PETITION FOR APPROVAL OF SETTLEMENT IN SURVIVAL ACTION
AND NOW, comes the petitioner, Alberta Horner, Administratrix
of the Estate of Charles L. Carter, by her attorney, Lisa J. Mauer,
Esquire, and respectfully petitions this Court to approve the
proposed settlement of a survival action, and in support thereof
avers as follows;
1. This Petition arises out of a motor vehicle accident
which occurred on September 26, 1994 at the intersection of East
High Street and Bedford Street in the Borough of carlisle~
Cumberland County, Pennsylvania.
2. At the time of the accident Charles Carter, now deceased,
was the driver of a vehicle which was proceeding through the
aforesaid intersection when it was struck by a vehicle operated by
Defendant Stanley Lanoue.
3. The decedent suffered injuries as a result of this motor
vehicle accident.
Said injuries included a knee injury which
resulted in an above-the-knee amputation in November of 1994.
4. The decedent died on December 25, 1994 from causes

5. At the time of his death, decedent was 66 years of age
and was survived by his wife, Hazel Carter, and one daughter,
Alberta Carter Horner, an adult.
6. At the time of his death, decedent was retired.
7. The decedent's daughter lived with her father until the
time of decedent's death.
8. on December 26, 1995, Alberta Carter Horner was appointed
Administratrix of the Estate of Charles Carter. See Exhibit "A"
attached hereto.
9. counsel fees in this matter are $12,250.00 (35\), with
expenses incurred in the amount of $468.21.
10. counsel recommends the proposed settlement because she
considers it fair and equitable.
WHEREFORE, Alberta Horner, Administratrix of the Estate of
Charles Carter, respectfullY petitions this court to approve the
