Doris Siebener requested Erwin Reitter to join with her to probate the will, which was in her possession, and the codicil, which was in his possession, but he refused to join with her and refused to produce the codicil; on December 26, 1995, Doris siebener probated the will only and Letters Testamentary were issued to her. 5.) On January 30, 1996, Erwin Reitter, without the knowledge of Doris Siebener, delivered the original codicil to - 1 - the register of wills with the request that it not be probated. 6.) On March 14, 1996, Erwin Reitter notified the register of wills to probate the codicil and since that date Erwin Reitter and Doris siebener have been coexecutors of the said estate. 7.) Decedent's will provides (paragraph 2) that Erwin Reitter has borrowed $33,000.00 from decedent and the executrix, Doris siebener, is directed to deduct this amount, with interest from his distributive share. (paragraph 3) 8.) Decedent's will provides (paragraph 7) that Erwin Reitter borrowed $60,000.00 from decedent secured by a mortgage on his Delaware residence and the executrix, Doris siebener, is directed to collect the unpaid balance, with interest. 9.) He refused to acknowledge that said debts - 2 - are owed by him. c.) He refuses to do anything to settle the estate. d.) Your petitioner believes he will not join in the filing of an account which shows he is indebted to the estate nor will he agree to reduce his distributive share by the unpaid balances thereof as directed by the will. 11.) To the 1I0norable, the judges of said Court: The petition of DORIS SIEBENER respectfully represents: I - PRODATE OF CODICIL 1.) KATHARINA REITTER died March 30, 1995, having first made her last will and testament dated March 22, 1991, in which she named your petitioner, Doris siebener, as her executrix. (Exhibit A, attached) 2.) On December 29, 1991, Katharina Reitter made a codicil to her will in which she named her two children as co-executors, said codicil was made in Delaware while she was visiting her son, Erwin Reitter. (Exhibit D, attached) 3.) Erwin Reitter and Doris Siebener are the two children of decedent Katharina Reitter. 4.) Doris Siebener requested Erwin Reitter to join with her to probate the will, which was in her possession, and the cOdicil, which was in his possession, but he refused to 'join with her and refused to produce the codicil; on December 26, 1995, Doris Siebener probated the will only and Letters Testamentary - 1 - were issued to her. 5.) On January 30, 1996, Erwin Reitter, without the knowledge of Doris Siebener, delivered the original codicil, together with the petition to admit it to probate, to the register of wills with the request that it be held and not probated at that time. 6.) On March 14, 1996, Erwin Reitter notified the register of wills to probate the codicil but the register refused to do so as the codicil was tendered for probate more than 90 days after the date of death and after probate of the will. (20 Pa. C.S.A. 3138) 7.) Erwin Reitter has not proceeded under 20 Pa. C.S.A. 3138 to have the codicil admitted to probate. The will remains in possession of the Register of Wills. 8.) Erwin Reitter has prevented Doris Siebener from settling the estate as the provisions of the un probated codicil must be included to carry out the intentions of the testatrix. WHEREFORE, your petitioner prays that a rule be issued, ordering Erwin Reitter to show cause, if any he has, why the codicil should not be admitted to probate as provided by 20 Pa. C.S.A. 3138. II - DISOUALIFICATION OF ERWIN REITTER AS PERSONAL REPRESENTATIVE 9.) Decedent's will states (Paragraph 2) that Erwin Reitter has borrowed $33,000.00 from decedent and the executrix, Doris siebener, is directed to deduct this amount, with interest - 2 - from his distributive share. (Paragraph 3) 10.) Decedent's will states (Paragraph 7) that Erwin Reitter borrowed $60,000.00 from decedent secured by a mortgage on his Delaware residence and the executrix, Doris siebener, is directed to collect the unpaid balance, with interest. 11.) Erwin Reitter has been furnished a copy of the Pennsylvania Inheritance Tax Return which lists the balance of the $33,000.00 debt and $60,000.00 mortgage owed by him to the decedent as assets of the estate and he refused to agree to the filing thereof. 12.) Solely because of the failure of Erwin Reitter to agree on the contents of the Pennsylvania Inheritance Tax Return, the estate has not paid the tax which was due December 30, 1995, and which has been subject to interest at the rate of 9% since that date. 13.) The estate has not filed the status report required by Rule 6.12 of the Orphans' Court rules as Erwin Reitter refuses to participate in settling the estate, will not join with Doris Siebener in establishing the assets to be reported with the result that the estate is ripe for a delinquency notice under Rule 6.12(b). 14.) II II. day of 01t.""It--.,. 1997, by and between ERWIN REl'l"!'ER, of Hockessin, Delaware, (EIlIUN) - AND - DORIS SIEIlF..NElt, of Mechanicsburg, Cumberland county, pennsylvania, (DOIHS) WHEREAS, Katharina Reitter died testate March 30, 1995, having first made her Last Will and 'l'estament dated March 22, 1991, and a Codicil dated December 24, 1991, and WHEREAS, the said will was probated December 20, 1995 ,lid Letters 'l'estamentary were granted to Doris Siebener, the Executrix named therein, and WHEREAS, said Codicil was never admitted to probate having been presented by Erwin Reitter more than three months after the grant of Letters in violation of 20 Pa. C.S.A. 3238, and WHEREAS, said Codicil named both parties, ERWIN and DORIS to be Co-Executors, and WHEUEAS, Katharina Reitter appointed ERWIN her attorney in fact by Power of Attorney dated December 14, 1991, which, among other things, authorized him to make gifts from Katharina Reitter to himself, and WHEREAS, by virtue of said Power of Attorney, ERWIN made gifts to himself from assets in his hands belonging to Katharina Reitter in the amount of $10,000.00 for each of three calendar - 1 - years, a total of $JO,OOO.oo, and WIIEHF.J\S, ERWIN believed Katharlna neitter was making identical gifts to DOlUS, when in fact no such gifts were made, and the parties intend to compensate her in the amount of $JO,OOO.OO from the reoidue of the estate, and WIIEHEl\S, DonIS presonted a petition to the court for a RUle to Show Cause why tho Codicil should not be admitted to probate and Letters Testamentary granted to her alone, and WIIEnEl\S, on July 1, 1996, a Rule was granted as requested by DORIS and the hearing set by the court for September 16, 1996, and WIIEnEl\S, the parties intend to make a family agreement by which the assets of the estate are distributed to the legatees without filing an account in the Court of Common Pleas of Cumberland county. Ileitter and Doris Siebener were owners of Mellon Bank CD 54923 as joint tenants with the right of survivorship and not as tenants in common. Doris is the owner thereof by operation of law and agrees that for purposes of distribution the $40,000.00 principal sum and interest from the date of death to July 1, 1997, shall be considered an asset of the estate to be equally divided between Erwin Reitter and herself. 3. On March 30, 1995, Katharina B. Reitter and Erwin Reitter were owners of (a) Core States (Formerly Delaware Trust) CD 605585738, balance $20,000.00, (b) CoreStates (formerly Delaware Trust) CD 4602445670, balance $40,000.00, (c) Core States (Formerly Delaware Trust) account 637565260, balance $651.52 and (d) First Bank and 'l'rust Company of Mechanicsburg account 5030094733, balance $5,230.00. All accounts which totaled - 3 - $65,001.52, were owned as joint tenants with the right of survivorship and not as tenants in common. Erwin is the owner thereof by opel"ation oC law and agreos that Cor purposes of distribution, the $65,001.52 principal sum and interest from the date of death to July 1, 1997, shall be considered an asset of the estate to be equally divided between Doris siebener and himself. 4. Parties acknowledge that Doris siebener has not cashed the Mellon CD held by her and decedent and that Erwin Reitter cashed and retained the proceeds of CoreStates CD 4602445670 in the amount of $40,000.00 on April 12, 1995, he cashed and retained the proceeds of CoreStates CD 605585730 in the amount of $20,000.00 on September 30, 1996, he also closed First Bank and Trust Company account 5030094733 and CoreStates account 637565260 and retained the proceeds. 5. For purposes of calculation of interest on the joint accounts it is necessary to impute interest on those accounts which have been closed. It is agreed that the interest itemized in Paragraph 5 in the total amount of $12,149.14, shall be an asset of the estate. Doris Siebener has received $4,323.34 and Erwin Reitter $7,825.80 which shall be reflected in the final accounting. 7. Interest received after July 1, 1997, belongs to the surviving joint tenant. Each party shall be responsible for accounting for interest on all jointly owned assets after that date, which shall be deemed the date of distribution for the final Federal and state Fiduciary Tax returns. 8. DORIS shall receive $30,000.00 from the estate to offset the $30,000.00 in gifts which ERWIN set aside to himself from assets of the decedent by virtue of his power of attorney. She acknowledges that neither she nor a member of her family received monetary gifts from her mother other than birthday and Christmas gifts. ERWIN alleges and DORIS acknowledges that the $30,000.00 payable to her as provided for in this paragraph is solely because she did not receive offsetting gifts from the decedent. 9. The Executrix shall retain $2,000.00 until the 1995, 1996 and final 1997 Federal and State Income Tax returns are accepted by the several taxing bodies and from that sum any penalty or interest shall be paid and the balance equally divided between them. 10. The 1995 Federal and state amended tax returns will result in a tax refund of $878.00 ($589.00 federal and $289.00 state) which will be equally divided between the parties when received. - 5 - 11. 'l'he parties approve the First and Final Account and schedule of distribution of Doris siebener attached hereto and agree to waive the filing of the same in the Court of Common Pleas. They agree that distribution be made upon execution and delivery of this Agreement which distribution shall constitute a release of the Executrix. 12. Each party acknowledges receipt of the full amount to which each is entitled as an heir of Katharina Reitter, subject to the distribution in the future of the amount retained by the Executrix under paragraph 9 hereof which shall be equally divided in the future. 13.
