I, MARLIN S. SOHERS, of Dickinson Township, cumberland
County, Pennsylvania, declare this to he my last will and revoke
any will previously made by me,
I. I devise and bequeath all of my estate, real and
personal, of every nature and wherever situate to my nephew,
RICHARD K. SOWERS, providing he shall survive me by thirty days.

II. should my nephew, RICHARD K. SOHERS, predecease me ~
or die on or before the thirtieth day following my death, I t
devise and bequeath all of my estate of every nature and wherever ~
situate to my nephew's wife, SHIRLEY J. SOWERS, providing she
shall survive me by thirty days.
III. I direct that all taxes that may be assessed in
consequence of my death, of whatever nature and by whatever
jurisdiction imposed, shall be paid from my residuary estate as a
part of the expense of the administration of my estate,
IV. I appoint my nephew's wife, SHIRLEY J. SOWERS,
executrix of this my last will. Should she fail to qualify or
cease to act as executrix, I appoint THE FARMERS TRUST COMPANY,
of Carlisle, Pennsylvania as executor of this my last will.
V. I direct that my executors shall not be required to
give bond for the faithful performance of their duties in any
jurisdiction.

have inspected 1he property a1 188 Peach Glen Road Gardners, P A for the purpose of establishing
a value. The property as described in the Cumberland County deed book 33X.756 consists of a
two story house that has no well, no central heal, no electricity, no bath and no septic system, It
includes a barn that is in poor condition and is situated on 40.18 acres more or less, Due to the
poor condition of the dwelling and outbuilding, most of the value has been placed on the land.
In my analysis, I have compared 1his property 10 other similar properties in close proximity
which have sold in the past year. In addition, the cost approach to value in establishing a per acre
value was also considered.
Please be aware that the actual value of the Sowers estate is wha1 an in1erested party, taking
all economic factors into account, is willing to pay for it at a given point in time.
According to my analysis, I believe the value of the Marlin Sowers estate as of the date of
death, April 18, 1995, to be one hundred thirty thousand dollars ($130,000).

The Petition of Shirley J. Sowers, Executrix under the
Last Will and Testament of Marlin S. sowers, a/k/a Marlin
Sowers, deceased, by and through her attorney, Marlin R.
McCaleb, Esquire, respectfully represents as follows:
1. The decedent herein was Marlin S. Sowers, also known
as Marlin sowers, who died on April 18, 1995, a resident of
Middlesex Township, Cumberland County, Pennsylvania, having
first made his Last will and Testament dated November 15, 1990,
a true copy of which is attached hereto and made a part hereof,
marked Exhibit "A."
2. Your Petitioner herein is Shirley J. Sowers, an adult
individual who lives and resides at 160 Peach Glen Road,
Gardners, Pennsylvania.
3. Letters Testamentary herein were issued by the
Register of Wills of Cumberland county, Pennsylvania, on August
25, 1995, to Shirley J. Sowers, the Petitioner herein, pursuant
to Item IV of said Last will and Testament.
4. At the time of his death, decedent owned the following
property:
(1) Massey - Ferguson 135 tractor valued at $800.00.
(2) 7.5 acres of unimproved farm land along Peach
Glen Road, Dickinson Township, Cumberland
county, PA, being the residue of land acquired

Oood Dook "Q", Volumo 20, Pago 501, valued at
$25,000.00.
(3) Undividod one-sixth (1/6) into rest in 40.10
acres known and numborod as 100 Poach Glon Road,
Dickinson Township, Cumberland County,
Pennsylvania I tract was originally owned by
Hiram Sowers, decedent's father, who died
intestate on 11/21/37, survived by six children
(including decedent), in whom title to the said
real estate vested by operation of law as his
heirs at law, valued at $21,666.67.
A true copy of the Inventory filed herein is attached hereto
and made a part hereof, marked Exhibit "B."
5. Richard K. Sowers, husband of your Petitioner and
nephew of the decedent, is the sole legatee and devisee under
the said Last Will and Testament, as provided in Item I

6. Your Petitioner has prepared and filed a Pennsylvania
Inheritance Tax return herein and has paid the Pennsylvania
inheritance tax in full, as evidenced by the Notice dated April
22, 1996, attached hereto and made a part hereof, marked
Exhibit "C." This estate is not of sufficient size as to incur

any liability for federal estate tax.
7. All debts and obligations of the decedent have been
paid in full and there are no unpaid creditors of the estate.
8. Because Richard K. Sowers is the sole beneficiary of

County, Pennsylvania, declare this to be my last will and revoke
any will previously made by me.
I. I devise and bequeath all of my estate, real and
personal, of every nacure and wherever situate to my nephew,
RICHARD K. SOWERS, providing he shall survive me by t~irty days.
II. Should my nephew, RICHARD K. SOWERS, predecease me
or die on or before the thirtieth day following my death, I
devise and bequeath all of my estate of every nature and wherever ~
situate to my nephew's wife, SHIRLEY J. SOWERS, prOViding she
shall survive me by thirty days,
III. I direct that all ta~es that may be assessed in
