Stipulations Against Liens S & S Dream Builders, LLC In the Court of Common Pleas County of Cumberland Owner , Pennsylvania S&S Dream Builders, LLC Docket Number 0 7- 1/ {, S- M J.-J) Term 2007 Contractor Page Number Whereas, S & S Dream Builders, LLC, hereinafter called the Owner, is about to execute contemporaneously with S&S Dream Builders, LLC of 1800 Two Turn Road, Shippensburg, Pennsylvania 17257, hereinafter called the Contractor, a contract for the erection or construction of a SINGLE FAMILY DWELLING upon the lot of ground known as Timberland Estates, Lot 77, Shippensburg, PA 17257Southampton Township, Cumberland County, Pennsylvania, described in Exhibit "A" hereof, of which S & S Dream Builders, LLC is the title holder of record, as more particularly described in Deed Book , Page ; and Now, February 22,2007, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the Owner to the Contractor to commence work on said building or improvement, to purchase materials for the same, it is hereby stipulated and agreed by and between said parties as part of said contract and for the consideration therein set forth, nether the undersigned Contractor, any Sub-contractor or material man, nor any other person furnishing labor or materials to the said Contractor under the contract entered into between said parties shall file a lien for work done or material furnished to said building, improvements or any part thereof. This stipulation is made and intended to be filed with the Prothonotary within 10 days after date in accordance with the requirements of the Act of August 24, 1963, P.L. 497, as amended, In Witness Whereof, the said parties have hereunto set their hands and seal the day and year aforesaid. Exhibit A ALL THAT CERTAIN lot or piece of ground situate m Southampton Township, County of Cumberland, Commonwealth of Pennsylvania. BEGINNING at a point on the Southern side of Baltimore Road (S.R. 3001) a 60 foot wide street, at corner of Lot No. 76 as shown on a plan of lots hereinafter referred to; thence along the southern side of Baltimore Road (S.R. 3001), South 52 degrees 47 minutes 58 seconds East, 74.00 feet to a point; thence across said Baltimore Road (S.R. 3001), South 37 degrees 12 minutes 02 seconds West, 29.83 feet to a point; thence continuing along Baltimore Road (S.R. 3001) where it intersects Red Hawk Drive on a curve to the right, said curve having a radius of 35.00 feet, an arc length of 50.76 feet and bearing South 11 degrees 21 minutes 03 seconds East to a point; thence continuing along same, South 30 degrees 12 minutes 02 seconds West, 36.23 feet to a point; thence continuing along same on a curve to the left, said curve having a radius of 175.00 feet, an arc length of 22.16 feet and bearing South 26 degrees 34 minutes 24 seconds West to a point at corner of Lot No. 78 on said plan; thence by said Lot No. 78, North 67 degrees 10 minutes 33 seconds West, 124.74 feet to a point at corner of Lot no. 76 on said plan; thence by said Lot No. 76 and through a point on line, North 38 degrees 33 minutes 16 seconds East, 149.30 feet to a point on the Southern side of Balitmore Road (S.R. 3001), a 60 foot wide street, at conre of Lot No. 76 on said plan, being the place of BEGINNING. BEING Lot No. 77 AND CONTAINING 13,817 square feet as per survey entitled "Subdivision Plan _ Timberland Estates - Phase 1, Southampton Township, Cumberland County, Pennsylvania" prepared by Martin and Martin, Incorporated, dated July 28, 2005, with revision, which, together with the necessary municipal approvals, is recorded in the Office of the Recorder of Deeds of Cumberland County, PA, in Plan Book Volume 92, Page 71.
