AN ENDED OBJECTION TO FIRST AND FINAL ACCOUNT
PROPOSED DISTRIBUTIONS OF BARBARA JEAN MAGILL, EXECUTRIX
AND NOW, this 16th.day of July, 1996, comes catherine Waltz,
pro se, who objects to the First and Final Account (F&FA) and
Proposed Distributions of Barbara Jean Magill, Executrix, as
prepared and filed by Attorney H. Joseph Hepford, Esq., and who
avers the following:
1 thru 7 of the Objection to IF&FA) Proposed Distributions of
Barbara Jean Magill, Executrix, filed June 14, 1996 are hereby
incorporated as if fully set forth herein and attached hereto as
Exhibit 1.
a. It is believed and averred that the house located at
5124 Erbs Bridge Road was appraised at $80,000.00 and sold for
$6,000.00 less than the appraised value, therefore, the sale price
difference from the appraisal price should be paid by Barbara,
Executr.ix, into the general distribution.
The heirs should not pay for the Executrix's or Attorney's
mishandling of the estate.
Wherefore, Objector respectfully requests that this honorable
court determine and correct inaccuracies and missing factual data
relative to the F&FA, correct the inequities alleged therein,
revise the distributions in accord with a corrected F&FA, assess
any additional costs against attorney and executrix commissions
and provide any other remedy available deemed to be equitable and
fair to the beneficiaries named within the F&FA.

AND NOW, this 14th. day of Junc,1996, comcs Catherine
Waltz, pro se, who objects to the First and Final Account (F&FA) and
Proposed Distributions of Barbara Jean Magill, Executrix as
prepared and filed by Attorney H. Joseph Hepford, Esq. and who
avers the following:
1. Catherine Waltz is the sister of decedent, Anthony J. Kiren,
and resides at 3834 Brisban Street, Harrisburg, pA, 17111
2. catherine Waltz is a named beneficiary at page 12 of the
F&FA.
3. The F&FA fails to indicate any amount of insurance money
and that "all insurance money...' was used for funeral
expenses. (See Page III of holographic will attached hereto
and marked EXHIBIT No.1)
4. The F&FA fails to identify and list amount of money discovered
in deccdent's wallet, amount of moncy rcimburscd co estate
from Rohrer bus ticket to Atlantic City, N.J., valuation of
voluminous number of coins and currency removed from the
safe at decedents rcal property and providcd co the carc and
custody of Barbara Jean Magill.
5. The Last will and Testament of decedent at pg 3 and 4 bequeaths
money in both Mellon Bank and Pennsylvania Credit Union
accounts to deccdents niece, Barbara Jean Magill and directs
that niece Barbara Jean Magill "pay all the bills". The F&FA
improperly paid all bills from the residual estate I the
decedent intended that all bills be paid from the Mellon
Bank and pennsylvania Credit Union accounts. (EXHIBIT No 1)

6. The F&FA improperly paid inheritence tax for $23,033.26
baqueathed to Barbara Jean Magill from the residuary eatate.
7, Is believed and therefore averred that Lea W. Lawson,
George Steltzer III, Tammy Lin Steltzer, Amber May
HendriCkson and Pamela HendriCkson, beneficieries listed
in the F&FA , were or are Commonuealth of PA welfare
recipients and therefore, any distribution to the aforesaid
or on their behalf shoUld be directed to the proper
Commonwealth Agency.
Wherefore, Objector respectfully requests that this honorable
court determine and correct innaccuracies and missing factual
data relative to the F&FA, ,correct the inequities alleged
therein, revise the distribution in accord with a corrected F&FA,
assess any additional costs against attorney and executrix
commissions and provide any other remedy available deemad to be
equitable and fair to the beneficiaries named within the F&FA.

AND NOW, this 29nd day of August, 1996, following receipt of the Estate's TrIaI Brief and the
Objector's TrIaI Brief, the following Order Is entered:
1. It appearing that the Objector, Catherine Waltz, has retained coWl8el, speelficaJly John
J. McNally, ill, Esquire, who has eonununlcated with the Auditor In reference to objections previously med
pro se by Ms. Waltz and It further appearing that Mr. McNo!ly has reached an Agreement with the
Estate's attorney, H. Joseph Hepford, Esquire, regarding the disposition of objections, all objections to the
First and Final Accounting previously med by Catherine Waltz, pro se, are deemed withdrawn except for
the objection as to the Executrix's segregation of her inheritance from the balance of the Estate used to
pay bills and inheritance tax.
2. The sole remaining objection, appearing to be a legal Issue, wlII be decided by the Auditor
without the need for testimony or the production or a record.
3. Both the Estate and the Objector may, If they desire, within ten days of this Order, me
additional and supplemental legal reasons for case authority with the Auditor In support of their position.
. 4. Thereafter, the Auditor shall determine the Issue and me an opinion as provided by law.

AUDITOR'S REPORT
1. The undersigned Auditor was appointed by the Court pursuant to Cumberland County
Orphan's Court Rule 8.1-1, et seq., on June 19, 1996.
2. The Auditor convened a Pre-Hearing Conference which was held at his offices in CarliB1e,
Pennsylvania on July 22, 1996. H. Joseph Hepford, Esquire, appeared for the Estate and Catherine Waltz,
pro se, appeared as the sole Objector.
3. At the Pre- Hearing Conference, the Issuea were narrowed, certain objections were
withdrawn, and the Estate admitted fmding certain additional Items of property which would be Included
in an amended First and Final Account. The matter was thereafter scheduled for trial on Friday, August
30, 1996 and both sides were required to provide a Brief on the remaining Issues prior to trial.
4. FoUowlng the Pre-Hearing Conference, and prior to the time scheduled for trial, the
Objector, Catherine Waltz, obtained counsel in the form of the Law Offices of James, Smith & Durkin
through the person of John J. McNally, III, Esquire.
6. On August 29, 1996, Mr. McNally, now representing the Objector, by letter, informed the
Auditor that all objections raised by the Objector were deemed to be withdrawn except for objection
nwnber 5 concerning the payment of bills and taxes from the residuary Estate as opposed to from the
bequest to the Executrix, Barbara Jean Mngill.
6. FoUowlngrecelpt of this Notice ofWlthdrawa1 of Objections and receipt ofTria1 Briefs from
both the Estate and the Objector, by Order, the Auditor provided an additional opportunity to both parties
to me within ten days of the Order of August 29, 1996 additional and supplemental legal reasons for their
respective positions. Neither side med any additional or supplemental reasons.:
7. The record, having been closed and no testimony being necessary, the Auditor will now
resolve the fmal objection in this report.

Is no residuary clause in this Will, the Estate argues that the residue will palI8 under intestacy laws and
intestate beneficiaries must bear the enUre cost of the odminlstroUon of the Estate.
Under the statutory scheme ror payment or loxes and eosle of adminlstrsUon, found ot 72 P.S. A
9144, the Legislature determined that 'in the obsenee or s contrary intent appearing in the WiU,
Inherlt.anee lox on trOl18fers of property and transfers of property made by specific devise or otherwise and
which Is not part or the residuary Eslete, shall be paid out of the residuary Estate and charged in the same
manner as generol administration expense of the Estate.' Thus, under the statutory scheme, unless the
Testator expressed a specific intenUon that his niece and Executrix, Barbara Jean Mngi1I, was to obsorb
the eosle and loxes out of her specific bequest, the residuary Estate must bear all cosle and expenses
including loxes under the provisions of this Wiu and the Statute.
In Re: Woolett's Estate 337 A.2d 837. (1975) the Supreme Court reiterated lle long st.anding
principal that in all cases the test must be the Testator's intent to dispose of a residue. In Woolett. the
Tes!.ator made 0 specific devise of reol es!.ate to a brother and thereafter provided the residue of the
Estate to one Jean Gardner. Gardner appeoled the imposition of costs and taxes on the residue passing
to her requesting that the specific devisee brother bear pro-rata share of loxes and expenses. ThIs, the
Supreme Court, determined, was not required. 'Since the Tes!.ator's Wiu Is completely silent with respect
to the manner in which loxes and expenses be paid, Appellant is 0 generol residuary legatee, she must bear
the contested costs' Id ot 839. Similarly, in the inst.ant Wiu, the Tes!.ator made a specific bequest of two
idenUrl8ble bonk necounle to Barbaro Jean Mngi1I. There does not appear to be any further specific,
Identlrl8ble intent on the part of the Tes!.ator to reduce this gin or to require that its donee be required
to pay any pro-rata share of costs or loxes out oClhe some. The sentence 'all Insurance money and money
from the Es!.ate to be used for modest funeral expenses and a stone marker and that all the bills be paid
by me niece, Barbara Jean MogIll', refers merely to odditlonal powers to be exercised by Magill in her
capacity as executrix. See oIso Es!.ate or Stewart. 473 A.2d 572 (1984) where the Pennsylvania Superior
Court, in opplylng Tes!.ator's intent, found that generollanguage allowing the executrix to ohandle my
Es!.ate as she sees fit' gave her a general power or appointment over the residue of the Estate.
Furthermore, the Court determined that Ihls was more than n word or administration but, in fact, was a

3. The F&FA fails to indicate any amount of insurance money
and that "all insurance money...' was used for funeral

4. The F&FA fails to identify and list amount of money discovered
in decedent's wallet, amounc of money reimbursed co estate
from Rohrer bus ticket to Atlantic City, N.J., valuation of
voluminous number of coins and currency removed from the
s~fe at decedents real property and provided ~o the care and
custody of Barbara Jean Magill.
5. The Last Will and Testament of decedent at pg 3 and 4 bequeaths
money in both Mellon Bank and Pennsylvania Credit Union
accounts to decedents niece, Barbara Jean Magill and directs
that niece Barbara Jean Magill "pay all the bills". The F&FA
Improperly paid all bills from the residual estate; the
decedent intended that all bills be paid from the Mellon
Bank and Pennsylvania Credit Union accounts. (EXHIBIT No 1)

AND NOW, this 22nd day of July, 1996, following a Pre'Hearlng eoruerenee before the Auditor
attended by H. Joseph Hepford, Esquire on behalf of the Estate and Catherine Waltz, pro se, objector, the
following Order fa entered:
1. Objection Number I regarding life Insurance fa withdrawn as the objector admitted at the
coruerence that the Executrix was the named beneficiary on the most recent Insurance polley.
2. The Estate has discovered additional Items since the filing of the First and Final Account,
some of which are the subject of objections, and the Estate will be rallng an Amended Pennsylvania
inheritance Tax Return and Amended Accounting. These Items are all follows:
a. Assorted coin seta and sllver coins $286.66;
b. Bags of wheat pennies $18.00:
e. Decedenta wallet with coins $90.46;
d. Rohrer Bus ticket refund $22.00;
e. Canadian dollar bills $2.20:
f. British poind notes $16.60;
g. OBSorted lose change $4.80;
h. OBSorted jewelry $102.00.
The sate objection remaining In Objection Number IT Is the alleged presence ofseveral one-hundred dollar
bUls In decedent's safe at the time of his death all well all loose coins and change found in the kitchen by
the objector. Consequently, testimony will be presented on the alleged presence and amounta of these
monies if the parties prior to trial do not otherwise resolve this ObJeCtion.
8. The obJeclor has raised the Issue all to whether or not the Executrix, also a beneficiary
of the will, should have segregated the Executrbt'slnherltanee from the balance of the Estate used to pay
bUls and inheritance tax. The objector and the Estate shall me a Brief containing legal authority for their
respective positions no later than ten days prior to trial to be held In this matter.

4. The objector has averred in her objections that several beneficiaries or the Estate were
recipients or welf'are benefits !'rom the Commonwealth or Pennaylvnn1a ond thererore the Estate W8lI
required, under Pennaylvnn1a IIlw, according to the objector, to notlf'y the appropriate authoritlcs ond to
make pnymenta directly to them rather than the intended beneficiaries. The objector ond the Estate wI1l
file a Brier on this mue, whleh legal authority shall be contained in one document in eoqjunetlon with the
Brier required above, ond shall be rued no IIlter than ten days prior to trial in thla matter.
5. The objector has indJcated a belier that the real estate owned by Decedent at the time or
his death W8lI valued at at least $80,000.00 ond, all parties agree, W8lI subsequently IlOld at a public/private
auction ror $74,000.00. At trial the objector wI1l be required to proceed with testimony 88 to the value or
the real estate at the time or death. The Estate may then respond accordingly.
At least ten days prior to trial in this matter, the Estate shall provide caples or any written
appra1lla1.s received on the real estate ond copies orthe most recent real estate tax billa to both the audJtor
ond the objector ror Ulle at trial.
6. Trla1 in this matter is scheduled ror Friday, August 30, 1996 beginning at 9:00am at the
Law Offices orRan Turo, 32 South Bedford Street, CarUale, PA 17013. At that time, the objections not
prevlOUllIy resol~ed shall be heard by the AudJtor ond all parties are required to obtain their wltnell8es ror
the trial.
