COMPLAINT
AND WOW this 13th day of January 2003, comes the Plaintiff,
Graphic T0ch, Dy and through its ownor, Vin~:~nt Willioltts, and files
this Complaint, and in support thereof, ave~3 as follows:
1. ~he Plaintiff, Graphic Tech, is a Pennsylvania corporation,
located at 601 Walnut Alley, New Cumberland, Cumberland County,
Pennsylvania;
2. iPlaintiff's sole owner is Vincent Williams (hereafter,
"Vince") Who is an adult individual residing in Camp Hill,
Cuml~rlan~ County, Pennsylvania;
3. i Defendant, Chenoweth Auctioneers, is a Pennsylvania
comi:~.ny,lOo_~ted at 207 Walnut Alley, New Cuml~rland, Cuml~rland
County, P~nsylvania;
4. .Defor~dant's sole owner, Bill Chenoweth (hereafter,
"Bill"), ts an adult individual residing in Cumberland County,
Pennsylvaria;
5. On or about June 3, 2002, Bill, representing Chenoweth
AuctioneerS, come to Gra~t'~ic Tech and entored into an oral contract
with Vincei of Graphic Tech for the custom design and lettering of a
box truck ~or Chenoweth Auctioneers;
6. Vince gave Bill of Chenoweth Auctioneers a 'ball park'
price of Cne Thousand ($1,000.00) Dollars to letter both sides and
the back o the truck owned by Bill;
7. 5 Lll called Vince to see if the lettering was finished
and get th'.= total owed before picking up the truck;
8. ~ill asked to pay for the lettering when he come down to
pick up the truck ($650.00+Tax). Vince stated that he didn't have an
invoice written out and would have to mail the invoice to Bill;
9. ~'~ill stated that he would drop the check in Graphic Tech's
mailbox when he received the invoice;
10. Vince delivered the invoice to BJ. ll and again Bill asked
if Vincewanted a check, Vince declined, asking Bill to mail it;
11. 3.ftor approximately one mont.h, Vince phonod Bill to inquire
as to the whereabouts of the check owed to Graphic Tech. Bill
stated that he gave the invoice to his accountant and he would call
to find out what happened;
12. ~ftor approximately one more mon~, Vince phoned Bill to
inquire a~ to the whereabouts of the check misplaced by Bill's
accountant. Bill stated that he thought Vince had over charged him
and he wo!ld have to pay Vince in installments;

13. After approximately two weeks, Vince mailed a letter to
Bill asking for payment or a civil case would have to be filed;
14. after no response, Vince, on behalf of Graphic Tech, filed
a case against Bill Chenoweth in Small Cla~s Court on October 30,
2002;
15. At the time of the hearing, an agreement was made between
Bill and ~'ince for Bill to pay Vince $450.00 plus court costs to
settle the case;
16. iHaving never received any money from Bill, Vince appeals
the judgement previously agreed upon and wants the full amount owed

17. This Complaint on behalf of Graphic Tech is being timely
filed with this Honorable Court within the 20 days from service as
specified Dn the Notice of Appeal;
NOW, Therefore, Defendant Bill Chenoweth of Chenoweth
Auctioneers specified the size, color, materials, etc., and
Plaintiff iprepared the lettering in accordance with his request and
written cQntract, there have been no complaints as to workmanship
and/or materials, Plaintiff respectfully requests this Honorable
Court to lorder Bill Chenoweth to pay the amount owed under his
contract, the sum of $689.00, plus all cos~ incurred by Plaintiff
to pursue this debt.

WHEREFORE Plaintiff, Graphic Tech, respectfully requests that
this Honor~le Court ORDER and DECLARE the following:
