $17.000,00. and the monthlY expenses are about
$3.000.00 a month,
