P'dmgrdph No.2 of the Order provides. in peninenl pan: Mother shall have primary physical cU~1ody of the minor children subject to periods of panial custlxly and visitation wilh Father as follows: (B) During the ~hlx)1 year, Father shall have the children up to two evenings per week frolll 5:00 p,m. until 8:00 p.m. Father shall provide Mother with a mini ilium of 24 hours notice as to when he intends to exercise Ihese periods of visitation. During discussion with the conciliator regarding the above provision. the conciliator directed Plaintiff to provide Defendant with a calendar setting fonh his requested weekday visitation. The conciliator funher advised Defendalllthat upon receipt of the calendar, she was to make the children available to Plaintiff for the requested weekday visitation periods. 8. On or about October I. 1997. Plaintiff provided Defendant with a calendar setting fonh his requested weekday visitation for the month of October. On or about October 6. 1997. Plaillliff provided Defendant with a calendar setting fonh his requested weekday visitation for the months of November and December. Tme and correct copies of the calendars are attached hereto as Exhibit MB~ and is incorpordted herein, 9. In Plaillliffs calendars, he requested weekday visitation with the children on October 14. 1997, October 28, 1997, and November 11. 1997, 10. Defendant intentionally and deliberately violated the letter and ~'Pirit of this Coun's September 22, 1997. Order by failing to make the children a\'ailable to Plaintiff on the above dates, Funher. During the summer months, Father shall have two to three evenings per week from 5:00 p.m. until 8;00 p.m. Father shall provide Mother with a minimum of24 hours notice as to when he intends to exercise these periods ofvisitation. 3. The parties shall alternate the following rnajor holidays. those holidays being defined as Thanksgiving, Easter, Memorial Day, Independence Day, and Labor Day. This schedule shall begin with Mother having Thanksgiving in 1997. These periods of partial custody shall be from 9;00 a.m. until 8;00 p.m. 4. Father shall have the children on Father's Day and Mother shall have the children on Mother's Day. These periods of partial custody shall be from 9;00 a.m. until 8:00 p.m. 5. Father shall have the children every Christmas Eve from 9:00 a.m. until 12:00 midnight Mother shall have the children every Christmas Day from 12:00 midnight until 7:30 p.m. 6. Both parties are entitled up to two weeks of uninterrupted custody with the minor children. These weeks may be consecutive. Father is to provide Mother with notice as to when he intends to exercise his weeks of custody no later than April 1st of each year. and Mother will provide Father with notice as to when she intends to exercise her weeks of custody no later than May 1 st of each year.
