COMPLAIn
1. Plaintiffs are adult individuals married to each other,
residing at 307 West Dauphin Street, Enola, Cumberland County,
Pennsylvania.
2. Defendant is an adult individual, residing at 34 Courtland
Avenue, Camp Hill, Cumberland County, Pennsylvania.
3. Plaintiffs and Defendant entered into an oral residential
lease on or about March 1, 1997, for the premises located at 307
West Dauphin Street, Enola, Cumberland County, Pennsylvania.
4. Plaintiffs and Defendant agreed to the amount of Three Hundred
Ninety ($390.00) Dollars per month for rental of the 8llid premises.
5. Plaintiffs have expended the amount of '!'Vo Thousand Six
Hundred '!'Velve ($2,612.30) Dollars and 30/100 in rent and in
repairs to the said premises.
6. Defendant has continually violated the Plaintiffs' right to
quiet enjoyment of the premises, by continually entering thereon
without authorization and cause.
7. At the time that Plaintiffs and Defendant entered into the
residential lease, Plaintiff Darlene Edwards made quite clear to
the Defendant, the fact that Plaintiffs needed and wanted to stay

in the premises at least through the end of the 1991-98 public
school year, so that Plaintiffs' son could complete schooling in
the East Pennsboro School District.
8. At the time that Plaintiff Darlene Edwards informed Defendant
of the Plaintiffs' need to stay in the leased premises at least
until the end of the 1991-98 school year, Defendant assured
Plaintiff Darlene Edwards that such a term would be 'no problem,'
and Plaintiffs entered into the arrangement in reasonable reliance
on that promise.
9. Subsequently, beginning in about June, 1991, (three months
after plaintiffs and Defendant entered into the lease), Defendant
began proceedings in an attempt to evict Plaintiffs.
10. Plaintiffs have paid all rents that are due pursuant to the
oral lease, and will continue to pay all rents that are due as long
as they are able to stay in the leased premises.
11. In reasonable reliance upon Defendant's promise made to
Plaintiffs, Plaintiffs have, in addition to the monthly rent,
expended the sum of approximately Six Hundred Fifty-Six ($656.30)
Dollars and 30/100 in necessary repairs and upkeep on the leased
premises, which Defendant declined to effectuate.
12. Because Defendant is seeking to break the promise that she
made to Plaintiffs, upon which Plaintiffs reasonably relied,
Plaintiffs believe and therefore aver that Defendant should
reimburse them for rent paid to date, along with the costs o~ the
necessary repairs that Plaintiffs have made to the premises,

year had expired and that because she was uncertain as to the
length of the lease she could provide, she would not agree to a
term of one (1) year.
8. Denied. Defendant told Plaintiffs that she may need the
property long before the school year had expired and that because
she was uncertain as to the length of the lease she could provide.

not have reasonably relied on such information as a basis for a
term of one (1) year.
9. Admitted.
10. Denied. Plaintiffs have failed to pay rent for August as
of the date of this filing. By reference to paragraph 13 of the
complaint, Defendant denies Plaintiffs' intent to pay future rent.
11. Denied. After reasonable investigation, Defendant is
without sufficient knowledge or infonnation to form a belief
regarding the truth of paragraph 11, and strict proof thereof is
demanded if relevant.
12-13. Denied as conclusions of law requiring no responsive

14 _ on May 5, 1997. Defendant served Plaintiffs with a Notice
to Quit the premises.
15. At the request of Plaintiffs, Defendant granted
Plaintiffs thirty (30) days from May 5. 1997 to find other living

arrangements,
16. On May 27, 1997, Plaintiffs claimed they had entered into
an agreement for the purchase of a new home.
17. On June 9, 1997, Defendant filed a claim for possession
of the premises.
lB. On July 2, 1997, Plaintiffs filed a counterclaim for the
retention of possession of the premises and for breach of quiet
enjoyment.
19. On July 15, 1997, the parties and their respective
counsel met at the Magisterial Court of District Justice Robert V.
Manlove for the hearing scheduled on their opposing claims.
20. At that time, the parties reached an accord and
satisfaction wherein Defendant agreed to withdraw her claim for
possession of the premises and other damages in exchange for
Plaintiffs' agreement to remove from the premises and to withdraw
their claim for damages.
21. In further consideration for the accord and satisfaction.
Defendant absorbed the costs of the district justice action which
she had filed for possession of the premises.
22. The accord and satisfaction was memorialized as a
judgment entered by District Justice Manlove on July 15, 1997, a
copy of which is attached hereto as Exhibit -A- and incorporated
herein by reference and a letter from Plaintiffs' counsel, a copy
of which is attached hereto as Exhibit -8- and incorporated herein
by reference.

Dear Craig:
This is to confirm the results of our mutual appearance before
District Justice Manlove this morning, Your client agreed to drop
her monetary claim and we agreed to drop our counterclaim. Our
intent was that District Justice Manlove enter a judgment twenty
days from today, for your client to gain possession of the leased
premises. District Justice Manlove stated that his computers would
not accommodate that. Therefore, he is going to enter a judgment
for possession, which would require the Edwardses to vacate within
twenty days. Your client is absorbing her own costs.
As you know from our discussions this morning, the Edwardses
have had difficulty in buying a home. They have therefore shifted
their efforts toward finding another home to rent. They have
applied for a lease in Enola. They expect to hear about this by
the end of this week. Hopefully, they will be able to move into
that new location.
Thank you for your efforts toward resolving this matter. I
assume that your client will cooperate with respect to favorable
references, or any other information about the Edwardses that a
prospective new landlord of theirs would need.
