I, HARRY E. KILLIAN, SR" of Upper Hifflin Township, Cumbereland County,
ennsylvania, declaree this to be my Last Will and Testament and revoke
ny will or codicil previously made by mo.
ITEH I: I direct that all my just debts and funeral expenses, including
y greavemarker and all expenses of my last illness, shall be paid from my
esiduarey estate as soon as preacticable after my decease as a part of the
dministreation of my estate.
ITEH II: I devise and bequeatll all of my estate of everey nature and wher-
Ver situate to my wife, DOROTHY ~I. KILLIAN, providing she sllall sorvive me by
hirty days.
ITEH III: Should my wife, DOROTHY H. KILLIAN, predecease me or die on or
efore tile thirtieth day following my death, I devise and bequeath all of my
state of every nature and wherever situate to my issue, per stirpes, living on
he thirty-first day following my deRth.
lTEH IV: I appoint CO~IONWEALTH NATIONAL BANK, of Shippensbureg,
ennsylvania, guardian of any property which passes outright eithere under
his will or otherwise to a minore and with respect to whicll 1 am autllorized to
ppoint a guardian and have not otherwise spccifically done so, provided that
his appointment of a guardian shall not superesede the right of any fiduciarey
in its discreet ion to distreibute a share where possible to the minore ore to
no tiler fore the minor's benefit. Such guardian shall have the powere to usc

of HARRY B. KILLIAN, SR.
WHEREAS, HARRY E. KILLIAN, SR., late of the Borough of Newville,
Cumberland County, Pennsylvania, died on August 22, 1995/ and
WHBRBAS, the Last Will and Testament of HARRY E. KILLIAN, SR, dated
December 19, 1983 was probal:ed on September 19, 1995/ and
WHBRBAS, Letters Testamentary were granted to HARRY E, KILLIAN,
JR., RONALD L. KILLIAN, and RICHARD E. KILLIAN on September 19,
1995/ and
WHEREAS, at least 4 months has elapsed since the first
advertisement regarding grant of letters testamentary, and
WHEREAS, the said Co-Executors have gathered the assets of the
estate of the decedent, consisting of personal property, and have
also deposited the proceeds of real estate transferred to the Co-
Executors prior to decedent's death, for a total value of
$88,125.98 as more fully sel: forth herein, which is a statement of
account of the said Co-Executors,
WHEREAS, the debts and deductions, including the payment of
inheritance tax in the said estate, is $25,435.69, leaving a
balance for distribution of $62,690,29, more fully set forth
herein,
WHEREAS, distributions in

NOW, THEREFORE, WITNESSETH that We, the said HARRY E. KILLIAN, JR.,

acknowledge that they have this day received from the said Co.
Executors, in full satisfaction and payment of all sum or sums of

will and testament, the assets listed in the schedule of
distribution, and do hereby bind themselves to the Accounting and
Schedule of Distribution attached hereto and do release the said
Co-Executors, HARRY E. KILLIAN, JR" RONALD L. KILLIAN, and RICHARD
E. KILLIAN froln any further liability,
AND, We do hereby stipulate that in order to avoid the expense and
time involved in the filing of a formal account and schedule of
distribution, We consent to distribution being made without the
filing of an account and schedule of distribution, the same to be
with the same force and effect as if they had been filed and
confirmed by the Orphan's Court Division of the Court of Cumberland
County, Pennsylvania.
THBREFORE, We do hereby remise, release, qui tclaim and forever
discharge the said Co-Executors of and from the said estate and
from all actions suits, payments, accounts, reckonings, claims, and
demands whatsoever for or by reason thereof, or for any other use,
matter, cause or thing whatsoever, touching upon the estate of the
said decedent, and We do further hereby covenant and agree that
should any liability come due to the estate of the said decedent
after the signing of this agreement, We hereby covenant and agree
with each other and the aforesaid personal represent- ative, that
We will contribute pro-rata our share of the estate to satisfy any
and all claims, demands, suits, or causes of action which may be
successfully prosecuted against the said estate or the aforesaid
personal representative after the signing, sealing and delivery of
this family settlement agreement and final release.
IN Jf.l\TNESS THEREOF, the parties have signed this Agreement this
