furniture which I have received from the Crawford family unto
my sister. r.ouise C. lIorstick, if she survives me, and if she
should predecease me, I give and bequeath all of sain items of
personal property unto her daughter, my niece. Janine lIershkovitz.
ITEM II. I qive, be~ueath and devise all of the rest, residue
and remainder of my estate unto my husband, Donald D. McCloskey.
lIowever. if the said nonald Po. McCloskey should predecense me,
or die within 90 days following the date of my death, then I
give, bequeath and devise the residential property situate at
1384 Simpson Ferry noad, New cumberlann, Pennsylvania, providinq
I own same at the time of my death, or the proceeds realized
from the sale thereof, if I am still in possession of said proceeds,
unto my husband's son, Don Richard McCloskey, or his issue, per
stirpes. ann the residue of my estate I give to my said sister,
Louise C. 1I0rstick. or her issue, per stirpes.

or any Codicil hereto, shall be subject to anticipation, or voluntary

Louise C. Horstick. I specifically direct that no fiduciary acting
hereunder shall be required to enter bond or post security in
any jurisdiction for the faithful performance of his duties.

RECEIPT, RELEASE AND
REIMBURSEMENT AGREEMENT
WHEREAS, Marian E. McCloskey, late of the Borough of New
Cumberland, Cumberland County, Pennsylvania, died testate on August
October 20, 1995, having first made her Last will and Testament,
duly executed on May 31, 1973, which is recorded in the Office of
the Register of wills of Cumberland County, Pennsylvania;
WHEREAS, by her aforesaid Last will and Testament, the said
Marian E. McCloskey named Louise C. Horstick ExeGutrix of her Last
Will and Testament;
WHEREAS, Letters Testamentary on the Estate of the said Marian
E. McCloskey were duly issued by the Register of Wills of
Cumberland County, Pennsylvania, unto Louise C. Horstick on
November 21, 1995;
WHEREAS, Louise C. Horstick as Executrix of the Estate of
Marian E. McCloskey has gathered the assets of the Estate as set
forth on Exhibit "A" which is a statement of the account;
WHEREAS, the debts and deductions, including payment of the
Pennsylvania Inheritance Tax in said estate, have been paid as set

forth on Exhibit "A"I
WHEREAS, it is the desire of the undersigned that distribution
be made and the said Louise C. Horstick is willing to make such
distribution upon the receipt of a proper release and
indemnification, which it is the purpose of this Agreement to
provide.
NOW, THEREFORE, KNOW YE that I, Louise C. Horstick, who am
named as a residual beneficiary under Item II of the Last will and
Testament of Marian E. McCloskey, do hereby acknowledge that I have
this day had and received from the aforesaid Executrix in full and
final satisfaction and payment of all sum or sums of money,
legacies, bequests and devises as are given, devised or bequeathed
by the said Last will and Testament of Marian E. MCCloskey, the
amount of distribution which is set forth opposite my name in the
Schedule of Distribution in the Statement attached hereto and
marked Exhibit "A";
AND I declare that I have examined the Account of the said
Executrix attached hereto as Exhibit "A" and find the same to be
true and correct in all particulars and hereby approve the same and
request her to make final distribution without the filing of said
Account for audit and approval by the orphans' Court Division of
the Court of Common Pleas of Cumberland County, Pennsylvania. In
consideration of the delivery to me of the distribution as

aforesaid, for myself, my heirs, executors, administrators and
assigns, I do remise, release, quitclaim and forever discharge
Louise C. Horstick individually and as Executrix of the Estate of
Marian E. Mccloskey, Deceased, and Anna Marie sossong, Esquire, and
the law firm of Skarlatos & zonarich, its successors and assigns,
of and from any and all actions, suits, payments, accounts, claims
and demands whatsoever or by reason of their administration of the
Estate of Marian E. McCloskey, Deceased, hereby agreeing that the
Orphans' Court Division of the Court of Common Pleas, Cumberland
county may, by its decree, confirm the said account and discharge
Louise C. Horstick. I further agree to indemnify and hold harmless
Anna Marie sossong, Esquire, and Skarlatos & Zonarich from any and
all claims, loss, liability and damage which they may suffer or to
which they may be subjected by reason of the settlement of this
account and distribution of the assets of the said Marian E.
McCloskey.
I do further declare it is my intention to be legally bound by
the execution of this instrument and do hereby covenant and agree
with the said Executrix and with the other beneficiaries that
should any liability come known against the Estate of Marian E.
McCloskey after the signing of this Agreement, I will contribute
pro rata with the other beneficiaries up to the share distributed
hereunder to satisfy any and all claims, demands, suits or causes
