ORDER OF COURT
AND NOW, this 25th day of August, 1995, after
hearing and upon consideration of the petition of June E. Davis,
it is hereby ordered and decreed that June E. Davis, the aunt of
Cheryl Lyn Hohrein, age five, having been born August 18th,
1990, is appointed guardian of the person.
At the hearing today the faxed copy of the consent of
the natural father was received, his name being David Thomas
Johnson, Sr., and also the consent of the natural mother, Susan
Lynn Hohrein. The father indicated on the bottom of his consent
that this consent and court records must record these visitation
rights to this consent to be valid.
I am not accepting his consent with that condition. I
feel that under the facts of this case I do not need his
consent, and I will not accept his consent based on the
conditions that he has attached to same.

TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
The petition of June E. Davis by her attorney,
Mandell K. Shanken, respectfully states that:
1. The name of the minor is Cheryl Lyn Hohrein. Her
address is 1186 Kingsley Road, Camp Hill, Cumberland County,
Pennsylvania 17011. She will be five years of age and her
birth date is August 18, 1990 and her birth place is Anne
Arundel county, Maryland. Her natural mother's maiden name is
Susan Lynn Hohrein and her married name is Susan Lynn Nowicki
and she resides at Apartment 3A, 1297 Ashton Court,
Annapolis, Maryland 21403. Her natural father is David T.
Johnson who resides at Apartment 24, 12 West Washington
BOUlevard, Bath, New York, 14B10.
2. The name of the Petitioner and proposed guardian is
June E. Davis. She is 35 years of age and currently resides
at 1186 Kingsley Road, Camp Hill, Cumberland county,
Pennsylvania 17011. The Petitioner, June E. Davis is the Aunt
of the minor, Cheryl Lyn Hohrein and the sister of Susan
....
Lynn Hohrein Nowioki. She has been caring for Cheryl
Lyn at her home since October 25, 1990 under a written
authorization from her natural mother.
(3) The minor's natural mother, Susan Lynn
Hohrein Nowicki consents to the petition. Her written consent
will be filed separately with the Court. The natural father,
David T. Johnson has just been located, his whereabouts
heretofore were unknown to the natural mother and petitioner.
It is believed that he will consent to the petition and his
written consent will be filed separately with the Court. A
copy of this petition has been sent to him with an affidavit
of consent by express mail, a true and correot copy
of the letter, consent and mailing receipt is attached hereto
as exhibit "A".
(4) The natural mother, Susan Lynn Hohrein Nowicki
was addicted to drugs prior to and for several years after
her daughter, cheryl Lyn Hohrein, was born in August of 1990.
The natural father, David T. Johnson disappeared sometime
prior to the birth of Cheryl Lyn. Therefore, under the
ciroumstances and in the best interests of the ohild, Susan
Lynn Hohrein Nowicki entrusted the oare of Cheryl Lyn to her
sister by way of a temporary written authorization, a true
and correct copy of which is attached hereto as Exhibit "B"
and made a part hereof.
Cheryl Lyn has beon in fact living under the care of and
with the petitioner at her residence in Camp Ilill since
october 1990, and she believes the petitioner to be her
mother. The petitioner and her natural mother feel that it is
in the best interests of the child to formally continue this
stable and close relationship and to leave the child in her
same nurturing environment. Also, the natural mother, Susan
Lynn Hohrein Nowicki cannot effectively care for the child
from an emotional and financial standpoint. A guardian of the
person of Cheryl Lyn Hohrein, has never been appointed by the
Court, and the petitioner, and the natural mother desire such
formal appointment by the court of petitioner to facilitate
her enrollment in school, Highland Elementary School,
kindergarten grade, beginning the first week of September,
1995, the obtainment of health insurance for her, the future
potential health decisions that may have to be made for her
and other similar practical considerations; as well as to
formally continue this past and current close relationship.
(5) The minor has no estate past, current or
anticipated. The petitioner has no adverse financial interest
in the minor nor any adverse interest of any type whatsoever
to the minor. In fact, petitioner financially supports the
minor with an approximate contribution of 10% from her
natural mother.
(6) The religious porsuasion of the parties are
as follows 1
Petitioner-Proposed Guardian: Non-Denominational
Christian.
Natural Mother: Raised as non-denominational
Christian. No known present religious persuasion.
Natural Father: Angelican
(7) The minor is not entitled to receive any money
as a party to any action or proceeding in any court.
(8) Neither the natural mother or the natural father
are veterans and notice to the United states Veterans'
Administration is therefore not necessary.
(9) The proposed guardian's written consent to the
appointment is attached hereto as Exhibit "C".

court appoint her, June E. Davis as guardian of the

Dear Mr. Johnson,
I represent June E. Davis of Camp Hill, PA who is the
sister of Susan Lynn Hohrein, now Susan Nowicki of
Annapolis, Maryland. June has been taking care of
Cheryl Lynn Hohrein, her niece and the natural daughter of
Susan Lynn Hohrein and ( according to the birth certificate,
a copy of which is enclosed) yourself, David T. Johnson ever
since a few months after her birth on August 18, 1990.
June has engaged me to file a petition for the appointment of
herself as guardian of the person of Cheryl Lynn so that she
can formally continue to take care of her and enroll her
into school in camp Hill which I believe begins in the next
week or so, to obtain health insurance and for other
practical reasons. Up until now, June has been caring for
Cheryl pursuant to a written authorization from her sister.
This does not meet the schools requirement of a Court
ordered guardianship.
Susan Hohrein has consented to the appointment of June as
the guardian and we need your consent as well. I would
like to file the petition together with your consent as
soon as possible this week. Therefore, please find enclosed
two original consent forms. Kindly keep one for yourself
and send me one signed and notarized copy by fax to
717-233-6816 ( with regular mailing of the original) or
by overnight express mail.
I will forward you a copy of the petition that we file
with the court term and number and the date for any
required hearing. A rough draft of the petition is
enclosed.
