LAST WILL AND TESTAMENT
I, ROBERT LEE YOST, of Newville, Upper Mifflin Township,
Cumberland County, pennsylvania, being of sound and disposing mind
and memory, do hereby make, publish and declare this to be my Last
Will and Testament, hereby revoking any and all former Wills or
Codicils by me made.
1.
I direct that all my just debts,
funeral expenses,
testamentary expenses and all inheritance taxes (whether such taxes
may be payable by my estate or by any recipient of any property)
shall be paid from Iny residuary estate as soon as practicable after
my decease and as part of the administration of my estate. My
Executor shall have no duty or obligation to obtain reimbursement
for any such tax so paid, even though on proceeds of insurance or
other property not passing under this Will.
2.
I hereby give, devise and bequeath all of my estate, both real
and personal property, unto my Trustee, in trust, for the following
purposes:
(a) I direct that my Trustee shall hold, invest and reinvest
the same, collect the income arising therefrom, and after paying
all expenses incident to the management of the trust, to \lse and
apply as much of the income and principal as may be necessary in
the sole discretion of my Trustee, in equal shares, for the

support, well-being and education of my children, SARA ANN YOST and
ROBERT LEE YOST, JR.
(b) I direct that all of my aforesaid real property, shall be
held by my Trustee in kind, for the use and benefit of my said
children, until ROBERT LEE YOST, JR. attains the age of twenty-one
(21) years, at which time all the real property shall be
distributed equally to and between my children as joint tenants
with right of survivorship.
(c) I direct that each of my children shall have the right of
withdrawal of his or her equal share of the remaining principal
and any accumulated income of said trust upon ROBERT LEE YOST, JR.
attaining the age of twenty-one (21) years.
(d) In the event that ROBERT LEE YOST, JR. shall fail to
survive until the age of twenty-one (21) years, the share of SARA
ANN YOST shall be distributed to her provided that she has attained
the age of twenty-one (21) years.
In the event any of my said
children shall fail to attain the age for distribution of their
share and shall be survived by issue, then his or her share shall
be held by my Trustee for said isslle and distributed tu them
equally as each shall attain the age of twenty (20) years. The
share or undistributed share of any of my said children who shall
not be survived by issue shall be distributed by my said Trustee
equally to my remaining children in accordance with the terms
hereof.

(e) Prior to the distribution of any share, my said Trustee
shall have the sole discretion to invade the principal of said
share (including real property) for the support, maintenance and
education of such children or issue of such deceased children,
regardless of age.
(f) To the extent that the same is permitted by law, none of
the beneficiaries hereunder shall have any power to dispose of or
to charge by way of anticipation any interest given to such
beneficiarYI and all sums payable to such beneficiaries hereunder
shall be free and clear of the debts, contracts, alienations and
anticipations of the beneficiaries, and all liabilities for levies
and attachments and proceedings of whatsoever kind, at law or in
equity.
3.
In the event that I shall not be survived by my children or
any issue of children, then I give, devise and bequeath all of my
estate, both real and personal property, in the following manner:
(a) My estate shall be paid to my heirs who would be entitled
thereto under the intestate laws of Pennsylvania in effect at my
death.
4.
I nominate, constitute and appoint SHIRLEY DEIMLER as
Executrix of my estate.
In the event SHIRLEY DEIMLER shall be

unable or unwilling to serve in such capacity, then I appoint
JOSEPH PAUL LINKCIIORST to act in such capacity.
5.
I nominate, constitute and appoint SHIRLEY DE IMLER as Trustee
under the terms of this Last Will and Testament and I further
appoint SHIRLEY DE IMLER as Guardian of the persons of any minor
children.
In the event SHIRLEY DE IMLER shall be unable or
unwilling to serve in such capacities, then I appoint JOSEPH PAUL
LINKCHORST to act in such capacities.
6.
I direct that neither my Executrix nor my Trustee shall be
required to file a bond to secure the faithful performance of their
duties in any jurisdiction.
7.
I authorize and empower my personal representative and
Trustee, in their sole and absolute discretion, to purchase or
otherwise acquire and retain any investments of which I die seized
or any real or personal property of any nature; to sell, lease,
pledge, mortgage, transfer, exchange, dispose of or grant options
in regard to any or all property of any kind forming a part of my
estate for such terms and such prices as they may deem advisable;
to borrow money for any purposes connected with the protection and
preservation of my estate; to mortgage or pledge any real or
personal property forming a part of my estate or to join in or.

I, ROBERT LEE YOST, of Newville, Upper Mifflin Township,
Cumberland County, Pennsylvania, being of sound and disposing mind
and memory, do hereby make, publish and declare this to be my Last
Will and Testament, hereby revoking any and all former Wills or
Codicils by me made.
1.
I direct that all my just debts,
funeral expenses,
testamentary expenses and all inheritance taxes (whether such taxes
may be payable by my estate or by any recipient of any property)
shall be paid from my residuary estate as soon as practicable after
my decease and as part of the administration of my estate. My
Executor shall have no duty or obligation to obtain reimbursement
for any such tax 50 paid, even though on proceeds of insurance or
other property not passing under this Will.
2.
I hereby give, devise and bequeath all of my estate, both real
and personal property, unto my Trustee, in trust, for the following
purposes:
(al I direct that my Trustee shall hold, invest and reinvest
the same, collect the income arising therefrom, and after paying
all expenses incident to the management of the trust, to use and
apply as much of the income and principal as may be necessary in
the sole discretion of my Trustee, in equal shares, for the

support, well-being and education of my children, SARA ANN YOST and
ROBERT LEE YOST, JR.
(b) I direct that all of my aforesaid real property, shall be
held by my Trustee in kind, for the use and benefit of my said
children, until ROBERT LEE YOST, JR. attains the age of twenty-one
(21) years, at which time all the real property shall be
distributed equally to and between my children as joint tenants
with right of survivorship.
(c) I direct that each of my children shall have the right of
withdrawal of his or her equal share of the remaining principal
and any accumulated income of said trust upon ROBERT LEE YOST, JR.
attaining the age of twenty-one (21) years.
(d) In the event that ROBERT LEE YOST, JR. shall fail to
survive until the age of twenty-one (21) years, the share of SARA
ANN YOST shall be distributed to her provided that she has attained
the age of twenty-one (21) years.
In the event any of my said
children shall fail to attain the age for distribution of their
share and shall be survived by issue, then his or her share shall
be held by my 'l'rustee for said issue and distributed to them
equally as each shall attain the age of twenty (20) years. The
share or undistributed share of any of my said children who shall
not be survived by issue shall be distributed by my said Trustee
equally to my remaining children in accordance with the terms
hereof.

(e) prior to the distribution of any share, my said Trustee
shall have the sole discretion to invade the principal of said
share (including real property) for the support, maintenance and
education of such children or issue of such deceased children,
regardless of age.
(f) To the extent that the same is permitted by law, none of
the beneficiaries hereunder shall have any power to dispose of or
to charge by way of anticipation any interest given to such

I direct that neither my Executrix nor my Trustee shall be
required to file a bond to secure the faithful performance of their
duties in any jurisdiction.

I authorize and empower my personal representative and
