C)~-(~iI~ rv1,~'erm, 2002 WHEREAS, Nicholas B. Bonner and Patricia A. Bonner of Cumberland County, Pennsylvania (herein "Owners") is about to execute contemporaneously herewith, a contract, with David Tucker of Cumberland County, Pennsylvania (herein "Contractor"), for the construction work on a building upon 2814 W. Rosegarden Blvd., Mechanicsburg, Cumberland County, Pennsylvania, more particularly set forth on Exhibit "A" attached hereto and made a part hereof. NOW, December 23, 2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Owner and the further consideration of One ($1.00) Dollar in hand paid to Contractor by Owner it is agreed that no lien shall be filed against the building by the Contractor, or any sub-contractor, nor by any of the material-men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Bonner CONTRACTOR: EXHIBIT "A" ALL THAT CERTAIN lot of ground situate in the Township of Upper Allen, County of Cumberland, and Commonwealth of Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point in the western line of Rosegarden Boulevard West 60 feet wide which said point is in the division line between Lots Nos. 7 and 8 on the hereinafter mentioned Plan of Lots; thence extending along the western line of Rosegarden Boulevard West, North 09 degrees 04 minutes 05 seconds West 75.0 feet to a point at corner of Lot No. 8 on the hereinafter mentioned Plan of Lots; thence extending along the division line between Lots Nos. 8 and 9 on the said Plan (the same being the center line of a 25 foot wide drainage easement) South 80 degrees 55 minutes 55 seconds West 134.0 feet to a point in the line of lands of H.S. Service Corporation; thence extending along the line of said other lands of H.S. Service Corporation, South 09 degrees 04 minutes 05 seconds East 75.0 feet to a point at corner of Lot No. 7 on the hereinafter mentioned Plan of Lots; thence extending along the division line between Lots Nos. 7 and 8 on said Plan, North 80 degrees 55 minutes 55 seconds East 134.0 feet to a point in the western line of Rosegarden Boulevard West, aforementioned, at the point and place of BEGINNING. BEING Lot No. 8, Block I, on the Plan of Section 2, of Rosegarden, which said Plan is recorded in the Cumberland County, Recorder's Office in Plan Book No. 28 at Page 141. house. HAVING thereon erected a brick and aluminum ranch style dwelling UNDER AND SUBJECT, nevertheless, to restrictions, reservations, easements, conditions and rights of way of record. BEING the same premises which Edmund J. Wilson and Nancy W. Wilson, husband and wife, by their Deed dated May 28, 1993 and recorded June 1, 1993 in the Office of the Recorder of Deeds in and for Cumberland County, in Book H36, Page 851, granted and conveyed unto Nicholas B. Donner and Patricia A. Donner, husband and wife, in fee.
