RELEASE, I{ECEII'T AND
FAMILY SETTLEMENT AGREEMENT
THIS AGREEMENT executed this 27th day of November, 1995, by and between Ruth L, Clouse,
personal administrator of the Estate of Mary B, Keek, deceased of Cumberland County, Twyla
Kauffman ofMechanicsburg,PA, individually, and Donald Heishman ofNewville,PA, individually.
WITNESSETlI:
WHEREAS, Mary B, Keck died on July 25, 1995 without leaving a will: and
WHEREAS, Ruth L, Clouse, decedent's sister and closest living relative, was, on August 4, 1995
appointed and swom as the personal representative of the Estate of Mary B. Keck; and
WHEREAS, Ruth L. Clouse has proceeded with the administration of the Estate and has prepared her
inventory, expenses, and recommendation of scheduled distribution as attached hereto and marked
Exhibit "A"; and
WHEREAS, the parties hereto desire the personal administrator shall not be required to file said
Account with the Orphan's Court of Cumberland County, and that the net Estate of the decedent shall be
distributed without the necessity of filing a formal account.
NOW THEREFORE, Ihe parties intending to be legally bound hereby, mutually agree as follows:
I, The Parties hereto agree and acknowledge they have fully and carefully examincd Exhibit "A"
including the schedule of distribution and find it true and correct and acceptable, and further that each of
them has received a copy of this Agreement and a copy ofsnid Exhibit "A".
2. The Parties hereto agree and acknowledge that Helen Heishman and Ruth L. Clouse were sisters
of the decedent and ifboth would have survived decedent then both would be entitled to a fifty percent
share of the Estate under Pennsylvania Intestacy Law, and further that Twyla Kauffman and Donald
Heishman as surviving children of Helen Heishman are entitled to Hclen Heishman's share.
3. The Parties hereto agree and acknowledge the Ruth L, Clouse as personal administrator of the
Estate has proposed a distribution schedule different than as called for in Pennsylvania's Intestate Law
and nevertheless agree to its terms and the conditions herein as set forth in Paragraph I. above.

4. This document is a full aad fiaal family Settlement Agreement by and among the parties, both
fiduciary and individual, all of the same having been arrived at, concluded and executed af\er a full and
complete disclosure of the assets of the Estale and the rights of the parties therein and therlO and all of
the parlies herelo, and each of them. agrees to abide by the lenns hereof,
5. The parties hereto do hereby release, remise and forever discharge Ruth L, Clouse, the personal
administrator of the Estate of Mary B. Keek, of and from any and all further liability of any nature
nrising out of the administration of the Estate,
6. This Agreement constitutes Ihe entire understanding among the parties hereto and each of them
acknowledges that no representations of statements of any kind, written or oral, have been made to them
or any of them prior hereto by the personal representative or by any other person or party upon their
behalf.
7. This Agreement shall inure 10 the benefit of and shall be binding upon the parlies hereto, and
each of them, their heirs, executors, administrators, successors and assigns.
