I, DOROTHY 1'. ROSS, of the Borough of New Cumberland,
Cumberland County, Pennsylvania, being of sound and disposing mind,
memory and understanding, do hereby make, publish and declare this
as and for my Last Will and Testament, hereby revoking and making
void any and all Wills or Codicils at any time heretofore made by
me.
ARTICLB I
I direct the payment of all my legal debts, and the expenses
of my last illness and funeral from my Estate as soon after my
death as conveniently may be done. I direct that all taxes that
may be assessed in consequence of my death, of whatever nature and
whatever jurisdiction imposed, shall be paid from my Residuary
Estate as part of the expense of the administration of my Est.ate.
ARTICLB II
I give and bequeath my automobile, household and personal
effects and other tangible personalty of like nature (not including
cash or securities), together with any existing insurance thereon,
unto my daughter, BARBARA R. ROHRBAUGH, my son, RICHARD G. ROSS,
and my stepdaughter, KARBN R. LAKB, to be divided among them by my

I give, devise and bequeath all the rest, residue, and
remainder of my Estate, of whatsoever nature and wheresoever
situate unto BARBARA R. ROHRBAUGH, RICHARD G. ROSS, and KARBN R.
LAKB, share and share alike.
ARTICLB IV
In the event that any beneficiary of my will shall not have
reached the age of twenty-one (21) years at the time for
distribution of his or her share, I give, devise and bequeath such
share unto DAUPHIN DBPOSIT BANK AND TRUST COMPANY, IN SBPARATB
TRUST, to hold, manage, invest and reinvest the share so received,
and the accumulation of income thereon, and to use and apply the
income and principal, or so much thereof as, in Trustee's
discretion, may be necessary or appropriate for such beneficiary's
support and education (including college education, both graduate
and undergraduate, and vocational training) without regard to his
or her ability to provide for such support or education or to make
payment for these purposes, without further responsibility, to such
benef iciary or to an}. person taking care of such benef iciary. When
such beneficiary shall reach the age of twenty-one (21) years,
Trustee shall distribute the then-remaining principal and any
income accumulated thereon unto such beneficiary absolutely, and
the Trust as to that beneficiary shall terminate. In the event any
beneficiary dies before receiving his or her final distribution
hereunder, such beneficiary's Trust shall terminate and the balance
of principal and income shall be paid over to my then-living issue
per stirpes by representation.

ARTICLB V
During the time any portion of my Estate remains in Trust, the
same shall not be subject to attachment, levy or seizure by any
creditor, spouse, assignee or trustee or receiver in bankruptcy of
any beneficiary prior to his or her actual receipt thereof. The
Trustee shall pay over income and principal as hereinbefore
determined to the parties designated, as their interest may appear,
without regard to any attempted anticipation, pledge or assignment
by any beneficiary, and without regard to any claims thereto or
attempted levy, attachment, seizure or other process, provided that
if any such levy or seizure, or other process, shall be authorized
by law or specific order of any Court having jurisdiction, Trustee
shall not be liable to any beneficiary for violation hereof by
reason of the same.
ARTICLE VI
If at any time during the continuance of any Trust created
hereunder, the Trustee in its sole and absolute discretion
determines that the size of any individual Trust account has become
so small as to be impractical to continue to hold in Trust and
uneconomical to continue to administer as a Trust, then in such
circumstances, the Trustee may without further authorization
distribute the balance of the principal and income in such Trust
account to the beneficiary then-entitled to the income therofrom,
and upon such distribution the Trustee shall be released from
further obligation with respect to that account and shall not be
subject to any claim from any person who may have had a future
interest in such Trust account had it been continued in Trust.

The Petition of Barbara R. Rohrbaugh pursuant to 20 P.S.C.A. 03356 respectfully states the following:
I. Dorothy F, Rosa ("Decedent") died on AUJlUStl5, 1995, testate, leaving her Last Will and Testamen
dated Iune 3, 1992, which was duly probated before the Register of Wills of Cumberland County on September II,
1995.
2. The Register of Wills granted Letters Testamentary to Petitioner, a daughter of the Decedent.
3. At the time of death, Decedent held fee simple title to real estate situate In the Borough of Ne
Cumberland, Cumberland County, PeMSylvanla municipally known as 320 Third Street, New Cumberland,
PeMSylvanla, Improved thereon with a two story dwelling, described In accordance with Exhibit" A" attached hereto.
4, Petitioner obtained an appraisal of the value of the real estate by Dan Bamlnger &. Associates, Realtor,
which values the property at $88,000.00, a copy of which appraisal Is attached hereto as Exhibit "B".
5. Barbara R. Rohrbaugh and her husband, Michael p, Rohrbaugh, desire to purchase the real estate for
the sum of $78,000.00 pursuant to an Agreement of Sale, a copy of which Is attached hereto as Exhibit "C".
6. All parties In Interest consent to the proposcll sale, and the Consent Is altathcll u Exhibit "D",

WHEREAS, Decedent was seised of fee simple title to the premises 320 Third Street, New Cumberland,
Cumberland County, Pennsylvania;
WHEREAS, the Decedent's Will gives, devises and bequeaths all the rest, residue and remainder of her Estate
in equal shares unto Barbara R, Rohrbaugh, Richard G, Ross and Karen R, Lake;
WHEREAS, the Executrix secured an appraisal of the fair market value of the real estate at Eighty-Eight

Division, Court of Common Pleas, Cumberland County, authorizing the sale of the real estate pursuant to the terms
and conditions of this Agreement or February 28, 1996, whichever shall last occur,

7. Possession, Buyer shall have the privilege of retaining possession of the Real Estate as of the date I
hereof until the date of settlement or such date as this Agreement shall be rendered null and void, provided that Buyer
shall pay all charges for utlllty services to the premises, maintain the property In Its present condition without major
alternations or slruclUral changes and maintain a tenant's Insurance policy.
8, Risk of Loss. Risk of loss from fire or other casualty shall remain with Seller until settlement, In
the case of fire or other casualty prior to settlement, Buyer shall have the option of rescinding this Agreement or of
settling and obtaining an assignment of the Insurance proceeds.
9. Trnnsfer Tax~. All real estate transfer taxes shall be divided equally between the Seller and the Buyer
at settlement,
10. Real Estate Taxes, Allta~es levied on the real estate shall be prorated as of the date of settlement,
the Borough and Counry taxes being prorated on a calendar year basis, and the School District ta~es being prorated I

14. Condition or Premises. Buyer agrees that Buyer has inspected the premises and no representations
have been made by the Seller as to the condition of the improvement erected thereon. or the plumbing, heating or

specified.
15. Buvef"s D<!rault. If Buyer shall fall to perform any of the terms and conditions of this Agreement on
Buyer's part to be performed, then in such event, this Agreement of Sale shall be null and void without further liability
by either party to the other, except to respect to the right of the residuary heirs to require the payment of reasonable
rent for the period of Buyer's occupancy of the premises.
16. Asshmment. This Agreement of Sale shall not be assigned by Buyer without the prior written consent
of Seller or the residuary heirs.
17. BlndlOl! Errect. This Agreement of Sale shall be binding upon and shall Inure to the benefit of Buyer,
their respective heirs and personal representatives and shall be binding upon and inure to the benefit of the Seller and
the heirs of the Decedent's Estate,
18. Jolndef' or Reslduarv Heirs. Barbara R, Rohrbaugh, Richard G, Ross, and Karen R. Lake, the heirs I
of the rest, residue and remainder of the Estate of Dorothy F, Ross, having reviewed the terms and conditions of this I
Agreement for Sale of Real Estate, have each executed the Joinder attached to this Agreement for the purpose ofl
