1, E. I.EE OILER, of Upper Mifflin Township, Cumberland County,
Pennsylvsnia, declare th1B to be my Last Will and Testament and revoke any
will or codicil previously made by me.
ITEM I: 1 direct that all my just debts and funeral expenses, including
my gravemarker and nll expenses of my last illness, shall be paId from my
residuary estate as soon as practicahle after my decease as a part of the
sdministration of my eatate.
ITEM 11: 1 bequeath those articles of my household furnl.ture and
furnishings and those articles of my personal effects snd personal property
as set forth In a separate memorandum, which 1 shall place wl.th my will or

ITEM 111: 1 devise and bequeath the residue of my estate of every
nature and wherever sl.tuate to my wife, HELEN C. OILER, providing she shall

before the thIrtieth day following my death, I bequeath thoRe articles of my

WHEREAS, Edward Lee oiler, late of Upper Mifflin Township,
Cumberland County, Pennsylvania, died on September 10, 19951 and
WHEREAS, the Last will and Testament of Edward Lee Oiler dated
February 18, 1987 was probated on or about September 25, 1995, and
WHEREAS, Letters 'l'estamentary were granted to Joan L. Brehm, J. 1\nn
Cohick and Jay F. Oiler on September 25, 1995; and
WHEREAS, at least 4 months has elapsed since the first
advertisement regarding grant of letters testamentary 1 and
WHEREAS, the said Co-Executors have gathered the assets of the
estate of the decedent consisting of personal property valued at
$ 148,675.29 as of September 10, 1995, as more fully set forth
herein, which is a statement of account of the said Co-Executors 1
and

WHEREAS, the Co-Executors own or owned jointly some nonprobate
assets previously owned by the Decedent, some of which were taxed
for Pennsylvania Inheritance Tax totalling $ 393,127.77.
WHEREAS, total income earned by the Estate is $ 33,478.52,
WHEREAS, the debts and deductions, including the payment of
inheritance tax in the said estate, is $ 51,985.32, leaving a
balance for distribution of $ 523,296.26, more fully set forth
hereinl
WHEREAS, distributions of probate and nonprobate assets in the
amount of $ 508,195.70 11ave been previously made, leaving a balance
of $ 15,100.56, in cash, to be distributed.
NOW, THEREFORE, WITNESSETH that We, the said Co-Executors, in
consideration of the above and intending to be legally bound
hereby, do hereby acknowledge that we have this day received from
the said Co-Executors, in full satisfaction and payment of all sum
or sums of money, legacies, bequests and devises as are stated
under said last will and testament, the assets listed in the
schedule of distribution, and do hereby bind ourselves to the
Accounting and Schedule of Distribution attached hereto and do
release the said Co-Executors, Joan L. Brehm, J, Ann Cohick and Jay
F. oiler from any further liability.
AND, We do hereby stipulate that in order to avoid the expense and
time involved in the filing of a formal account and schedule of
distribution, We consent to distribution being made without the
filing of an account and schedule of distribution, the same to be
with the same force and effect as if they had been filed and
confirmed by the Orphan's Court Division of the Court of Cumber-
land County, Pennsylvania.
THEREFORE, We do hereby remise, release, quitclaim and forever
discharge the said Co-Executors of and from the said estate and
from all actions suits, payments, accounts, reckonings, claims, and
demands whatsoever for or by reason thereof, or for any other use,
matter, cause or thing whatsoever, touching upon the estate of the
said decedent, and We do further hereby covenant and agree that
should any liability come due to the estate of the said decedent
after the signing of this agreement, We hereby covenant and agree
with each other and the aforesaid personal representative, that we
will contribute pro-rata our share of the estate to satisfy any and
all claims, demands, suits, or causes of action which may be
successfully prosecuted against the said estate or the aforesaid
personal representative after the signing, sealing and delivery of
this family settlement agreement and final release.
