6. If any beneficiary hereunder should die within thirty (30) days
after me, he shall be deemed to have predeceased me for all purposes
hereunder.
7. 1 appoint as executor hereunder my husband, RALPH J. WEAVER.
If he should be unable or unwilling to serve or to complete the adminis-
tratlon of my estate, then 1 appoint my daughter, BETTY W. SMITH, to
serve in his place. If my daughter should be unable or unwilling to
serve, then I appoint as her successor my son-in-law, S. BERNE SMITH. If
he should be unable or unwilling to serve. then I sppoint as his successor
such attorney associated with the firm of McNees, Wallace & Nurlck, in
lIarrlsburg, Pennsylvania, as shall be designated by said firm. My
executor shall serve as guardian of the property passing to minors as a
result of my death, whether under the provisions oC this will, any trust
Instrument executed by me, any policies of insurance on my life, or in
any other sit~ation In which the power to appoint such guardian exists

MORTGAGE
THIS MORTGAGE, made ae of the ~~ay of February, 1992,
between STEPHEN B. SMITH, an adult ~vidual ("Mortgagor") and
MARIAN S. WEAVER, an adult individual ("Mortgagee").
BACKGROUND:
A. Mortgagor, by his Note ("Note"), bearing even date
herewith, is indebted to Mortgagee in the principal sum of
Fifty Thousand and 00/100 Dollars ($50,000.00), which Note
provides that the entire principal sum and all other amounts
evidenced thereby, shall be due and payable on or before
March 1, 2007.
B. This Mortgage shall be security for the payment of
the Note.
NOW, THEREFORE, in consideration of said indebtedness and
for better securing the payment of the same, and the interest
thereon, and all other sums provided for in the Note ar herein,
to Mortgagee, Mortgagor does hereby grant, convey and mortgage
unto Mortgagee the real property located in 2015 Yale Avenue,
Camp Hill, Cumberland County, pennsylvania, being more
particularly described on Exhibit "A", attached hereto and made
a part hereof, together with any and all improvements, rights,
privileges, hereditaments, and appurtenances, and the
reversions, remainders, rents, issues and profits thereof (the
"premises").
TO HAVE AND TO HOLD the premises unto Mortgagee forever;
provided, however, that if the indebtedness and other sums
payable under the Note are paid in full to Mortgagee, then the
estate hereby granted shall cease, determine and become void.
Mortgagor covenants and warrants to Mortgagee as follows:
1. The recitals set forth above are incorparated herein
as operative provisions of this Mortgage.
2. Mortgagor has good and marketable fee simple title to
the Premises.
3. Mortgagor shall not sell, conveyor otherwise
transfer any right, title or interest in the Premises without
obtaining Mortgagee's prior written consent.

4. Mortgagor shall not permit any lien other than the
lien of this Mortgage to become n lien on the Premises.
5. Mortgagor will keep any and all buildings on the
Premises insured against loss under a fire and extended cover-
age insurance policy for the full insurable value thereof in
companies and amounts satisfactory to Mortgagee, with a stan-
dard mortgagee clause in favor of Mortgagee.
6. Mortgagor will pay any tax, assessment or other
lienable charge assessed against or imposed upon the Premises
when due, and will deliver receipts therefor to Mortgagee
immediately upon demand.
7. "Mortgagor" and "Mortgagee" include singular or
plural, and their respective heirs, executors, administrators
and assigns of the Mortgagor and Mortgagee, as the case may be.
If more than one party is named as Mortgagor, the obligation
hereunder of each such party is joint and several.
8. This Mortgage is intended to be and is a purchase
money mortgage under the provisions of the Lien Priority Law,
as amended.
9. The following shall constitute Events of Default
hereunder if the Events below described remain uncured for
thirty (30) days after Mortgagee notifies Mortgagor in writing
of such default;
a) the failure of Mortgagor to pay any installment
of principal or interest under the Note after the
same becomes due and payable;
b) the failure of Mortgagor to pay any other sum
required to be paid by the Note or this Mortgage when
the same becomes due and payable;
c) the failure of Mortgagor to perform or observe
any non-monetary covenant or agreement in the Note or
this Mortgage;
d) the failure of Mortgagor to perform or observe
any covenant or agreement contained in any written
document between Mortgagor and Mortgagee, whether now
existing or hereafter created; and
10. In the event Mortgagee retains an attorney to insti-
tute an action to foreclose on this Mortgage, Mortgagor agrees
