1:1. On the ..vpnln~ of March lB. H1J7. the Dewndwlt Edwin D. Zeigler. II contacted
the PlalntilT by telepho"" and proposed that the alor<'llaid agreement be modified in that
sald Defendant would be permitted to grout the tile installed by the PlalntilT and thal the
afOresaid total installation prioo would be reduced.
14. On the evening of March lB. 1997, the PlaintilT agreed to the modification proposed
by the said Defendant and the parties agreed to reduce the alOresaid total installation price
by $75.00 to a new total installation prioo of $760.00.
15. 10e alOresaid installation was perlOrmed in a competent and workman like manner
and the PlaintilT perlOnned and completed all of the duties which he had undertaken and
agreed to perlOrm in accordance with the provisions ofth" alOresaid parol contract.
16. On March 17. 1997, the PlaintilT submitted to the Defendants his invoice for the
installation of the aforesaid ,..rami<- tile. A copy of the alOresaid inwire. which includes a
provision lOr late f"lyment char~ at the rate of 1 1/2% per late period of 30 daY'. marked
Emibit No.1. is attached hereto and incorporated herein by reference.
