WAIVER OF I.IENS

WHEREAS, Bmc~: I{.. Barclay, of Cumberland County, Pemasylvania, entered into a contract with BBEC, lnc.,
of Cumberland County, Pennsylvania, to provide materials and perform labor necessary for completion of' a
residential dwelling situate upon lot of ground located:
253 Brindle Road, Mechanicsburg, I)A 17055, , Cumberland County, PISNNSYI.VANIA, as more particularly
set forth in Exhibit "A" attached hercto.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said
contract and for the consideration thereto set lbrth, that neither the undersigned contractor, any sub-contractor or
material man, nor any other person furnishing labor or materials to the said contractor under this contract shall
file a lien for work done or materials furnished to the said buildh~g or any part thereof.
This stipulation is made and intended to bc liled with the County Prothonotary within ten (10) days after date, in
accordance with the requirements of the Act of Asscmbly of Pennsylvania, in ~uch case provided.
Thc General Contractor hereby agrees to waive any defects in the filing m~d indexing of this Lien Waiver in the
Office of the Prothonotary where it is to be filed pursuant to Section 1402 of the Mechanics Lien Law of 1963
and agrees that it will not contest the validity of this Lien Waiver based upon any such defects and hereby agrees
to this waiver of defects on behal£ or any of the Subcontractors, materialmen or suppliers that may provide any
labor or materials under lhe General Contractors Agreement with thc owner a~d who, but for the same, waiver,
would be entitled to assert Mechanics IJens against the owners property under the Mechanics Lien Law of 1963.
The General Contractor also hereby agrees to provide actual Notice of the Lien Waiver to all subcontractors,
materialmen and suppliers prior to providing any labor or material by them to the project and will further
provide for a written acknowledgment by each of these persons of the Lien Waiver prior to providing any labor
or materials to the project.
IN WITNESS WHEREOF, the said parties hereto have hereunto set their hands and seals this 18th day of
December, 2002.

EXHIBIT "A"
ALL THAT CERTAIN tract of land situate in _Monroe Township, Cumberland County, Pennsylvania, being more fully bounded,
limited and described as follows, to wit:
BEGINNING at a point on the eastern side of Brindle Road, a/k/a Township Road T-562 and also being the right-of-way line of the
aforementioned roadway; thence North two (02) degrees seventeen (17) minutes thirty (30) seconds East one hundred and zero
hundredths (100.00) feet to a point on the Eastern side of the aforementioned roadway at Lot No. 8; thence along Lot No. 8 the
following courses and distances: South eighty-seven (87) degrees forty-two (42) minutes thirty (30) seconds East, three hundred and
zero hundredths (300.00) feet; thence North two (02) degrees seventeen (17) minutes fifteen (15) seconds East, one hundred two and
twenty-six hundredths (102.26) feet to a point at Lot No. 1 of another plan of lots being recorded in Plan Book 49, Page 137; thence
along the last mentioned lands South eighty-eight (88) degrees eight (08) minutes twenty (20) seconds East four hundred sixty-eight
and twenty-four hundredths (468.24) feet to a point at Lot No. 6 on the Plan of Lots recorded in Plan Book 49, at page 137 thence
along the last mentioned Lands South five (05) degrees fifty-five (55) minutes twenty (20) seconds East two hundred fifty and zero
hundredths (250.00) feet to a point at Lot No. 11; thence along Lots No. 11 and I0 South eighty-five (85) degrees forty-one (41)
minutes fifteen (15) seconds West five hundred seven and th/rty hundredths (507.30) feet to a point at Lot No. 6; thence along Lot
No. 6 the following courses and distances: North two (02) degrees seventeen (17) minutes thirty (30) seconds East, one hundred fifty
and zero hundredths (150.00) feet to a point; thence North eighty-seven (87) degrees forty-two (42) minutes thirty (30) seconds West
three hundred and zero hundredths (300.00) feet to a point the eastern side of Brindle Road, a/k/a Township Road T-562, being the
point and place of BEGINNING.
CONTAINING 3.77 acres and bein.g designated as Lot No. 7 on the f'mal Subdivision Plan for Alice W. Zollers dated February 20,
1987, and revised February 1, 1988, as prepared by C. W. Junkins Associates, Inc. Said Plan is found of record in the Recorder of
Deeds Office in and for Cumberland County, Pennsylvania in Plan Book 54, at page 141.
BEING the same premises which Central Pennsylvania Group, Inc., a Pennsylvania Business Corporation, by Deed dated the 14th day
of April, 1988, and recorded at Cumberland County in the Office of the Recorder of Deeds, in and for the County of Cumberland, on
the 19th day of April, 1988, in Record Book H-33, Page 65, granted and conveyed unto Bruce K. Barclay.
