ESTATE OF HAZEL V. SHOAl', DECEASED
WHEREAS, Hazel V. Shoal', late of Carlisle, Cumberland County, Pennsylvania,
deceased, died testate on Scptcmber 23, 1995, having first made her last will and
testament, which was duly executed on October I, 1968, which was duly admilled to
probate by thc Register of Wills ofCumbcrland County, File No. 1995-00737; and
WHEREAS, the said Hazel V. Shoap, by the alorcsaid last will and testament,
namcd L. Richard Shoap, J, Kcnneth Shoap and Donald R. Shoap as Executors of said last
will and testament; and
WHEREAS, J. Kenneth Shoap and Donald R. Shoap have renounccd their
appointments as Executors in favor of L, Richard Shoal'; and
WHEREAS, lellers testamentary on the estate of the said decedent were duly
issued, on October 5, 1995, by the Register of Wills of Cumberland County, Pennsylvania,
to L. Richard Shoap as Executor, hereinafter called personal representative;
WHEREAS, the said personal representative gathered the assets of the estate of
the said decedent and the assets consist of both real property and personal property, to a
total value of$838,567.27, as set forth in Exhibit A, which is a statement of inventory and
account of the said personal representative, and which is attached hereto and rnade a part
hereof; and
WHEREAS, the debts and deductions, including the payment of inheritance tax, of
the said estate, amount to $127,671.27, leaving a balance lor distribution 01'$710,895.73,
also as set forth in the statement of the said personal representative, which is allached
hereto and rnarked as Exhibit A;
NOW, L. Richard Shoap, J. Kenneth Shoap and Donald R. Shoap, being all of the
children of the said decedent, and being those persons entitled to inherit under said last
will and testament and each entitled to a one-third distributive share of the residuary
estate, do hereby, each of us, acknowledge that we have this day had and received from
the aforesaid personal representativc, in full satisfaction and payment of all sum or sums of
money, legacies, bequests, and devises as are given devised and bequeathcd to each of us
respectively by the said last will and testament, the amounts due us under said last will and
testament, which amounts we have received this day, and which amounts are in the
amount set opposite our respective names in the table and schedule of distribution in said
statement allached hereto and marked Exhibit A;

AND, J. Kenneth Shoap and Donald R. Shoap hereby agree to assign and consent
to the award to L. Richard Shoap, in-kind, of real property situate at II South Penn
Street, Dorough of Shippensburg, County of Cumberland, Pennsylvania. more fully
described in the Fiduciary Deed executed by the parties hereto, registered and recorded in
accord with Section 3536 of the Probate, Estate and Fiduciaries Code, and allached
hereto and marked Exhibit D;
AND, each of us does hereby stipulate that in order to avoid the expense, delay
and publicity involved in the filing of a formal account and schedule of distribution, we
each agree that no formal account is necessary and we do hereby agree that we do consent
to distribution being made without the filing of an account and schedule of distribution,
the same to be with the same force and effect as if they had been filed and confirmed by
the Orphans Court Division ofthe Court of Common Pleas of Cumberland County.
THEREFORE, we and each of us do hereby remise, release and quitclaim and
forever discharge the said personal representative, L. Richard Shoap, heirs, executors,
administrators and assigns, of and for the said estate, from all actions, suits, payments,
accounts, reckonings, claims, and demands whatsoever for or by reason thereof, or for any
other use, maller, cause or thing whatsoever touching upon the estate of the said
decedent, and each of us do rurther hereby covenant and agree that should any liability
come due to the estate of the said decedent after the signing of this agreement, we and
each of us do hereby covenant and agree with each other and the aforesaid personal
representative that we will contribute pro rata our share of the estate to satisfY any and all
claims, demands, suits, or causes of action which may be successfully prosecuted against
the said estate or the aforesaid personal representative after the signing sealing and
delivery of this ramily selllement agreement and final release.
FURTHER, it is agreed by each party to this Agreernentthal:
a. This agreement shall be indexed and recordcd in the cstate proceedings and that
the terms hereof shall be binding upon cach party's respective heirs. successors,
administrators and assigns;
b, This agreement shall be governed by and construed in accordance with the laws
of the Commonwealth of Pennsylvania;
c. The parties hereto agree to execute such other or additional documents as may
be necessary to effectuate the agreements set forth herein.
d. This Agreement and Release may be executed in separate counterparts and
when duly executed by all parties hereto, shall constitute a single agreement binding upon
all such parties.

Pennsylvania, of the one part and L. Richard Shoap, heir of the estate of Hazel V. Shoap,
orShippensburg, Pennsylvania, of the other p"rt.:
WHEREAS, Leslie D. Shoap and HlI7.el V. Shoap, his wire, were seized in fec of
a certain house and tract ofland, hereinafter described; and
WHEREAS, Leslie D. Shoap predeceased his said wife, on February 9, 1978,
leaving her as the sole owner, in fee, of the said certain house and tract ofland, hereinafter
described; and
WHEREAS, Hazel V, Shoap died on the 23rd day of September, 1995, leaving a
will dated October I, 1968, probp.!ed in the offic:,: of the R~gister l'fWilIs in and for the
County or Cumberland, by which testator appointed L. Richard Shoap, J. Kenneth Shoap
and Donald R. Shoap, Executors; and
WHEREAS, J, Kenneth Shoap and Donald R. Shoap have renounced their
appointments as Executors in favor of L. Richard Shoap; and
WHEREAS, lellers testamentary on the estate of the said decedent were duly
issued by the Register of Wills or Cumberland County, Pennsylvania, to L. Richard Shoap
qs Executor on October 5, ] 995; and
WHEREAS, said will and testament authorized the Executor to have full power
and authority to do any and all things necessary for the complete administration of the
testator's estate; and

WHEREAS, L. Richard Shoap, J. Kenneth Shoap and Donald R. Shoap, being all
the natural issue of the said decedent, and being those persons entitled to inherit in equal
shares under said last will and testament; and
WHEREAS, J. Kenneth Shoap and Donald R. Shoap have consented to this
transfer and renounced their interests in the house and tract hereinafter described ~
allachments hereto);
NOW THIS INDENTURE WITNESSETH, that L. Richard Shoap, Executor, has
granted, released, and confirmed, and by these presents, by force and virtue of the will of
Hazel V, Shoap, does grant, release, and confirm, unto L. Richard Shoap, as heir to the
said decedent, all that certain house and tract of realty situated in the Borough of
Shippensburg, County of Cumberland, Pennsylvania, bounded and described as follows, to
wit:
BEGINNING at an iron pin on the curb line of said Penn Street at the
comer of a fourteen (14) foot wide alley; thence with said curb line
North nineteen (19) degrees West seventy-nine (79) feet, two and one-
rourth (2-1/4) inches to a stake at corner; thence by lot formerly of Lillie
K. Aughinbnugh, now D.C. Foose, North sixty-nine (69) degrees, rorty
(40) rninutes, East forty (40) feet, six and three-fourths (6-3/4) inches to
a stake on line of lot formerly ofC.J. Gossert. now Arthur R. Burkhart;
thence with the lot of said Burkhart. South twenty (20) degrees, forty
(40) rninutes, East seventy-nine (79) feel, three and one-half (3.112)
inches to a stone at the edge of the fourteen (14) foot wide alley
aforesaid; thence with the said alley South sixty-nine (69) degrees, forty
(40) minutes, West forty-one (41) feet, one-eighth (1/8) of an inch to
the iron pin, the place of beginning. Having thereon erected a 1.1/2
story frame bungalow, known as nurnber 11 South Penn Street,
BEING the same tract of land which C. Eugene Blum and Helen
M. Blum, his wife, by their deed dated 16th day of August, 1955 and
recorded in the office for the recording of deeds in and for the County
of Cumberland in Deed Book "S", Volume 16 at Page 483 conveyed to
Leslie D. Shoap and Hazel V. Shoap, his parties of the Second part
herein.
