The Trust established under Article VI shall be held,
administered and distributed as follows:
page'3 of 16 Pages
A. The entire Trust estate shall be administered as a
single Trust until my youngest living grandchild attains the age
of thirty (30).
B. If at any time the Trustee, in the Trustee's
discretion, deems that a grandchild is in need of funds for his
or her proper care, support, maintenance or education, the
Trustee shall pay to or apply for the benefit of that grandchild
any amounts out of the grandchild's share of the Trust estate
that the Trustee considers necessary for the grandchild's proper
care, support, maintenance and education, "Education" shall
include elementary, secondary, college and post-graduate study at
any accredited institution of the grandchild'S choice for any
period of time that, in the judgment of the Trustee, is
advantageous to the grandchild concerned and shall include
reasonable amounts for all related living and travel expenses of
the child. Should the income be insufficient to provide my
grandchildren with adequate maintenance, support, welfare or
education, the Trustee may invade the principal of the Trust for
these purposes. Payments of income or principal pursuant to this
paragraph need not be equal for each grandchild and shall not be
taken into account at any later division or distribution of the
Trust estate for my grandchildren. The Trustee shall accumulate
and add to principal any net income not distributed during the
year. Payments for the care, maintenance, support or education
shall be made only if there are no other sources available for
these needs, including the resources of the parents of the

grandchild. My primary purpose in establishing these Trusts is
to provide substantial assets for my grandchildren when they each
reach the ages of eighteen (18), twenty-five (25) and thirty
(30), but the share of the trust estate of each grandchild may be
distributed for his or her care, maintenance, support or
education if necessary.
C, The Trustee in exercising its discretionary authority
with respect to the payment of income or principal of the Trust
estate to the beneficiary, may take into consideration any income
or other resources available to such beneficiary from sources
outside of this Trust that may be known to the Trustee. The
Trustee may accept as final and conclusive the written statement
of the beneficiary receiving payment as to other available income
or resources. The determination of the Trustee with respect to
the necessity of making payments out of income or principal to
the beneficiary shall be conclusive on all persons however
interested in the Trust.
D. When a grandchild of mine attains the age of eighteen
(18), the Trustee shall distribute to that grandchild ten (10%)
percent of the then balance of the principal of his or her share
of the Trust estate as determined by dividing the Trust estate by
the number of grandchildren living at the time who have not
attained the age of thirty (30).
E, When a grandchild of mine attains the age of twenty-
five (25), the Trustee shall distribute to that grandchild fifty
(50%) percent of the then balance of the principal of his or her

share of the Trust estate divided by the number of grandchildren
living at the time who have not attained the age of thirty (30).
F. When a grandchild attains the age of thirty (30), the
Trustee shall distribute to that grandchild an amount equal to
the 'rrust estate divided by the number of grandchildren living at
the time who have not attained the age of thirty (30).
G. Should a grandchild die prior to termination of the
Trust, then on the death of that grandchild, the Trustee shall
distribute all of the balance of the deceased grandchild's share
of the Trust estate to his or her issue then living, per stirpes
and not per capita. If there is no issue then living, then all
of the balance of the deceased grandchild's share of the Trust
estate shall be added to the shares set aside for the benefit of
my other grandchildren and the issue of any deceased grandchild,
per stirpes and not per capita, including proportionately both
the distributed and the undistributed shares.
H, All of the trusts provided for herein shall in any
event terminate on the expiration of twenty-one (21) years after
the death of the last survivor of all my grandchildren in being
at the time of my death.
I, If on termination of the administration of my probate
estate, there has been no distribution in trust to the Trustee
and events have occurred which would require the Trustee under
the terms of this will to make immediate distribution of all the
property, my Executor or Executrix shall perform all of the acts
Page 6 of 16 Pages
necessary to complete such distribution and for this purpose
shall have the powers granted by this will to the Trustee.
J. The determination and/or payment for the estate needs
of the Trust beneficiaries shall be made by the Trustee on a
regular basis which, in no event, shall be less than semi-
annually.
K. If at any time any beneficiary entitled to receive
income or principal from the Trust estate is a minor or an
incompetent or a person whom the Trustee deems unable to handle
the funds properly or wisely if paid directly to the beneficiary,
the Trustee in its discretion may make payments in anyone or
more of the following ways:
1, To the natural guardian or legally appointed
guardian of the person or estate of the beneficiary;
2, By making expenditures directly for the care,
support, maintenance, or education of the beneficiary; or

Trustee, The decision of the Trustee as to which of the
aforementioned methods should be used in making payments shall be
conclusive and binding on all parties concerned.

Dear Mr. Turano I
Rei Estate of Patricia A. Otstot
File No.1 2195-0776
This is in response to your request for an extension to file
the Inheritance Tax Return for the above-referenced eetate.
In accordance with Section 9136(d) of the Inheritance and
Estate Tax Act of 1995, the time for filing the return is extended for
an additional period of six (6) months. This extension will avoid the
impoaition of a penalty for failure to make a timely return. However,
it does not prevent interest from accruing on any tax remaining unpaid
after the delinquent date.
The return muat be filed with the Register of Willa on Dr
before December 6, 1996. Because Section 9136(d) of the 1995 Act
allowa for only one extra period of aix (6) months, no additional
extenaion(a) will be granted that would exceed the maximum time
permitted.

A. The entire Trust estate shall be administered as a
single Trust until my youngest living grandchild attains the age
of thirty (30),
B. If at any ti~e the Trustee, in the Trustee's
discretion, deems that a grandchild is in need of funds for his
or her proper care, support, maintenance or education, the
Trustee shall pay to or apply for the benefit of that grandchild
any amounts out of the grandchild's share of the Trust estate
that the Trustee considers necessary for the grandchild's proper
,
care, support, maintenance and education. "Education" shall
include elementary, secondary, college and post-graduate study at
any accredited institution of the grandchild's choice for any
period of time that, in the judgment of the Trustee, is
advantageous to the grandchild concerned and shall include
reasonable amounts for all related living and travel expenses of
the child. Should the income be insufficient to provide my
grandchildren with adequate maintenance, support, welfare or
education, the Trustee may invade the principal of the Trust for
these pUrposes, Payments of income or principal pursuant to this
paragraph need not be equal for ~ach grandchild and shall not be
taken into account at any later division or distribution of the
Trust estate for my grandchildren, The Trustee shall accumulate
and add to principal any net incom~ not distributed during the

shall be made only if there are no other sources available for
these needs, including the resources of the parents of the

C. The Trustee in exercising its discretionary authority
with respect to the payment of income or principal of the Trust
estate to the beneficiary, may take into consideration any income
I
or other resources available to such beneficiary from sources
outside of this Trust that may be known to the Trustee. The
Trustee may accept as final and conclusive the written statement
of the beneficiary receiving payment as to other available income
or resources.
E. When a grandchild of mine attains the age of twenty-
five (25), the Trustee shall distribute to that grandchild fifty
(50%) percent of the then balance of the principal of his or her

share of the Trust estate divided by the number of grandchildren
living at the time who have not attained the age of thirty (30).
F. When a grandchild attains the age of thirty (30), the
Trustee shall distribute to that grandchild an amount equal to
the Trust estate divided by the number of grandchildren living at
the time who have not attained the age of thirty (30).
G, Should a grandchild die prior to termination of the
Trust, then on the death of that grandchild, the Trustee shall
distribute all of the balance of the deceased grandchild's share
of the Trust estate to his or her issue then living, per stirpes
and not per capita, If there is no issue then living, then all
of the balance of the deceased grandchild's share of the Trust
estate shall be added to the shares set aside for the benefit of
my other grandchildren and the issue of any deceased grandChild,
per stirpes and not per capita, including proportionately both
the distributed and the undistributed shares.
H, All of the trusts provided for herein shall in any
event terminate on the expiration of twenty-one (21) years after
the death of the last survivor of all my grandchildren in being
at the time of my death.
I, If on termination of the administration of my probate
estate, there has been no distribution in trust to the Trustee
and events have occurred which would require the Trustee under
the terms of this will to make immediate distribution of all the
property, my Executor or Executrix shall perform all of the acts

necessary to complete such distribution and for this purpose
shall have the powers granted by this Will to the Trustee.
J. The determination and/or payment for the estate needs
of the Trust beneficiaries shall be made by the Trustee on a
regular basis which, in no event, shall be less than semi-

guardian of the person or estate of the beneficiary;
2. By making expenditures directly for the care,
support, maintenance, or education of the beneficiary; or
3. To any person or organization furnishing care,
