LAST WILL AND TESTA~ENT
OF
CARL J. FILIMEK
I, Carl J. Filimek, of Cunberland County, Pennsylvania, being
of sound and disposing mind, memory and understanding, do hereby
make, publish and declare this as and for my Last Will and Testament,
hereuy revoking any and all prior Wills and nny nnd all Codicils
thereto, by me at anytime heretofore made.
FIRST: I direct the payment of my debts and expenses of my last
illness and funeral from my estate as soon after my death as conven-
iently may be done. If there be no cemetery lot available for my
interment owned by me at the time of my death, I authorize my personal
representative to purchase such cemetery lot with a contract for
perpetual care using therefor funds from my estate in such amount as
he shall consider necessary and desirable, and I authorize my personal
representative to cause title to or ownership of such lot so purchased
to be vested in such person as my personal representative shall
designate.
Further, in this connection, I authorize my personal representative
to expend further funds from my estate in such amount as my personal
representative shall consider necessary and desirable for the purchase,
erection, and inscription of a suitable marker for my grave.
SECOND: I give, devise, and bequeath all the rest, residue and
remainder of my estate, whether real, personal or mixed, and of any
nature whatsoever and wherever situated unto my beloved wife, Mary
Alice Filimek, provided that she is living on the thirtieth (30th) day
after the date of my death.

THIRD: In the event my beloved wife, Mary Alice Filimek, does
not survive me, or does not survive me by said period of thirty (30)
days, 1 then, give, devise, and bequeath unto my sister-in-law, Mrs.
Wilma Wortman, of Warner Robins, Georgia, and Mr. Charles David
Wortman, of Marysville, Tennessee, all the rest, residue, and remainder
of my estate, in equal shares, per stirpes.
FOURTH: No interest of any beneficiary under this Will or any
Codicil hereto shall. be subject to anticipation or voluntary or
involuntary alienation.
FIFTH: In addition to the powers conferred by la~I, 1 authorize
my Executrix in her absolute discretion:
A. To retain in the form received, and to sell either at
public or private sale, any real or personal property;
B. To manage real estate:
C. To invest and reinvest in all forms of property without
being confined to legal investments, and without regard
to the principal of diversification;
D. To exercise any option or rights arising from ownership of
investments;
E. To compromise claims without Court Approval, and without
the consent of any beneficiary;
F. To distribute in cash or kind or both at such valuations
as she may fix.
SIXTH: 1 direct that any and all inheritance, estate, and
transfer taxes imposed upon my estate passing under my Will or
otherwise, shall be paid out the principal of my residuary estate.
SEVENTH: No fiduciary acting hereunder shall be required to post
bond or enter security in any
jurisdiction.

EIGHTH: I appoint my wife, Mary Alice Filimek, Executrix of
this Will. If she does not act or continue to act, I appoint
Charles D. Wortman Executor in her place with the same powers and
duties,
IN WITNESS WHEREOF. I set my hand and seal to this my Last Will
and Testament consisting of this and two other pages at the end of
which I have also set my hand and ~~xed my seal for greater
and better identification this ~ day of June, A.D., 1985.
