WILL AND T~STAM~NT
1, RICHARD G. CHOTAS, of Wormleysburg, in the County
of Cumberland and State of Pennsylvania, being of sound mind, memory
and understanding, do make and publish this my last will and testa-
ment, hereby revoking and making void all former wills by me at any
time heretofore made.
And first, I direct that my funeral be conducted in
manner corresponding with my estate and situation in life and that
all my just debts and funeral expenses be fully paid and satisfied
as soon as conveniently may be after my decease.
As to such estate as it hath pleased God to intrust me
with, I dispose of the same as follows, vi~:
I. I hereby make the following specific cash bequests, to wit:
I bequeath the sum of $100.00 a piece to my father,
George E. Chotas; my mother, Angeles Greene; my brother,
Elliott P. Chotas; my sister, Chrysanthe Chotas Baker;
together with my nephewR: Phillip Chotas, Mark Chotas and
Michael Hattrup; and nieces: Mary Ellen Hattrup, Becky
Hattrup and Angie Greene, of Harrisburg, Pennsylvania.
In the event, for any reason any of the above bene-
ficiaries should contest or attempt to contest my Will, their

respective bequest shall be forefeited automatically and
lapse back into my residuary Estate.
My residuary Estate shall bear the expense of the
Inheritance Tax due by each of the within named beneficiary.
II. As to all of the rest, residue and remainder of my personal
property, both tangible and intangible, wheresoever situate,
I grant and bequeath the same to my friend, Robert H. Wilt.
III. I hereby grant and devise all of my said real estate, or any
interest I may have in any real estate, wheresoever situate,
and in particular, the real estate situate at 608 North
Third Street, Wormleysburg, Cumberland County, Pennsylvania,
to my friend, Robert II. Wilt.
It is my request and hope that if there is a mortgage
on any real estate, which is not paid off, that the said
Robert H. Wilt will make appropriate effort to continue
making payments towards the payoff of the same in order to
retain the said real estate.
IV. I further expressly authorize and empower my Executor, to
have full power and authority, at either public or private
sale, which in their discretion shall be in the best interest
of my estate, without the necessity of posting bond, or prior
court approval, to liquidate all of my assets into cash, and
after the payment of all necessary taxes, debts, costs and

expensos, the balance of the procoeds shall be paid for the
benefit of the beneficiaries, as set forth herein.
V. I hereby nominate and appoint John J. Krafsig, Jr., Esquire,
to serve as the attorney for my estate.
And I hereby nominate, constitute and appoint Robert
H. Wilt, my Executor, and if he is unable to serve, I hereby
nominate, constitute and appoint John J. Krafsig, Jr., Executor,
of this last Will and Testament, without the necessity of posting
bond.

I, RICHARD G. CIIOTAS, of Wormleysburg, in the County
of Cumberland and State of Pennsylvania, being of sound mind, memory
and understanding, do make and publish this my last will and testa-
ment, hereby revoking and making void all former wills by me at any
time heretofore made.
And first, I direct that my funeral be conducted in
manner corresponding with my estate and situation in life and that
all my just debts and funeral expenses be fully paid and satisfied
as soon as conveniently may be after my decease.
As to such estate as it hath pleased God to intrust me
with, I dispose of the same as follows, viz:
1. I hereby make the following specific cash bequests, to wit:
I bequeath the sum of 5100.00 a piece to my father,
George E. Chotas; my mother, Angeles Greene; my brother,
Elliott P. Chotas; my sister.
Chrysanthe Chotas Baker;
together with my nephews: Phillip Chotas, Mark Chatas and
Michael Hattrup; and nieces: Mary Ellen Hattrup, Becky
Hattrup and Angie Greene, of Harrisburg, Pennsylvania.
In the event, for any reason any of the above bene-
ficiaries should contest or attempt to contest my Will, their

respective bequest shall be rorercited automatically and
lapse back into my residuary Estate.
My residuary Estate shall bear the expense or the
Inheritance Tax due by each of the within named benefiCiary.
II. As to all of the rest, residue and remainder or my personal
property, both tangible and intangible, wheresoever situate,
I grant and bequeath the same to my friend, Robert fl. Wilt.
III. I hereby grant and devise all of my said real estate, or any
interest I may have in any real estate, wheresoever situate,
and in particular, the real estate situate at 608 North
Third Street, Wormleysburg, Cumberland County, Pennsylvania;
to my friend, Robert fl. Wilt.
It is my request and hope that if there is a mortgage
on any real estate, which is not paid off, that the said
Robert H. Wilt will make appropriate effort to continue
making payments towards the payoff of the same in order to
retain the said real estate.
IV. I further expressly authorize and empower my Executor, to
have full power and authority, at either public or private
sale, which in their discretion shall be in the best interest
of my estate, without the necessity of posting bond, or prior
court approval, to liquidate all of my assets into cash, and
after the payment of all necessary taxes, debts, costs and

expenses, the balance of the proceeds shall be paid for the

V. I hereby nominate and appoint John J. Krafsig, Jr., Esquire,
to serve as the attorney for my estate.
And I hereby nominate, constitute and appoint Robert
H. Wilt, my Executor, and if he is unable to serve, I hereby
nominate, constitute and appoint John J. Krafsig, Jr., Executor,
of this last Will and Testament, without the necessity of posting
bond.

5 552a(b) (3); 5 C.F.R. 5 1630.8(b) (3) (1995); 59 Fed. Reg.
26,496 (May 20, 1994), we are authorized to release information
regarding Mr. chotas' TSP account to you.
Our records indicate that the account balance was disbursed on
March 8, 1996, in accordance with the Form TSP-3, Designation of
Beneficiary, which was on file in our office. Therefore,
$16,465.07 was disbursed to Robert H. Wilt; $14,818.57 was paid

upon due consideration of the within petition to pay
returned
bequests into the Department of Revenue pursuant to 20 Pa. C.S.A.
53540. The same is approved and it is hereby ordered that the
Petitioner shall discharge his responsibility for payment to the
said beneficiaries, Phillip Chotas, Mark Chotas, Angie Greene,
Michael Hattrup, Mary Ellen lIattrupt and Becky Hattrup, by issu-
ing a check for moneys to be paid into the State Treasury through
the Pennsylvania Department of Revenue, designating the name of
each beneficiary. The moneys shall be held in a custodial capacity,
subject to refund, without appropriation, pursuant to Section 24
of Article III of the Constitution of Pennsylvania,
This Court shall retain jurisdiction with respect to
any claim to such moneys.
Upon further findings and Order of Court that a Claimant
is entitled to all or a part of the moneys, the Department of
Revenue, upon Petition, shall refund such moneys, pursuant to the
Order of Court.

them for the respective beneficiaries and attached hereto and
marked as an "ExhibitO, is the correspondence relating this
attempt to receive information from them, which is incorporated
by reference and made a part hereof.
5. That their apparent pique cannot be a proper
basis to delay the administration of the Estatel therefore
request is made, as to any bequest checks returned, the same
shall be converted into money to be paid into the state Treasury
through the Department of Revenue. Said moneys to be held in a
custodial capacity, subject to a refund, without appropriation
pursuant to Section 24 of Article III of the Constitution of
pennsylvania. That the court retain jurisdiction with respect

*N.B. Despite diligent efforts to locate the following benefici-
aries, to witl Phillip Chotas, Mark Chotas, Angie
Greene, Michael lIattrup, Mary Ellen lIattrup and Becky
lIattrup, receiving a $100 bequest and the attached
documentation of efforts to obtain the same, the
Executor and the Attorney for the Estate have not been
able to receive the cooperation from several benefici-
aries to secure this information, although it is obvious,
these beneficiaries have such knowledge. That for what-
ever reason they have for their pique, have made it
necessary to request the Court in order to complete
administration of the Estate, to pay those bequests into
the Court, through the Office of Register of Wills; and
thereby place appropriate responsibility upon these bene-
ficiaries to petition for their respective bequests,
pursuant to the copy of the notice sent to these persons,
fully apprising them of the position they have created
for themselves. A copy of said Petition is attached
hereto.

You are further advised of your right, for good cause
shown, to appear and make any objection to the Account that you
deem appropriate, on or before August 26, 1997, at 9100 a.m. to
appear at the place indicated above, to make any such objection.
The undersigned is of the opinion, that all distribution
requested is strictly in accord with the terms and conditions of
the decedent's Will.
But with regard to the $100 bequest made to the following
beneficiaries, to witl Michael lIattrup, Mary Ellen lIattrup, Becky
lIattrup, Phillip Chotas, Mark Chotas and Angie Greene; you are
specifically advised, that due to the inability to obtain correct
address and to receive the cooperation of several of the known
beneficiaries to secure this information, relating to these bene-
ficiaries, that the Orphans' Court Division will be so apprised
of the same. A Petition to pay these respective bequests into
Court, through the Office of Register of Wills, will be made.
Thereafter it will be the responsibility of those individual
beneficiaries to make application for these said moneys, until
said moneys escheat to the state, if not applied for under the
Escheat Laws.
Also any checks received and not cashed within 60 days
from issue, will be not be honored by the drawee bank and will
be deemed to have been abandoned by the particular beneficiary.
Upon approval of the Court of the Audit and Account,
distribution will be made within thirty (30) days thereafter to
you, as beneficiaries of the said Estate, if no objections are
filed.

Elliott P. Chotas, Chrysanthe chotas Baker, Phillips Chotas, Mark
Chotas, nngie Green, Michael Jlattrup, Mary Ellen Jlattrup, and
Becky I~ttrup. The only known addresses are that of nngeles
Greene,

Elliott P. Chotas, 175 Stiles Drive, Marysville, pennsylvania
17053, and chrysanthe chotas Daker, 46B3 Basque Drive, Santa
Maria, California 93455.
3. The said nngeles Greene and Elliott P. Chotas,
are residents of Pennsylvania and the Chrysanthe Chotas Baker,
is a resident of California, with all other said beneficiaries
believed to be out-of-state residents and their addresses cannot
be ascertained.
4. Requests were made for the cooperation of the two
beneficiaries, Elliott P. Chotas, who knows the whereabouts of
the said Phillip Chotas, Mark Chotas and Angie Greenel and
Chrysanthe Chotas Baker, who is the mother of Michael "attrup,
Mary Ellen "attrup and Becky "attrupl by sending the notices to
them for the respective beneficiaries and attached hereto and
marked as an "Exhibit", is the correspondence relating this
attempt to receive information from them, which is incorporated
by reference and made a part hereof.
5. That their apparent pique cannot be a proper
basis to delay the administration of the estatel and therefore
request is made to approve the payment of the said bequests
into Court, through the Office of Register of wills to pay the
respective bequests of $100.00, designating those beneficiaries
who cannot be contacted to complete administration of the
Estate.
