LAST WILl. AND TESTAMENT OF'
RUTH G. MABLEY
I, Ruth G. Marley, of the Borough of Carlisle, Cumberland
county, pennsylvania, declare this to be my last Will and Testament
and revoke all Wills and Codicils previously made by me.
ITEM I: I direct that all my just debts, funeral expenses
and the expenses of the administration of my Estate, including any
federal, state or other death taxes payable because of my death,
shall be paid from the residue of my estate as soon as practicable
after my decease, as a part of the expense of the administration
of my Estate.
ITEM II: I devise and bequeath all of my estate of every
nature and wherever situate, as follows:
A. One-fifth (1/5) thereof unto my grand-nephew, Jeffrey D.
Weer:
B. One-fifth (1/5) thereof unto my grand-niece, Christina J.
Weer:
C. One-fifth (1/5) thereof unto my grand-nephew, Alan R.
Weer:
D. One-fifth (1/5) thereof unto my grand-nephew, Jamie R.
Boomershine: and
E. One-fifth (1/5) thereof unto my grand-niece, Amy L.
Boomershine.
PROVIDED, HOWEVER, that should any of my said above named grand-
nephews and/or grand-nieces predecease me or die on or before the
thirtieth (30th) day following my death, his or her share shall

Jeffrey D. Weer, Christina J. I~eer and/or Alan n. Weer, if any of
those beneficiaries shall be a minor at the time of my death, and
with respect to any property which I am authori?ed to appoint a
guardian and have not otherwise specifically done so, provided,
that this appointment of a guardian shall not supersede the right
of any fiduciary in its discretion 1:0 distribute a share where
possible to the minor or to another for the minor's benefit. Such
guardian shall have the power to use principal, as well as income,
from time to time, for the minor's support, welfare and education
or to make payment for these purposes, without further responsibility,
to the minor or to any person taking care of the minor.
ITEM IV. I appoint my niece, Ruth Boomershine, guardian of

Jamie R. Boomershine and/or Amy L. Boomershine, j f either of those

RUSSELL WEER,
Executor of the Estate
of RUTH G. MARLEY
WHEREAS, RUTH G. HARLEY, late of West Pennsboro Township,
Cumberland County, Pennsylvania, died on April 27, 1996; and
WHEREAS, the Last Will and Testament of RUTH G. HARLEY dated May
16, 1983 was probated on October 26, 1996; and
WHEREAS, Letters Testamentary were granted to RUSSELL WEER on
October 26, 1996; and
WHEREAS, at least 4 months has elapsed since the first
advertisement regarding grant of letters testamentary; and
WHEREAS, the said Executor has gathered the assets of the estate
of the decedent consisting of both real property and personal
property, for a total value of $ 9,371.84 as more fully set forth
herein, which is a statement of account of the said Executor;
WHEREAS, the debts and deductions, including the
inheritance tax in the said estate, is $ 7,399.24,
balance for distribution of $ 1,972.60, more fully
herein;
payment of

WHEREAS, distributions in the amount of $ 0.00 have been
previously made, leaving a balance of $ 1,972.60, in cash and in
kind, to be distributed.
NOW, THEREFORE, WITNESSETH that we, the said JEFFREY D. WEER,
CHRISTINA J. WEER, RUSSELL WEER, as guardian for ALAN R. WEER,
JAMES R. BOOMERSHINE and AMY L. BOOMERSHINE, in consideration of
the above and intending to be legally bound hereby, do hereby
acknowledge that they have this day received from the said
Executor, in full satisfaction and payment of all sum or sums of
money, legacies, bequests and devises as are stated under said
last will and testament, the assets listed in the schedule of

distribution, and do hereby bind themselves to the Accounting and
Schedule of Distribution attached hereto and do release the said
Executor, RUSSELL WEER from any further liability.
AND, we do hereby stipulate that in order to avoid the expenGe
and time involved in the filing of a formal account and schedule
of distribution, we conBent to distribution being made without
the filing of an account and schedule of distribution, the same
to be with the same force and effect as if they had been filed
and confirmed by the Orphan's Court Division of the Court of
Cumberland County, Pennsylvania.
THEREFORE, we do hereby remiBe, releaBe, quitclaim and forever
discharge the said Executor of and from the said estate and from
all actions suits, payments, accounts, reckonings, claims, and
demands whatsoever for or by reason thereof, or for any other
use, matter, cause or thing whatsoever, touching upon the estate
of the said decedent, and we do further hereby covenant and agree
that should any liability come due to the estate of the said
decedent after the signing of this agreement, we hereby covenant
and agree with each other and the aforesaid personal represent-
ative, that we will contribute pro-rata our share of the estate
to satisfy any and all claims, demands, suits, or causes of
action which may be successfully prosecuted against the said
estate or the aforesaid personal representative after the
signing, sealing and delivery of this family settlement agreement
and final release.
