Samuel Diaz, being duly sworn. deposes and says:
1. That he is the Assistant Secretary of Fleet Mortgage Corp. flkla
Fleet Real Estate Funding Corp., which has a business address of P.O.
Box 1169. Milwaukee, Wisconsin 53201-1169. and has personal knowledge
of the facts hereafter set forth.
2. That Fleet Mortgage Corp. flkla Fleet Real Estate Funding Corp.
is the owner and holder of a Note dated May 27. 1993 executed by Harold
L. Boles, Jr. and Mary Kay Boles. in the original amount of $99.225.00.
3. That said Note is secured by a Mortgage payable to Fleet Real
Estate Funding Corp.. executed by Harold L. Boles, Jr. and Mary Kay
Boles and recorded in Cumberland County Mortgage Book 1139, Page 19. in
the Recorder of Deeds Office of Cumberland County. Pennsylvania. Fleet
Real Estate Funding Corp. is now known as Fleet Mortgage Corp. A true
and correct copy of the Mortgage is attached hereto.
4. That the present owners of record of the property are Harold L.
Boles, Jr. and Mary Kay Boles, whose last known mailing address is 14
Edgewood Drive, Mechanicsburg. Pennsylvania 17055.
5. That said Note is now in default. the due date of the last
installment being December 1. 1996.
6. That the outstanding balance. exclusive of attorney's fees and
costs. as of December 31. 1997 is as follows:

above are in conformity with the Mortgage documents and
Pennsylvania law, and will be collected in the event of

Mortgage is reinstated prior to the sale, reasonable

4. The Defendants' Answer to Paragraph 7 reads as follows:
7. Denied. Defendants are without sufficient knowledge
to form a belief as to the averments set forth in
paragraph 7 and therefore deny same.
5. Rule 1029 of the Pennsylvania Rules of Civil Procedure
governs the proper procedure for a party to respond to a pleading.
Rule 1029 reads in pertinent part:
bl Averments in a pleading to which a responsive
pleading is required are admitted when not denied
specifically or by necessary implication. A gener-
al denial or a demand for proof, except as provided
by subdivision (cl and (el of this rule, shall have
the effect of an admission.
c) A statement by a party that after reasonable inves-
tigation the party is without knowledge or informa-
tion sufficient to form a belief as to the truth of
an averment shall have the effect of a denial.
6. In Paragraph 7, Plaintiff avers the fact of the
Defendants' default and the amounts outstanding on the Mortgage
Note.

7. The Defendants claim to have no knowledge as to the fact
of default or amounts owed.
8. Pursuant to Rules 1029(b) and (c), the Defendants should
be deemed to have admitted the allegations because no averment of
reasonable investigation has been made.
9. Furthermore, as the mortgagors for the property, the
Defendants are in a position to either specifically admit or deny
their default and the date of their delinquency.
10. Plaintiff verifies in its Affidavit filed concurrently
with this Motion that the Defendants are in default and includes
the amounts necessary to hoth reinstate and payoff the account.
11. Upon Affidavit filed concurrently with this Motion, the
status of the mortgage payments made to and received by Plaintiff
is verified and reveals that Defendants are in default under the
terms of the Mortgage and that no cure has been effected.
12. The Affidavit further indicates that Plaintiff is the
owner and holder of the Mortgage Note dated May 27, 1993, executed
by Defendants in the amount of $99,225.00 for real estate situated
at 14 Edgewood Drive, Mechanicsburg, Cumberland County, Pennsylva-
nia, of which the Defendants are the record owners.
13. By reason of the Defendants' foregoing admissions and the
documentation of default without an allegation that the default has
been cured or documentation thereof. there is no longer a triable
issue of fact or law.
