HomeMy WebLinkAbout02-6171STIPULATION AGAINST LIENS THIS AGREEMENT made this !~ day of ~, 2002, by and. between MICHAEL MANNING & ASSOCIATES, A PENNSYLVANIA PARTNERSHIP, of Camp Hill, Cumberland County, Pennsylvania, hereinafter referred to as Contractor, PATTI A. DIEHL, single person, hereinafter referred to as Owner, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in East Pennsboro Township, Cuxnberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as Lot #27 Hickory Ridge, Phase I, East Pennsboro Township, CLunberland County, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot abow~ described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Exhibit A ALL that certain piece or parcel of land situate in the Township of East Pennsboro, Cumberland County, Commonwealth of Pennsylvania, being more fully described as follows: BEGINNING at a point on the dedicated right of way line of Sullivan Street at the dividing line of Lot No. 26 and Lot No. 27, Hickory Ridge, Phase I, recorded in Plan Book 77, Page 143. Thence by said dividing line, South 50 degrees 28 minutes 29 seconds West a distance of 52.40 feet to a point at the dividing line of Lot No. 28 and lands herein described. Thence by said dividing line, North 39 degrees 31 minutes 28 seconds West a distance of 124.33 feet to a point on the dedicated right of way line of Black Pine Drive. Thence by said right of way line, North 50 degrees 28 minutes 32 seconds East a distance of 97.79 feet to a point at the western terminus of a 5.00 foot radius curve connecting the dedicated right of way line of Black Pine Drive with the dedicated right of way line of Sullivan Street. Thence by said curve to the right having a radius of 5.00 feet and an arc distance of 7.85 feet to a point on the dedicated right of way line of Sullivan Street. Thence by said right of way line, the following three courses and distances: 1) South 39 degrees 31 minutes 28 seconds East a distance of 8.97 feet to a point; 2) by a curve to the right having a radius of 125.00 feet and an arc distance of 77.93 feet to a point; and 3) South 03 degrees 48 minutes 20 seconds East a distance of 46.04 feet to a point, the place of BEGINNING. BEING Lot No. 27, as shown on Final Subdivision Plan of Hickory Ridge, Phase I, recorded in Plan Book 77, Page 143, and being subject to all easements of record.
